Lawyers React to Katie Magbanua's First Proffer Part2 w/Marcus Weeks

Join former public defender and D.C. lawyer Marcus Weeks (whose RU-vid channel is Debtfree Dad - please subscribe) and Judy the RU-vid Lawyer as we continue watching and reacting to the first proffer video of convicted murderer Katherine Magbanua. Magbanua was found guilty and sentenced to life in prison in spring 2022 for her role in the July 2014 murder for hire of FSU law professor Dan Markel. In the fall of 2022, Magbanua made proffers in an attempt to reduce her sentence. She testified against her ex Charlie Adelson (a former periodontist) at his trial at the end of October 2023. Charlie Adelson was recently found guilty and sentenced to life in prison. Adelson's mother Donna Adelson was arrested 11/13/23 as she tried to get on a plane to flee to Vietnam with her husband Harvey. Wendi Adelson, Markel's ex-wife and Charlie's younger sister, has been named by the State as a co-conspirator, but has not been charged with any crimes so far.

So Katie can clearly remember she needed to have an insurance paper signed by Charlie and she also remembers she was at Yindra’s house …but is almost completely blank on everything related to the hit. She doesn’t realize how ridiculous this is and it’s obvious she’s lying.

51:50 She can remember minute details about some inconsequential vacation, how she noticed her passport was expired while her mom was visiting etc, but can't remember any details about the murder. Hallmark of a liar. Great detail about side stuff to run down the clock and avoid talking about the crime.

Let Katie rot in prison, she's had years and many opportunities to come clean, she made her choice to cover up for everyone so she can sit in prison until she dies . Katie is a liar , she doesn't want anyone to know she was the middlenan , she wants to act like everything was done in secret without her knowledge, I believe her version as much as I believe Charlie's version 🙄

Katie's proffer is all over the place 'like a mad woman's breakfast'. Anything to separate her from the reality of how, why and when it all eventuated. She wants to talk with Sigfredo to cement an even 'newer' narrative - so her sentence can be drastically reduced. In tapes of Katie conversing with others (where there is no need to lie) - she is straight to the point and doesn't mince her words AT ALL.Thank you Judy and Marcus!♥

Correct. I wanted to mention in the plethora of wiretapped calls (thanks, Fanci Fiction!), Katie spoke a ton freely with Charlie; both of them loved to chatter and were kissing up to each other. In this proffer video, she acted like Charlie barely told her anything and kept her in the dark. I don't buy it- she definitely would have asked Charlie for lots of details and knew what she was putting Sigfredo up to.

Katie remembers specifics about money stuff from way back then. She’s fuzzy on anything else, especially stuff that implicates her & others. She mentions her kids several times, her brother caring for them, and Rivera’s mom. Feel she’s told family lies about her involvement and doesn’t want them to turn their backs on her while she’s in prison. She’s relying on them and has no one else. Implicating Adelsons requires admitting stuff to her family about which she continues to lie. Like she did w/hit, she’s trying to play both sides. ‘I wish I could remember cause I want to see my kids, but it’s not my fault that it’s all fuzzy cause long ago.’ Katie mentions Dan in relation to her family for their sympathy. At this point, no matter, she’s not leaving prison for long time and feels her family turning their back isn’t worth a maybe w/regard to her sentence. A reasonable person wouldn’t play. She needs attorney to remind her that she asked to spill beans, and pretending that beans are too fuzzy to spill is silly.

They are not offering her freedom to be honest. An honest murderer does not avoid prosecution just by being honest. "Yeah, I did it." "Well, that's that then, you're free to go, and thanks for the honesty!"

The people that are interviewing her in my opinion are doing a terrible job! They are all jumping in, interrupting each other, and interrupting her Katie. I think just the woman should be asking her questions. It’s a real disappointment to see that they would operate in this manner.

Listening to her talking in this interview is insightful. This woman is crazy, what is she trying to hide, she’s already convicted. It makes sense now why she didn’t take her immunity deal. She’s holding on to some gang type loyalty or something else we simply can’t understand. I wish Sigfredo would talk, we might get a very different story.

Why is she still playing games? She's definitely still minimizing her involvement and maybe all the speaking in riddles and not remembering stems from that. But saying she didn't know about Luis until the bump? Yet Luis tells a specific story about her telling him to take down the pic of the owl from instagram. Why would he make that up? But how does saying she didn't know about Luis help her? And why does it help her to say the Adelson's didn't know to her knowledge when she did? I do not get this woman whatsoever!

She is still not telling the truth or trying to minimize her involvement. If I had ever participated in a contract murder, my adrenalin would have been off the scale. Even if I were such a sociopath the worry about being caught would have been driving everything. I would have remembered when I found out the guy had been killed. It's not like not remembering what I had for breakfast that day. The only way that these details would not be clear would be if she had done 10 or 15 such murders and this one just didn't stand out among the others.

Exactly!!! If I was ever involved in a hired hit of course I would remember every detail, even 20yrs later but especially if my freedom was on the line. I just think Katie is dumb ASF, she doesn't want to admit her part because she thinks they won't offer her a lesser sentence, she thinks if I tell them I knew nothing they'll believe me and give me less time 🙄 I hope Georgia is done with her

Katie remembers taking a Xanax at Charlie’s house July 18, 2014, (8 years prior!!) and she remembers Charlie saying his brother in law had an “accident” that day and he told her he put $$ in her car (money for what?? She didn’t ask??) …but she doesn’t remember anything about arranging hit. Then at 01:42:00 she plays the victim. 🙄 Then her word salad interrogation of the detectives about the bump phone calls 🙄🤨

Great show Judy! OMG its like pulling teeth with this & Part One... But i will say she did REALLY great on the stand @ Charlie's trial... I wish Georgia would have not asked so many close ended q's, i would've loved to hear her give longer answers other than "yes ma'am & no ma'am" but Georgia prolly needed to keep her focused & on track... I wonder if Donna gets convicted if she will wind up in same prison as Katie... This case is so full of irony on EVERY level... I'll bet you could search the planet & never have the mother of a the son who hired the hitman wind up in same jail as her son' s ex girlfriend who is the wife of the hitman she used to write 1,000.00 checks to...so weird... Can anyone get Katherine Magbanua’s prison call recordings? Would be interesting to see hear. On a side note and off topic … I was outraged watching the true crime story of Robert Wone on Oxygen. What a miscarriage of Justice. What went wrong with the case? Did the police not try hard enough?

I covered my friend Robert Wone's murder case in multiple livestreams over the last few years. True Lifestyles has reported on Magbanua's call records and jail records but I'm not sure if the actual call recordings can be obtained.

Didn’t Katie have an opportunity to get out to be with her kids but she would not turn against her boyfriend or husband or whatever? If that’s true, what a fool!!! He’s in prison anyway. At first, she didn't want to help convict Sigfredo, who was also facing the death penalty. But after he was convicted, my guess is she was overconfident and thought she could get off scott free, so she still wouldn't make a deal.

Katie clearly says that she wants to talk so that they can offer her freedom to get back to her children. They are not promising her anything like that and that’s why she is withholding information. They say to her you have to come out with the truth because nothing worse can happen to you. And they tell her that Charles case is stronger than hers. Ie they tell her that they don’t really need her and that they will not offer anything. So she can’t say everything until someone promises something to her.

How can they make a guarantee before they know if the information she has is of any real value? Even if she were 100% honest from the second she was arrested she would still be in prison. The law doesn't say "We don't convict honest murderers." All the honesty in the world doesn't make up for murder. They may be able to offer her something for her belated honesty, but getting away with murder won't be one of them. In the case of Brian Winchester they offered him immunity because they needed his testimony to convict Denise Williams AND he was already facing 30 years on a kidnapping charge, so he's still doing hard time.

Yep, the investigators don't meet with her dangling a deal in front of her. She has to offer information first which they would try to corroborate, if possible.

Am I the only one that thinks Rashi should have played this for Charlie’s jury? Katie seems to be pumping for details. With her lack of details, her testimony could be interpreted to fit his theory: murder first, extortion later. She appears to lie through out. You could argue to the jury to disbelieve all her testimony.

I’m hoping that Katie’s brother , on the witness list and also Katie’s attorney on the witness list for Donna’s trial will offer more insight into if the Adelsons were paying any of Katie’s attorneys or taking care of her kids on the outside. Witness lists aren't due until 8/12. Those were all sorts of people that the State deemed to have relevant information & had to disclose to the defense. But-- I sure hope Francis Magbanua & Tara Kawass will testify for the State about Donna offering money, plus more damaging info.

Charlie would have a hard time appealing for ineffective counsel. He was on the jail house calls saying "I can't appeal due to ineffecive counsel, because I had a great laywer. Dan did a great job."

@@aalegalfocus After hearing 4 or 5 experts comment, I think Rashbaum really did do a lousy job all the while probably relieving the Adelson family of a million or more dollars. While people say "he did not have a lot to work with," that extortion defense was almsot guaranteed to fail. He would have been better off having Charlie keep quiet and try to make it look like it was Wendy who did it and Charlie was only doing damage control after the fact. That would have had a much better chance even if maybe less than 50/50. Meanwhile, Rashbaum botched the jury selection by not being there. He failed to object to all sorts of things during the cross on Charlie. He got all emotional when he should have focused on just being cool and logical. Then, he exhibited this horrible body language toward Charlie (as if he didn't like him) at the end, and his closing was long, convoluded and boring. At that point he needed a hail mary and he produced a dud of a closing. Lawyers who have a difficult case like this should go and watch Jose Baez during his opening and closing on the Casey Anthony case and repeat his language on "reasonable doubt" almost verbatim.

I think Katies attornies cried because they knew they took this case to court for the publicity and also waved attorneys fees for same reason. She was truly crying and it was because she knew she should have made Katy take the immunity deal. I wish someone could go meet with Katy and file for ineffective assistance because thats what she got! Katy got the worst deal for passing an envelooe...she truly did and it sucks. You dont tell your client to pass on immunity and convince them to go to trial. Just think about it. How do you feel about that Judy? I pray an attorney will help her. They wanted the camera's on them and thats so wring. I just know that has to be the reason because why else did she take her case? Katie didnt pay her, Charlie didn't either. So....? Hope to here from you. Also my husband is a judge. Longest sitting judge in Tennessee for 42 consecutive years. We talked and he feels the same about the attorneys and how they let Katie miss such a sweet deal. They had to have taken it for the platform and exposure in front of the cameras. Im mad about how they did her. How do you feel Judy or what do you think?

Hmm... I'd previously missed the detail that Katie had a Xanax habit. I know Charlie would hand out prescription drugs like candy but if she took Xnx regularly (prescribed or not) that isn't something I'd heard before. She did contract Covid twice in jail (horrible comment on jail infection control and I feel super bad for her) and covid has been known to cause confusion.

Judy- So I listened to your audio during this stream, and I think it’s fine. I was really trying to give ML a tip to grow his channel, because he posted that video about not enough people watching. The slight echo is his office, plus the low hum of the computer fan- That ruins the audio quality, which totally reduces views.

2:02:53 Kawas was just play acting with the crocodile tears to justify taking money instead of doing right by Katie. As much as Rashbaum had nothing to work with on Charlie's behalf, Kawass could have gotten Katie off ! Maybe Katie couldn't face her children if she confessed? That makes sense. If her son was 15-16 then, he would be so ashamed.

I believe much of what Katie is saying - she was manipulated and is unable to make sense of a lot of what she was told. I think that there is more likely an issue with Luis' belief that KATIE said "I Know!" on the phone after the hit. Siegfried and Wendi aren't talking - but they likely are the two that had the conversation that a woman said they knew the hit had occurred.
