Reforms to leasehold and freehold in England and Wales have become law - but without a promised cap on ground rents.
The new law aims to make it cheaper and easier for more people to extend their lease, buy their freehold and take over management of their building.
But plans to remove ground rent for existing leaseholders or cap it at £250 have been dropped.
The Leasehold and Freehold Reform bill was one of the last pieces of legislation to make it through Parliament on Friday before it was shut down for 4 July’s general election.
Levelling Up Secretary Michael Gove - who has announced he is standing down as an MP at the election - had originally wanted to cap ground rents at nominal level.
That was changed to a planned £250 cap - but the idea was dropped altogether as the legislation was rushed into law at the last minute on Friday evening before the dissolution of Parliament.
Barry Gardiner, the Labour MP for Brent North, presented "LEASEHOLD", a documentary exposing the injustices of our feudal housing system. He spoke to Matthew Wright on LBC on the morning after the Leasehold and Freehold Reform Bill was passed in to law.

Ground rent basically sums up GB right now.... pay a lot of money for literally nothing.... they treat you as cattle.

What about lease extensions? What has happened to this? Also the cladding problem, I’m currently in a ground floor flat with Woking borough council and they ripped apart our cladding last week without even explanation on who is responsible for remediation work! I’m livid, no one will answer my questions or tell me anything. I can’t even afford to pay the energy bills then this month I’m hit with this shock. I’m afraid I have to pay thousands of pounds to replace the cladding which is now proved to be unsafe. I purchased the leasehold 20 years ago assuming I’m buying a fire safe home and now I’m stuck with a flat with repairs in the thousands, after removing the cladding the breeze blocks underneath are completely naked and not waterproofed and left to all elements of the weather not to mention the rain which will cause so many issues in the future. Our double glazing was found not to be safely installed by the original contractors and they were not properly fitted. To top this off I’m also not well with chronic conditions and this will cause me more stress and anxiety. 😢

the first house my ex-wife and i bought was leasehold, it it was on church land, we had no service charges and the ground rent was as you say, peppercorn, £5 a year i think it was, this is why when i bought my current place as leasehold i had no idea the problems i would run into, just extending a lease took nearly a year to sort and cost £6000, and i have to do it all over again 5 years on, you basically buy a piece of pepper, not bricks and mortar, and the freeholders can't wait for something to wrong then they pounce on you with law and start running up "legal fees".

Doesn't make sense that we should have such a feudal extractive system when we have Jacob Rees Mogg in the ruling party? The Tories are the party of the landlord class, it makes perfect sense.

Richmond Village leases Run by BUPA are harsh 10% event fee if selling £600 + monthly charge . unqualified managers ripping off vulnerable + 80s.. especially at Aston. on Trent where i reside.bullying the norm.

Luckily our conveyancer spotted the ground rent increases in line with RPI. It was at £248 per year, so would've pushed us over the £250 per year mark (outside of London). We managed to get the ground rent capped at £250 per year. My advice to anyone buying a leasehold property is query the ground rent with your solicitor/conveyancer. The amount payable is critical when it comes to re-selling the property as lenders may not lend on properties where a ground rent exceeds £250 per year, due to the risk of eviction. Pay for the deed of variation and save the stress further down the line!

The Conservatives did not bring in peppercorn rates because they were being given threats to be sued for millions or billions by the freeholders. The Bank of England advised the gov not to do it, the freeholders said the leases were to pay for pensions they were pension investments. In my opinion leaseholders are pawns being used to subsidise these greedy investors. I believe pensions should be paid by industry but the gov sold off a lot of the UK bluechip firms. It's the poor leaseholder who now has to suffer a much watered down reform bill.

Does nothing on the Ground Rent which is NOT peppercorn rates. Has not helped the Leasehold properties that need to be extended! 😡

i'll be going to court over the terms of my lease soon, so this could prove interesting... i had to extend my lease 5 years ago, expecting to have sold and moved by now, i not only paid £5000 for the extension but another £900 to cap the rent. as i haven't moved i have to do this all over again if i hope to sell.

I do not agree with Barry Gardiner politically, but on this subject he is totally correct. The only place in the world where you buy a property & don’t actually own it. The flat owners need to have control over their own properties.

I agree in respect of your comment about buying a property, basically however its the land and outer shell of the building which you do not own - hence ground rent. There are undoubtedly some leases which should be explained in more detail by solicitors to the buyer - most buyers do not understand the full implications of a lease - then why should they? that is why you have a solicitor, the number of times I come across leaseholders who do not have a clue to what they have signed is very worrying - going back onto the leases that increase and often double periodically - particularly on new properties, it does allow the developer to sell the properties at a lower price and the actual cost is reclaimed by way of ground rent over a period - understandably the developer needs interest on the loan that he has made as well as lost profit etc - This subject is very deep and needs longer than a couple of lines, suffice to say that in principal I don't disagree with your view that owners need control over the property they have bought, however you can always buy the freehold if you and a number of other flat owners group together to do just this. You would need the advice of a specialist surveyor for this but you can get basic guidance from various government sources - google lease enfranchisement

@@dahb1945 , This type of ownership does not belong in the 21st century, all other countries manage it. Let people own their flats in perpetuity no lease extensions & the owners to be in charge of the maintenance etc. The freeholders can invest in other things such as stocks & shares.

All irrelevant nonsense. It's the existing property 'lease extensions' that takes the p*ss not the 'ground rent'.. To clarify, it 's not always the 'tenant' that has the cost of 'leases', it's whoever owns the property.

Barry Gardner is absolutely correct about ground rents. Where he is wrong is the abolishment of leasehold that potentially works for flats. It's the irresponsible estate managers who require being held to account and the offshore freehold ground rent collectors who should be held to account by tough legislation that means they are liable for poor service by fine or loss of ability to operate in business. THE DAYS OF SECOND RATE LEASEHOLD SYSTEMS IS NEARING THE END.
