The way appellate courts work is, A) A lower court issues a decision, which in this case would be a criminal conviction, and B) the defense files an appeal to the appellate court on the grounds that the lower court failed to follow the law or proper procedure, at which point the appellate court actually has the jurisdiction to take some action if appropriate. All of that would only occur if and when there is a guilty verdict. If he’s found innocent the point is moot because the prosecution cannot appeal.

This happens to people every day. I have been railroad right through a courtroom. The judges told me that they didn't care what the law said. I was in his courtroom, and he was the law. I was showing him the DOT handbook for CDL, and he told me that was not a law in his courtroom. It happens every day to good innocent people. 😢

Okay, your legal analyst needs to read McAfee's ruling. It's one giant appealable issue. He literally says her behavior was improper and that her testimony had an "odor of mendacity" (that is, he thinks she lied under oath). His legal reasoning in not removing her is flimsier than tissue paper in a hurricane. The guess of people more experienced than I am is that he's up for election soon in Fulton County and didn't want to make a politically unpopular decision. So he peppered his decision with reversible errors galore and kicked it up to the appeal court to do the dirty work.

At the end of the day Fox or CNN can give their "analysis" on the legal contest of the testimony but the final say is the jury. Common people like you or me with no vast legal knowledge will decide the faith of the defendant. Her testimony might not be relevant to the analysts but they know that could be really significant to a jury or "touch the nerve of discontent". We need to see how this playout because we don't really know.
