Its easy to say that he should sue. The reality is that living with pending litigation is a burden, and especially for a sitting Justice. I agree that he has a basis to do so, but no one should interpret a decision by him not to do so as any sort of admission of guilt. His family might do well to close the door on this and heal privately.
