He never claimed they were. Assistance animals like ESA's and service animals are very beneficial for people for all kinds of seen and unseen disability's

YES THEY ARE IN HOUSING...the same law applies to both......Fair Housing Act....as well as some state laws.

An ESA is not covered by any Federal law.

Not true. They are covered by Federal Housing laws.

Any landlord who does not believe it is Federal Law opens them self up to a minimum of $10,000 in fines if they deny them. I suggest people research American with disabilities act 1974 when concerning ESA.

um, its not a new law. its a clarification and guidance on the existing FHA law. No, not all rules are waived.....assistance animals must behave, can't cause a disturbance.

I have been living in my complex for 6 years never late on any payments or any issues our complex has no pet policy. . My daughter is in need of therapy dog support for anxiety and other issues . So my question is do I get the letter from her therapist and psychiatrist and present to landlord first or I can get the dog first and than give them the letter once they request it . Thank you for your help.

Why would you "get" a dog first who might chew her face off or a yippy dog who would bite her nose off, before your licensed shrinks want to put in writing, with their signatures, that she needs a "therapy dog"? You didn't ask, but I would get her licensed medical doctor (psychiatrist) and (I presume licensed) therapist to weigh in. Honestly, I would not "get" a MiniChowWhoopieFrizzie from the friendly BY breeder who says they are sweet and only $1,500? How Come Why the MD and state-licensed therapist no give you letters already? You didn't ask, but why not move to a place that accepts pets? Easy Peasy No Rent Control Lemon Squeezy.

@E Boston Actually if you request your therapy dog to live with you even though it is not a service dog and they allow it they can live with you come back when you’re not retarded

Your daughter can NOT have a therapy animal. Therapy animals do NOT work for one person, they only work with many people in institutional settings.

If your complex has no pet policy your daughter can have a pet without any problem....

they need to have an actual ID on the service dogs /in training maybe with better treatment for retired service dogs since they've received extensive training already The ID would be kept on them maybe visible in a clear pocket they need to be government recognized in other words more so at least

No they absolutely do not have to have any ID/tag/vest saying the animal is a service animal. Nor do they NEED to have "extensive" training; they just need to be trained to perform a task that helps their person with their disability. Yes, many service animals do go through extensive training, particularly seeing eye animals & seizure-sensing animals & whatnot & the animal SHOULD absolutely be fairly well behaved in public but they really ONLY need to be trained to perform (at least) one task to help their person with their disability. They do not need to be registered as a service animal (an ESA doesn't need to be registered either)... All a person needs is a note from their doctor. (Or apparently as this video says, a social service worker)... All that said, IF the animal IS clearly identifiable as a service animal, no one can ask you for proof. If the animal is NOT easily identifiable as a service animal, they can ask you only TWO questions: 1) Is the animal trained to perform a task due to a disability & 2) What is the task the animal is trained to do? They may NOT ask what the disability is, for identification, paperwork, or ANYTHING other than those 2 questions. As I don't believe anyone should just believe everything/anything they read online without fact/source checking, please verify this information for yourself. (: Service animals are protected under the Americans with Disabilities Act & any of this information can be verified by visiting ADA.gov

@@Skittle02 My service Dog wears a vest with an ID tag due to my PTSD and Have a Letter from my VA Mental Health Doctor and for my vision injuries (flash bang in Iraq) i'm not blind but can't drive but can see well enough to get around (had double Cornea transplants 2nd one just 3 weeks ago just got worse over time) Now I know there not required but there are days I don't want to interact with people . he leans against me to tell me he's there and I didn't really train him to do that he could just tell when I'm stressed from sites and sounds and sees my mood swings and jumps up with his front legs like he's hugging me. have had a few times people ask me what my disability is and told them 1) thats illegal to ask and 2) look at the patch on his vest. they go PTSD? and tell them yea I have him to keep me from coming after you. they got it.

Some landlords says no pets. Also means no health related to have a pet. People forget landlords dont have to renew your lease.

A landlord can also say well I'm going to get ride of my rentals and sell them landlords don't have to rent their property out or they can say hey I'm just going to leave them empty

in about 10% of the US, landlords need a reason to terminate tenancy even after the lease is expired. and while hard to prove, unless the landlord has a reason such as lease violations,the tenant can argue discrimination

Its also not easy to get hold of the houseing program to up lift you on your side thats whats in there web site to tell you can not be charged or told to leave your place of liveing paying rent. Thay need to open more up in there ESA web site that really does protect you and your ESA rights. To get a hold of thoes in the HUD houseing with the Fedrule goverment.

I’m not on the lease but i have a support dog can the landlord charge me if I’m not on the lease ? But i live in the unit ?

I sent a request to my landlord to accept or deny a cat for an emotial support animal. In the request there was a letter from my doctor stating that he strongly advised me to get one for mental health. The land lord replied stating they need me to fill out additional forms which is a contract with additional rules and stipulations of their own. Can they make deny my request and make me sign a contract even though I've provided proof by a medical doctor. I'm seeking legal advise on a potential claim now. What do u think guys?

No, ABSOLUTELY not. My best friend just went through this with her HOA. You can ask free legal questions from lawyers at avvo.com & they'll answer this for you but the short answer is ABSOLUTELY not, they cannot make you sign a contract or ask for ANYTHING more than that doctors note.

without seeing the contract, impossible to say. they can't require a specific medical document, but they can require a list of reasonable rules such as no excessive noise, dog must be on a leash, dog must be walked at the curb or designated area and trained not to pee all over the front lawn.

Thay tell you with a ESA you can not be kicked out of your place where you rent if you have a ESA. And thay can not charge you extra. Welles landlords have some rights. But i dont know there rights. One thing ESA didnt say that landlords have the right not to renew your lease.how about that one.

Not everyone can afford court costs. And no one should have to go to court for this. Landlords should no better. To kick people out of there home for how many months or years. Thay should follow by law. About ESS support no matter where or by who that's not the point it's documented that's all landlords need to know documented Don't look for the housing program to help you not in pa. State. Thay don't work in the department of a ESA. The ESA needs to cover all outlites like this about landlords. That people with ESA are no problems cause it's legal. Don't trust every landlord you see either. And not everyone in apt. Buildings have health issues either don't be fun to fall for that. Cause landlords will say if I let you in than others will want dogs to. Well than how about getting a real doctor's letter from your own doctor. What could landlord say to that. We know darn well not everyone who lives in a apt. Building is going to get a doctor's letter saying there aloud to have a cat or dog because there on medication or there dyeing or there depressed or that have a cold or that can not walk than it means everyone has some kind of mental state. I don't see all that happening that's what I would have told my landlord. Don't ever under estimate landlords whether educated smarts or not. Let them know your not as stupid as that think you are I stand up for anyone with a ESA support animal. My rights were tossed out the window cause I didn't think by there was no problem. But I always wanted to mover after 10 years. Ps. Don't fall for nice that can be a mask under the true colors of who thay really are and how thay act some not all landlords some are on power and control trips that feed on on that.

Can a condo association legally request documentation for an ESA. Is a simple written request legal?

Yes. A condo association or HOA can ask for documentation for any ESA., in the forms listed in this video. Once a letter is provided from a doctor or social service rep, nothing more can be requested/required.

I have 2 service dogs one is 9/12 yrs old and the other is being trained to replace him when he retires. and yes he's going to enjoy his retirement here at home.
