New York, NY - Looking dazed and speaking barely above a whisper, a Brooklyn hardware store clerk pleaded guilty Thursday to charges he abducted and dismembered an 8-year-old boy who lost his way home.
The guilty plea, to charges of second-degree murder and kidnapping, guarantees Levi Aron a sentence of 40 years to life in a case that traumatized the victim's tight-knit Orthodox Jewish community.
Aron, 36, had previously pleaded not guilty to a first-degree murder and, if convicted, would have faced life without parole. But the family of Leiby Kletzky urged prosecutors to strike a deal to avoid the painful spectacle of a trial.
"There is no way one can comprehend or understand the pain of losing a child," the boy's father, Nachman Kletzky wrote in a statement distributed to the press. But he added that the plea gave the family "some partial closure on one aspect of this nightmare."
Legal closure came Thursday afternoon after an expressionless Aron was led into the courtroom wearing an orange jump suit, handcuffs and a yarmulke.
Judge Neil Firetog began by telling him that after seeing psychological reports, he was convinced claiming mental illness was "not a viable defense."
The judge then had Aron answer a series of often leading questions about his conduct. His one-word responses were delivered in a low, flat monotone after long pauses and prodding by his lawyers.
Aron expressed no remorse and only hinted at motive: At one point told the judge he felt "panic" when he found out there was a frantic search on for the boy, who was still alive in his apartment.
The judge asked him what he decided to do, and he responded simply, "Smother." He also answered yes when asked if he had bound and drugged Leiby.
Afterward, defense attorney Jennifer McCann insisted that her client, though under medication, knew what he was doing.
"He came here to accept responsibility for his actions," McCann said. "He understands the charges."
One of the city's most gruesome crimes in recent memory began with a chance encounter last summer on the streets of Brooklyn neighborhood of Borough Park, home to one of the world's largest Hasidic communities outside Israel.
The victim got lost on his walk home from a religious day camp and asked Aron, whom he met on the street, for help, prosecutors said. It was the first time the little boy was allowed to walk alone, and he was supposed to travel about seven blocks to meet his mother but missed a turn.
According to court papers, the defendant himself provided authorities a disturbing narrative of what happened next.
During an interrogation after his arrest and in a written confession, Aron recounted how the boy first asked for a ride to a book store. But "on the way, he changed his mind and wasn't sure he wanted to go."
The defendant described deciding to take the boy to a wedding upstate. He said when they returned, they watched television before the boy fell asleep. Leiby remained there watching TV the next day while Aron went to work at the hardware store.
By that time, Borough Park was buzzing over the disappearance. The boy's picture was plastered on light posts around the area.
"When I saw the fliers, I was panicky and afraid," police said Aron wrote. Once home, he added: "I went for a towel to smother him. He fought back a little until he eventually stopped breathing."
Detectives' notes also outlined statements by Aron about how he carved up the body with knives and disposed of body parts, including the severed feet found wrapped in plastic his freezer. A cutting board and three bloody carving knives were found in the refrigerator.
The rest of the boy's body was discovered in bags inside a red suitcase in a trash bin. His legs had been cut from his torso.
Aron claimed that after the killing he was hearing voices telling him "to take his own life for what he did," according to court papers.
As the interrogation wore on, detectives said Aron made clear he was aware of his own notoriety, "I'm famous," he said.

Oh I don't know so much about it being a case of 'only in America'.Only a few days ago here in the UK a 9 year old girl was walking alone when a guy attempted to abuduct her,in plain sight.Fortunately she kicked & struggled & managed to break free & arrived home. But it could've gone so horribly wrong.Thankfully such incidences seem relatively rare in the UK tho' just 1 child being abducted is 1 child too many, wherever he/she lives in the world.I hope your sister remains safe.

Not in any way defending this individual,BUT who the hell let's an EIGHT year old walk home alone?! The world is full of sadistic low-lives so to think of a kid as young as this being allowed out alone,to my mind,is just unconscionable. But I've no doubt his parents deply regret making such a decision. What a tragedy.

Only in America bro that you can't do this. My 9 year old sister, goes on the train herself, walks home by herself and everything really. Only in America where you get kidnapped if you walk a lone, helpless

what i mean is, only in big cities and countries like USA, UK, and Australia, etc where the crime rate is 'not low', child kidnapping happens.

Would you also describe Portugal as a safe country? That's where Madeline McCann was abducted 5 years ago & hasn't been seen since.Portugal is known as a safe place to visit for families in particular. What I'm saying is nowhere can or should be considered entirely safe from such incidences.I don't know Singapore, where you are,but I can only assume it's an incredibly safe country!

For some reason, this case really hit me. I think it's mostly because of the innocence that little Leiby seemed to have, especially when seeing photos and that video of him walking down the street. It's just really sad that a little boy can not walk down the street without being in danger, in broad daylight nonetheless. I don't want to imagine the pain and terror he went through. It's just so sad.

I wouldn't say any country in Europe is safe, not to be mean or anything. Singapore is so small that the police can control it's entire country. You can't see Singapore on the world map btw. I have a aunt/uncle/cousin in America and when they visited singapore, they were so shocked to see that my 9 year old sister goes home by herself from school taking the train + bus on her own. I (15) travel a lone too, I don't really think about safety because there's virtually no crime here.

You know,I kinda guessed my comment could be somewhat controversial as these tragedies usually only engender reaction against the perpetrator of the crime,& understandably so.But in the interest of balanced debate I did want to ask why a child so young would be allowed to be out alone.Your point about this neighbourhood being considered safe is perfectly valid, moreso in that it highlights,(retrospectively),how wrong we sometimes get it.A salutory lesson to learn, sadly.I do feel for the parents.

Ummm, the man is clearly incompetent as evinced by the fact that his lawyer had to repeatedly shake his head yes in order to signal to the client the correct answer. WTF?

well the country is small but with over 5 million people here, it's just crazy with traffic jams and all that. I guess I am lucky. I never lived in 'dangerous' cities so if i do one day, I will have to be careful on who's around me, my environment, etc. May I ask which country do you live in?

very nice place I always knew New York isn't the safest place to live in because the city is big so you can expect some crimes going on.

I wouldn't consider your comment 'mean',the countries which make up Europe do have more than a fare share of crime including child abductions. And I'm sure you consider yourself fortunate that you live in a country which has a small enough population that the Police are capable of monitoring & dealing swiftly with criminal activity, whatever form this takes. :-)

'Over 5 million people',so not quite so small, haha.I think I'm correct in saying that William & Kate visited Singapore on behalf of the queen last summer as part of the Diamond Jubilee celebrations & they both spoke with much admiration for the Country.I'm sure you WILL travel one day & I'm equally sure you'll adapt sufficiently to your new environment/s. And I live in England.

Well yeah,England DOES have some amazingly beautiful areas, though like any other country it has it's not so good areas. And certainly New York does appear to have a particularly high crime problem but I can't say definitively as I've never visited The States.Ok,cool chatting with you but I've got to go eat.Take care. :-)

If you believe in justice and due process then you have to believe that everyone is entitled to a defense. It's the only way to prevent false incarceration and corruption especially when dealing with the indigent and/or minorities who have pre-existing strikes already against them. This case was indefensible as ALL of the evidence pointed towards this monster, any defense was just a formality. Personally, I think this is a case that merits the death penalty. Murdering one of the most innocent of victims- a child with no real knowledge of the outside world..
