I hope that this case also exposes MSP Fanning to the highest degree. Fanning’s actions have destroyed trust in the jury process in Massachusetts. I hope that he is prosecuted and causes the Courts to get MSP OUT of deliberation rooms. Especially when there is a case that EVIDENTLY involves bad actors who wear the badge of the MSP.

this is an utter failure of the Judge , not making it clear , having a complicated form , complicated charges and not polling the jury to find out what they were hung on
I will bet that she has done this many times before , when she did not want the jury verdict . This woman is not stupid , but very cunning and manipulative . She sold her soul to the devil , many years ago , I think .
This woman was a public defender for crying outloud .. I would never have any faith in her running anything right... I have seen public defenders at work and they are not for their client
I hope Karen Read can be freed and get $$ for interviews, book, etc. to help pay legal fees - they are worth every penny & absolutely rock!.. it won't buy back the years of life and pain she will have lost. She can be proud horrific injustice was uncovered.

Judge Cannone can go down in history (with her name) as setting precedent doing the right thing BY LAW. I will pray for this judge to be brave and set precedent for this. Weinberg has EVERY out for her to do so and become an American & Massachusetts hero (Prosecutor had no worthy argument). If she does not, Weinberg's argument to appeal court will retire her as an OVERTURNED judge- thats forever. So can her glory be. Please everyone, just pray to give judge strength with love...no hate in mind...to do the right thing to declare an investigation ( then, hopefully dismiss later.) But right now, she should call jurors in secretly for investigation into this!

Wineburg was an absolute boss! He oozed absolute class, knowledge and wisdom and bombed Lallyflops "argument's" That oral argument was perfect! Lally said absolutely nothing that was not demolished immediately after or before he had a chance to utter a word. He brought nothing new and all the "legal" grounds he argued were obviously disingenuous and not at all what the previous rulings were even pertaining to. They cherry picked sentences and hodge podged something that sounds somewhat analogous to their points but when you actually look at the cases in full and is plain as the nose on your face that they are not the same situation in ANY of his examples and that is dishonest to the tribunal and unethical per usual. That was perfection and I wish this judge would come to her senses and try, genuinely try to be fair and rule in the interest of justice, due process, defendent's rights to a fair trial and not rule in favor of one of the oldest protections afforded to the American Justice system & make this woman face double jeopardy. This is absolutely totally wrong and if there is a chance in heck she was convicted of count 1 or 3 then it would so clearly be overturned in a heart beat. Its so short sighted and unjust. Unfortunately, we are not surprised!
Why did the jury instructions say “do NOT return any verdict information until you have reached a verdict on ALL THREE charges?” The jury followed that instruction.
I am licensed in Texas. Here, the rules of evidence require standards for what constitutes evidence admissible in court. If a judge deems that evidence doesn’t meet the standards for admissibility, it is not shown to the jury. No prosecutor would accept the solo cups, zero chain of custody or inverted videos. Any PD would know better than to try and run THIS “evidence” by any DA because they would be in trouble for wasting resources. And thank you God, zero charges can be brought when the ME says the manner of death is undetermined. Rant over🙄
This was my biggest issue from the start! Judge should not have allowed any if this evidence into trial and case should never been brought with ME saying undetermined and also saying not conclusive of normal hit amd runs. Add on text messages from head officers about swaying ME's final decision. Its absolutely disgusting and immoral.
I'm having a hard time believing Weinberg, who is brilliant, did not point out that the very last jury instruction read by Bev said "do not fill out any verdict forms until you have unanimous verdicts on all counts." Thus, even if they had decided on counts 1 and 3, they were told not to fill out any verdict forms yet because they were hung on count 2. Bev failed to contemplate this possibility and poll them.

@@kathymazzola1200 Yes, definitely happened. It's easy to find on any stream channel, at the very end of the segment with Bev reading the jury instructions. It's the very last instruction.
Oooh also while i remember, not only did Karen rock up wearing blue but she sat without any of her attorney's between her and Paul. She just turned away from him without once looking like she needed shelter from his gaze. She's such a strong person.

Judge Cannone's conundrum, is that she has constantly positioned herself as a "champion" of jurors and of the jury system. Her first response to all of this was to protect the jurors' identities. Which was spot on, and not fought by anyone. So now, she is on a track to give the jury all the latitude she can on this motion. But knowing that the jury found her instructions indecipherable and self-contradictory, she will likely find it very difficult to admit responsibility for this whole fiasco. She did ultimately grant the defense's motion for the jury form to be amended. But not until after much finger-wagging at them (for apparently no sound legal reasons). And she has (inappropriately) displayed her animus toward the defendant. I'm hopeful (70/30) that she will at least allow a hearing, with all jurors present. But not as hopeful (10/90) that she will rule correctly.
It’s not surprising at all that the DA’s office isn’t interested in the truth in regard to the verdict. If they were interested in the truth, they never would have charged her in the first place.

The Jurors said they reached out to the CW at the same time that they reached out to Defense as well. So my assumption all along is on or around 7/1-7/2. The CW mocked the Defense juror affidavit and Motion on 7/12, as though this came out of nowhere and it was rubbish. Meanwhile they knew at the time they responded that they TOO were contacted as well.
Also, wouldn’t it be an error on the judge because she failed to ask what the verdict were on each charge or ask any questions at all? How could she declare miss try without asking questions about the verdict because she knew there was more than one
Legally she doesn’t have to poll the jury or even let the lawyers poll the jury. Normally the judge does poll the jury and I would to know if she does in other cases or if she doesn’t poll them all.
But she is supposed to ask questions that she never did so she failed for instance what charges are you hung up on even talking to the defense to let them ask Karen read what she wants to do. They were no questions whatsoever.

Lally actually makes me furious, I can’t stand liars, everyone has been giving lally the benefit of the doubt through out the trial that he’s not in on the conspiracy but this ⬆️ makes it very clear he is a liar and has no interest in justice or the law 😡
All this crazy just proves the CW isn't interested in Justice, they are in it to win it. It started at the beginning of this case, when they aka LEO & CW did their best to prevent her from defending herself at every turn. When she didn't rollover and beg for mercy, they upped the stakes. Not turning over deserved evidence until at last minute or at all, whining that the Defense isn't playing fair or being timely, etc etc etc. Now the Defense is playing by the rule book--absolute letter of it, that the CW & Judge gave them and the CW playing the but, but, but game. The CW also "bad mouthing" the Jury won't go well either. They are watching this, and everything else they can get. If I was a jury member, I would go public. Fear of miscarriage of Justice out weighs fear of safety. I would be screaming from the rafters. Another thing, I know the defense put out the contact by Jury, the CW didn't??? They were contacted within 24hrish. Didn't have to say something? The rules for Thee but not for Me are so confusing. It happened before, during and now of the trial. I don't get it.
I just can't deal with lally! He's looking and grasping at straws trying to make it look like he knows his job and he doesn't. It's not even close and this man is just being a typical narcissist. But he knew he had to get up there and say something.... He's a disgrace and I hope they get rid of him. I don't know how he has made it to the position he's in. The jurors are sitting here telling you this is what we said and we didn't know we could just say something. Nobody knows they can just speak up ... People who have never done jury duty don't know what they can do. He's not listening because it's not what they want it to say. He shouldn't be able to just stand here and have a leg to stand on. As I watch all the cool court formalities and traditions , it’s quite sad because they miss the most important part wrongfully convicting someone and a total inept investigation ! This is not justice. We are here today because of inept jury instructions.
This trial is a travesty of justice for all parties. I cannot in good Conscience say guilty of any charges. I have a pit in my stomach thinking about how many other defendants faces the same BS but lacked The resources for a stellar defense. 😩 😣 😡 ….and i back the blue Typically. Not these jokers though. I am Embarrassed from afar. Lally has GOT to be miserable. I feel zero passion from Him.
Im loving seeing you both smile while you listen to Marty make their case. Note that Bev has not interrupted once to complain of hyperbole or to state that there is no jury. She just listened. Will it make a difference? I doubt it. She's just as all-in as Lally. Which at this point, with the evidence that's available is preposterous betond measure but i think this is the hill she's decided to give in to. How wonderful os Marty though? He's very captivating when he's making his points.
