I have a vivid memory of Emily on this day of trial. After coming back from lunch they were back and forth from sidebar for over an hour, and Emily yelled "We've been back from lunch for over an hour and we've accomplished absolutely nothing!"
Has any of you seen this new Netflix documentary…apparently the director is pro Heard and used clips of you tube and other socials, then edited them to take them out of conflict. I won’t be watching it!
The whole Depp team did great at letting Heard's team and witnesses talk. These people were only digging a hole for themselves and Depps team knew it. It was absolutely glorious how things unfolded.
I am having so much fun looking through these sidebars. Judge A is just cracking me up. 2 favorite quotes are "I'll sustain this objection all day long, every day." (Day 17). And "You can't put 'what, if any' in front of a whole statement and say you're directing her directly to that. There are ways to ask the question. You just can't ask in those ways."
I loved judge A, she had so much personality and zest while still being a great jurist. I kinda hope another trial happens in her court on camera just to see her in action again
Favorite trial quote was related to the “What if any.” Problem. Judge: “what if any isn’t a bandaid, it won’t solve everything” Elaine, a minute later: “and yes what if anything does solve everything.” Haven’t had a chance to look at the sidebars myself but I wanna know if she was admonished for arguing like that in open court
I’m so confused… maybe you can help? How did it go from Emily reading the Sidebar from day 2 ie New PR guy had phone etc to Emily reading the Sidebar re Dr Hughes’ reading from her notes?? Which happened a lot later in the trial?? Do you know? I would be really appreciative
@@wheresmyparade It's not a jump. It says at the top of the transcript that it was the morning of day 15 when the PR guy stuff happened. Dawn Huge's cross was also day 15. We went back on the stand as soon as court began for the morning.
All this time it looked like Elaine was flustered and didn't know what she was doing, but those sidebars clearly show that she knew exactly what she was doing and tried to sneek a lot of things into the trial they weren't supposed to. They played hella dirty!
Up to a certain point in the trial, I tried to give her grace because I knew she didn't often do trials. I got to the point of "nah this is just slimy" when Hughes took the stand, and very quickly had no patience left. But seeing the sidebars is mind boggling so just how weasley she was
I feel like AH had tried to create a "record" of abuse by texting people and saying she was being abused, and now she's frustrated that she can't use any of that.
That’s exactly what she did! Notice how the only people who could corroborate her stories are people in her circle. Fortunately, nobody bothered to teach her about hearsay.
@@laurenlintt3361 It would've probably worked if the only people who knew about it were people in her circle, provided that their entire witness statements weren't based on text messages alone 😂😂
Exactly especially bc it’s was precisely those messages and tactics that got the UK case to rule against JD She thought it was a slam dunk and everyone one would believe her bc she said it or “emailed it to herself” for future reference She didn’t for one minute think she would have to verify any dates or corroborate any evidence with anything other than bc I said so
It’s wild to find out the Ms. Bumblehoff was intentionally playing dumb in order to come across as if the court & Depp’s team were ganging up on her. She’s worse than we thought. Yucky.
emily! i remember watching your videos (depp v. heard and josh duggar specifically) and thinking, "i really enjoy this. i wonder how i could get a job at a lawyer's office just writing documents." and now i am an affidavit writer!! :)
It feels like Hughes brought her notes up so she could read into the record all the stories Amber told. It would have been hard to remember. Even Amber couldn't remember her stories.
Well, it seemed Hughes remembered Heard's stories very well, she was re-telling them like the best gossips. What she struggled to remember were her own findings of her testing and data of her own report...🙈🤷♂️
Well she had no problems remembering all of AH’s self reports… it was the testing data she needed help with. Probably because her tests for all junk designed to achieve a desired outcome.
We have a saying "you can't whip cream out of shit", clearly their client made it impossible for them to take any effective legal action which is unfortunate for them. I was wondering, how would have they coped, had they had Johnny as a client?
*objection* Elaine: Your honor, I don't think that's- Judge A: Sustained. Elaine: But may I- Judge A: *explains everything* Elaine: *agrees* Elaine: *proceeds to do the exact same fucking thing, just adding "what, if anything"*
Truly infuriating to see someone you know who knows what they’re doing, play dumb. It’s like gaslight adjacent, idk what to call it? Disrespectful is an understatement
These sidebars reveal new spelunking depths to Bredehoft's ineptitude. Watching the entire trial last year, there were times when I actually felt sorry for her. That sympathy evaporated during her post-trial smear campaigns. I still wonder if she was ever even paid.
oh hi theramintrees i agree wholeheartedly. i love your content, and sincerely hope you in future use a vaguely-bredehoft-looking dummy in your videos in future.
It's hard to comprehend her complete misunderstanding of rules of evidence, especially when so much of the *intent* of these lines of questioning could have been made permissible with the correct approach.
That is actually quite contradictory. If Elaine was as inept as you say, why would anybody in Johnny Depp's side earn all this praise? Don't get me wrong, I am Camille's biggest fan. I just think that she earned it for way more than you claim.
@@renx81 Both can be true, Depp’s side had the harder job x1000. All Amber’s side had to do was keep enough doubt in the jury’s mind that JD _could_ have abused her, even once, and there’s no way of knowing either way. But Amber’s performance, submitting falsified evidence, using two corrupt psychologists and their manipulative tactics didn’t work in their favour.
@@funkyfranxLiterally if she had just stuck with saying that Depp verbally abused her - that's it! That's all she had to do to win her case! Literally it!
@@renx81 the opponent can be inept and the person they are against can still be stellar. There’s some cases where it’s a good lawyer versus a shitty lawyer and the good one lowers themselves to not wholly fuck over the shit one (aka brooks where the da’s could have definitely gone harder but didn’t because brooks was pro se) but if the good lawyer doesn’t lower themselves to that level and still goes to the best of the abilities that makes them great even compared to garbage
Nice to hear you talk about the loss of a dog or pet so kindly. I sadly lost my dog in November when we were both hit by a drunk driver who ran a red light while we were crossing the street. His loss has been much harder in me than any of my injuries. It's just so hard. You brought a tear to my eye.
I'm so, so sorry for your loss--how horrible. We had to say goodbye to our sweet senior lab last year; we were lucky in that it wasn't a sudden accident (she had cancer) and we were able to say goodbye to her here at home thanks to Lap of Love veterinary hospice, but it was still way too soon and just awful for all of us--I've never seen my 78-y-o father cry like that. I can't imagine how much worse it was for you. I hope that your injuries are healing, and that you're feeling better. And I hope that one day you're able to find a new companion, as well...when you're ready. Best wishes to you.
After many years together and several years of watching EDB together, my beloved kitty took his final journey yesterday. Thank you for streaming something lighter to help pass the hours, Emily. He found your voice familiar enough to relax with me throughout the day and I think that helped him go gently in the end. There is something comforting in knowing this place he and I frequented together will still be here.
not just that but the sheer amount of times she said i don't think that's the way it is after being told that's the way it is. Keep in mind there is a lot of pre trial stuff that the judge had to deal with from her too. 0.o
@@Lazrael32 Her emails back and forth with Depp's team during pretrial were so aggravating to read. Seems like part of her schtick is to frustrate the opposition to their wit's end.
Well that was the part of her strategy, she did everything in her power to add stuff she wanted to, even if she shouldn't (or legally couldn't). Lots of lawyers act that way if I were to judge by several trials I watched. It's scummy AF, but if it works, nobody bats an eye. This time it failed.
Sadly so many people are regurgitating second hand information without looking into for themselves, which is really obvious when you have seen the trial and all the evidence...
Just need to tell everyone that my dog literally lolled at EDBs squeaky voice effect 😭 she was chillin on the floor but then lifted her head, stared at the screen, went "HAROUMMM" and then did her laugh-face panting thing she does when stuff is funny to her. It was amazing 😂
I can honestly say during the johnny and heards court case I only watched Emily as she answers the questions we need answering and made it so easy to understand how the American courts work. Xx
In fairness... This is a fantastic resource for people becoming lawyers. A - they learn hearsay B - if a law student doesnt lose their mind reading all this. They might not be a great lawyer and it's indicative that they have more learning to do C - they should have the fear of Beelzebub in their hearts that they never want to be like bredehoft in an example to other students and lawyers. Edit: corrected typos
One of the RU-vid lawyers, Attorney Bri, said in a live stream with someone (I forget who) that she watched the trial, wrote down all the objections, looked them up, used them in one of her trials, and won!!! Definitely great education 👏👌
I passed out watching the stream and woke up to a gifted membership! I don’t know who you are, but I am eternally grateful! I wish I knew who you are so I can just say thank you to you personally! Now I’m gonna subject myself to all the previous member streams. You’ve blessed me and cursed me lol. but seriously thank you!
Thank you members for making this happen! I have wanted to see Emily read sidebars since they were released! Thank you Emily for the stream! catching up on the replay now!
You aren't alone. I have rewatched this so many times. And through legalbytes coverage. Emily however is more my flavor of human with her cursey words. Love it here!
You're exactly right! I didn't find Emily until after Depp v Heard, but if I'm needing to binge something, I'm so glad it's this case and not ice cream! 🤣 The hilarity! 🤣
@@kardiojunkeeI have read all sidebars, and they haven't been confronted with it. I think judge A should have. Ben Rottenborn was surprised when he saw AH walk past him and go out of court. I hope at least her own team told her not to do that again
Can one ever truly get bored with that trail? I mean, especially the side bars are JUICY. I kinda wonder how on earth Elaine got that case because she seems absolutely unaware of the rules. She doesn't even know the basics in court! I mean, I'm just a bartender but even I know by now what "hearsay" is. It had to be explained to her over and over and over and over and OVER again. How judge A and Johnny's team managed to keep their cool is beyond me. 😂
So when I saw Runkle do a video on this yesterday, my first thought was ‘Hey, I wonder if Emily is gonna cover this.’ I’m so glad you did! I needed this laugh today!!
As a replay crew person I’m gutted that I rarely catch streams bc a chance for a gifted membership is so cool! Not surprised EDB does neat stuff like that.
So it seems like Elaine was not just a dummy, which it seemed at many times, she was obtuse and insistent. Like a dog with a bone only the bone was usually rotten. She is like a pebble in your shoe, wears u down over time. This is an intentional strategy and i bet it works for her often. It just didnt work here because AH was not believed and the evidence showed she was the abuser.
10:50 we lost 2 dogs the last couple of years. We've had them both since they were puppies. One I had to bring to be put down and I have never sobbed as hard as I did pulling into that vet office just staring at her face. Even thinking of her name sometimes brings tears to my eyes she has been gone 3 years this summer.. Tearing up as we speak. The other dog was put down as well this past February. My mom brought him, it felt cruel to keep him alive anymore. He has a huge tumor in his side that just kept growing, open wounds that wouldn't close, he had to eat his food a certain way so he wouldn't throw up, and so on. Buca passed is my mom's arms and Nakita passed in my arms. Its a sadness you don't get til you are dealing with it personally
Elaine is a mystery. I did feel sorry for her during the trial, because having A.H. as a client must be absolute hell. But especially the interviews Elaine gave after the trial was over, showed that she isn't a nice human being herself. Her behavior after the trial and now during these sidebars really makes me wonder how she became a well established lawyer in the first place. Her behavior and the many mistakes she made during and after this trial are very unprofessional. I just don't get it. Now the only person I still do feel sorry for is our beloved Mr. Rottenborn. Having A.H. as a client and being forced to work with unprofessional Elaine must have infuriated him and absolutely worn him down at the same time.
Y'wanna know the worst of it. Elaine was deemed one of the /best/ defense lawyers in civil court for the state/region she represented. Shows how much that standard is worth.
@@QargZerI didn't like Rottenborn during the trial, but working with A.H. must have been very difficult and infuriating. And then trying to work with a colleague who doesn't seem to understand the most basic legal terms like hearsay, present sense impression etc must be incredibly infuriating. And to top it all off during closing arguments she used basically all of the little time they had left and left Rottenborn with a few minutes. He must have been fuming inside.
@@vxfusion6975 Elaine's not known for her trial work, she's known for getting an insane percentage of her cases to settle or dissolve without having to go to court.
I remember saying some days that it looks like Judge A is leaning over to literally bite off Elaine’s head. The more we go into these sidebars the more that impression solidifies. It’s so impressive of Judge A’s restraint that Elaine survived this trial.
Emily I just watched the Netflix documentary and idk of you can sue but it felt incredibly defamatory and so icky that they stole your footage along with so many others. I'm so upset but not surprised unfortunately 😔 let us know if there's anything we can do to support you.
If you do this again, you should play the actual trial, on like 1.5 speed, and then when they do the sidebar, go into the sidebar conversations :) relive the trial on a different level
I am so happy to be on the replay re-watch crew. I missed so much because chat was so fun and lively during the livestream. Elaine's "I didn't know" reminded me of those people in high school who tried to pull that 💩. Some got away with it, depending on the teacher. Judge A really came through with the no BS teacher role. "I don't CARE if you didn't know, Ms. Bredehoft. This is your responsibility "
I can never make live streams but have watched COUNTLESS hours of your videos. I’m a member on RU-vid and Patreon. This video was amongst your best. This was wonderful! The way you broke these objections down was just outstanding. Thank you!! We’ve never met but damn if I don’t want to have a beer with you just once!
It was so serious and yet bordering on farce. If I had not witnessed it I would not have believed AH’s lies & Elaine’s shenanigans. The sidebars are revealing how underhand her actions really were. Also it’s hilarious with hindsight. In some ways Elaine appears out of her depth. Almost feel sorry for her.
So weird. Last year in May/June I was awaiting surgery and I binged the whole trial with you and watched a lot of lives around the Depp/Heard case to keep my mind busy so I wouldnt hyperventilate about surgery. Now, a year later, I'm here; awaiting another surgery, watching lives about the Depp/Heard trial...
The sidebars are amazing- they highlight so much. Even in the testimony, I notice more in the transcripts than I did watching. Amber was so focused on referencing her own past statements. That's interesting. Referencing past statements and referencing past experiences are two totally different things. It's just solidifies that this was her plan for a long time. Also, in writing, her 'script' stands out. Her testimony absolutely sounds like chunks out of a movie transcript. It's so scary that people like this are out there, just roaming the earth with us and we could encounter them at any moment. It's truly terrifying!
I don't understand why Elaine would think that acting annoyed and incompetent would make her look good to the jury. It just came off as her not having any faith in her client so she had to use underhanded ways to get the information she wanted. Seeing that this was planned on her part only makes her look worse at her job. I do think it's a bit sad that court is a lot of showmanship instead of facts since the lawyers likeability is a big part of what a jury will base their opinion off.
I rewatched your coverage again this month (for the 4th time!) and the amount of times you were like “I wanna know what they’re saying!!!” “I wish we could hear side bars” “do it in open court!”, and now you get to see them! Because it’s fresh in my recollection, I can remember certain long side bars so this is so interesting! PS I WANT YOU TO DO ALL THE SPICY SIDE BARS SO BAD
WOW did I miss hearing you say “ELAINE 😒” Lmao Thank you for making this stuff so fun and interesting! I also LOVE the fact that I don’t need any previous knowledge of courts or law to watch and enjoy your videos - but thanks to you, I leave with a little bit more of that every time 😊 You’re the bomb, thank you for the hours upon hours of awesome content ❤
I’ve literally been watching this trial over again, so I’m elated to see this at such a random time!!!! I’m so excited! I miss when this trial was going on!
I'm batteling immense pain caused by an inflamed root tip. Its like having contractions, but in my mouth 🫣 the antibiotics need about one more day to kick in and alleviate the pain and man am I glad for this perfect video to help me get some distraction. Judge A and Emily made me laugh through the worst pain. Thanks so much ❤
"I don't know how much time they gave Elaine to go talk to all the people" stoooooop 🤣🤣 and I can imagine the PR guy didn't take it too well either when she told him
I'm into this so much! I've always wanted to hear what goes on at side bar and this trial is one I am very familiar with so I'm in the best place to understand what's going on. Thank you, Emily.
I know you're trying to just fit into one more stream but I do think it would be fair to look through Johnny's Direct. Especially when you were talking about how the judge was smiling and whatnot at some of the side bars- id love to see if any of her being amused by johnny got in. Yes i know i can look them up- but I love YOUR reading of them! 💜💜💜
I had so much fun listening to this! Objectively, a video about sidebars from a trial that happened months and months ago might not sound that interesting, but it's actually fascinating! The tea of it all 😅
At this point I think the problem wasn't "witness (AH) wasn't prepped", it's that Elaine doesn't know how trials work, so how can she prep her? Even I understood what hearsay and business records mean, and their exceptions. I didn't like Rottenborn or Jr, but everyone (including them) around Amber and Elaine deserves a medal for putting up with them for so long.
I keep and kept asking myself how is she still getting clients ... so many things didnt get into the trial that were crucial to their point ... The priority of the evidence makes no sense ... some that they fought to get in didnt matter at all ...
@@amberevolexactly I think she has played the ditsy woman attorney (and now older grandma attorney who doesn’t understand tech) for a while when she is in court, always so surprised there were rules and please tell me what to do your honor. In the south with some male judges that might have played to her advantage. Now it’s just stupid to watch streamed to a whole audience. But it’s def trying to sneak as much in as possible to see how much the judge allows.
If I could go back in time, I would definitely study law. You make it so interesting. I never tough that one day I would listen to 3 hours of sidebars from a trial !!!! And I’m French Canadian !! Even harder on certain words ! Thank you
It wasn't incompetence, she played dumb when it suited her. And it suited her more often than not. Depp's team even said her reputation preceeded her, that she plays dirty and tried to get around rules of court.
I I think the reason AH kept testifying about what JD might be thinking or whatever is because her goal was to make him look as bad as possible. Also, it’s possible she did things like recording him when drunk because she wanted to humiliate him, not out of concern that he wouldn’t remember.
Typically, but not always. Abusers will [in a mental context] try to show how they know what's /best/ for the person they're abusing. So when she's trying to explain what JD was thinking, it was just showing that she thought she knew JD better than JD knew JD. Which ties into the 'I know what's best for you'. The other part of it is. She took the pictures and recordings to spin them in a way that makes JD look like he's in need of help. Which, while he might have been, it wasn't from what he was already going through. It was her help. JD's side of the argument is that she is using the pictures to make him look like a drunk, drug addled abuser because of the stereotype. Whereas, in reality. The abuse was from her, because she was trying to manipulate the narrative and gaslight him slowly.
Emily, you are SO FUNNY to watch while you're going through this w/ us! I've been laughing and waking my husband up! I keep imagining you as the judge finally saying to Bredehoft, "I AM SICK OF YOUR FKRY! STOP IT!" 🤣
This only confirms what we all already knew, Elaine is a very, very, very bad & unskilled attorney, just as AH is a very, very, very bad & unskilled actress, they deserved each other
The sequel to Depp v Heard I didn’t know I needed! 🤣🤣🤣 Its giving me all the good-vibe throw back feels like when your favorite movie gets a reboot and they don’t muck it up! 🎉
1:32:28 Elaine literally tells the court, “I will keep throwing shit at the wall to see what I can get to stick….your Honor.” (Aka This is my dumpster fire and I’ll beg if I want to!) 😂😂 🤦🏼♀️ Lawd! I can’t with that woman…the frustration is real, but you break up that insanity with your commentary hilariously perfect! 🤣🫣
It’s out tomorrow! I just went over to Netflix to see! It should be really good. Unless they decide to take a side then I’m not gonna like it. Hopefully, it’s good to watch.
First thing I want to say is with the Netflix series…you got A LOT or air time Emily. Lol. I was SO happy to see it too. Secondly, the final clip of episode 1 of @darthnews saying amber is f--‘d is ICONIC!
Remembering how painful this was at the time - but actually hearing how ridiculous it continued to be when we couldn’t hear - is even more painful - however your commentary is the reason we made it through to begin with and right now I’m crying 😂
Thank you so much for this video! Had such a good time watching it. I followed the trial when it happened, but I only recently discovered your channel. I always wondered what they talked about on sidebar. Tysm!!!!
doco is just clips of Emily, Tug, Andy etc strung together while they are still painting their ridiculous narrative lol. Residuals much? Emily, we all remember you doing a brilliant & honest job during trial 💜
🍿*Popcorned Planet* 🍿has a copyright strike against them for showing ANDY'S clips from the doc! It seems that Channel 4 & Netflix now own his footage because they used them. So now he can't make a penny off his OWN VIDEOS! During his live-stream yesterday a notice popped up, warning Andy to stop or he'd be in trouble. ❓❓EMILY, did YOU give permission to have your footage included in this "doc"? Is it legal?? ⚖
@@primmoore6232 it’s so wrong, I hope Andy sorts it out or perhaps they should all do their own honest doco & at least put out the truth about trial. & such hypocrisy stating that all creators want is clicks & 💰 whilst they show this for that exact reason 🤦♀️
I am in NZ and seldom catch a live stream, but I am thankful for the replays. Cheers for your considered and thoughtful breakdowns and commentaries. You are always clear and concise!
Good lord, that morning sidebar went so bad for Heard's team.Someone being disrespectful to the officers of the court, someone violating a judge's order, a witness being shady on the stand, and teh lawyer herself suggesting that her witness' testimony is going to get into some shaky legal grounds. This trial just keeps on giving, doesn't it? Edit: thanks for the 'control+F myself' drama immediately after.
