Walledzq is partially correct. While the officer writes his citation he has 15 minutes to have the K9 meet up with him. If it is over that it is ruled unreasonable. Honestly, a few more minutes won't hurt anything---- if he has a controlled substance it would not be thrown out. Also, he always has the right to ask him out of the vehicle and based off his observations can conduct field sobriety-- It's not his first day on the job, he knew something wasn't right.

Not signaling your lane change does NOT give you probable cause to search a vehicle. If you have probable cause of intoxication it gives you the ability to perform SFST's as an officer-possibly an arrest and a vehicle inventory prior to tow.

Consent, no consent, the cops are going to bring the dog and do what they want - you will still get a ticket/arrested either way, but its your options in court and how you will fight the charges that really change with/without consent. Thanks again for asking me to clear this up... im sure others were confused too :)

If you were going to get charged with it one way or another, why give them the permission? There is no reason to give a police officer the right to search your vehicle, their job is only to gather evidence and use it against you. If you talk to the police and give up information other than your name you're just giving them more ammo to use against you in court, and they will use everything against you. They'll say things like, "I can make this easy on you, just tell me what it is and where it is and we can help you." - No, they're going to charge you either way and then use that as clear evidence in your case that you admitted. It's kind of hard to refute later that it wasn't yours if you admitted to a police officer, their "promises" of making it easy are meaningless essentially. I realize the "Am I being detained or am I free to go?" thing gets memed a lot but you should exercise your rights when you think you're being held unlawfully. If they say you are being detained or under arrest then there's no reason to continue asking. You have rights before they stop you and all the way through to the time you're sitting in a patrol car and going to jail. If you do find yourself being arrested for -any- offense, do not answer their questions, get yourself an attorney, or a public defender, whatever, but you have nothing to gain from talking with them and everything to lose.

Never, never, ever let a cop search your car even if you have nothing. rights are for the innocent too!
