Malaysia PROTEST Against Philippines Extended Continental Shelf over SABAH

Malaysia has opposed the Philippine submission to a United Nations body to formally recognize the extent of its undersea continental shelf, saying it is projected from the baselines of Sabah. In a note verbale to UN Secretary General António Guterres on June 27, Malaysia’s permanent mission to the United Nations said Malaysia has never recognized the Philippines’ claim to Sabah.
Earlier, China had also protested against the Philippines claims. In a note verbal on June 18 communication, addressed to UN Secretary-General António Guterres, the Permanent Mission of the People’s Republic of China to the UN, said the Chinese government seriously requests the Commission not to consider the submission by the Philippines.
Malaysia requested the UN Commission on the Limits of the Continental Shelf not to examine and qualify the Philippines Partial Submission. The Government of Malaysia categorically rejects the Philippines’ Partial Submission on the basis that the Republic of the Philippines’ continental margin is projected from the baselines of the Malaysian state of Sabah.
This clearly disregards Malaysia’s indisputable sovereignty over the state of Sabah, the mission said. The mission said Sabah has always been an integral part of Malaysia, and has been recognized by the UN and the international community as part of Malaysia since the formation of the Federation of Malaysia on Sept. 16, 1963.
It argued that the Philippines’ claim to sovereignty over Sabah is incompatible with its erga omnes obligation to recognize and uphold the legitimate exercise of the right to self-determination by the people of Sabah in 1963. The Government of Malaysia wholly rejects the claims by the Republic of the Philippines that the latter has legal ownership and sovereignty over the Malaysian state of Sabah, the mission said.
It is clear that the Republic of the Philippines claim to Sabah has no basis whatsoever under international law. The Philippines asked the UN body last month to formally recognize the extent of its undersea continental seabed in the South China Sea, where it would have the exclusive right to exploit resources.
Through the Philippine mission to the UN in New York, the Philippine government submitted information to the UN Commission on the Limits of the Continental Shelf on the extent of its undersea shelf in the South China Sea, off western Palawan province, after more than a decade and a half of scientific research.
The Department of Foreign Affairs (DFA) explained that under Article 76 of the UN Convention on the Law of the Sea or Unclos, a coastal state such as the Philippines is entitled to establish the outer limits of its continental shelf. This comprises the seabed and subsoil of the submarine areas extending beyond 200 nautical miles but not to exceed 350 nautical miles from the baselines from which the breadth of the territorial sea is measured.
The National Mapping and Resource Information Agency led the Extended Continental Shelf Technical Working Group that worked on the submission for over 15 years.
The DFA underscored the significance of the submission in securing the Philippines’ sovereign rights and maritime jurisdictions in the WPS, noting that the 2016 award on the South China Sea arbitration confirmed the Philippines’ maritime entitlements and rejected those that exceeded geographic and substantive limits under the UNCLOS.
Philippine permanent representative to the UN Antonio Lagdameo said the move “can reinvigorate efforts of states to demonstrate their readiness to pursue Unclos processes in the determination of maritime entitlements and promote a rules-based international order. Former foreign affairs secretary Teodoro Locsin Jr. said the Philippines will not abandon its territorial claim over Sabah despite aggressive financial offers.
He bared the repeated offers in the past involving huge amounts of money for the Philippines to drop its claims over Sabah, formerly known as North Borneo. Meanwhile, visiting Malaysian Foreign Minister Dato’ Seri Utama Haji Mohamad Bin Haji Hasan will meet with Foreign Affairs Secretary Enrique Manalo to discuss the current state of Philippines-Malaysia relations, the DFA said.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

If you called it rent, where is the agreement between Sulu and Malaysia? If none, it is just like what pirates and mafia do for a living. Why in the 1878 agreement, was Malaysia not mentioned? Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Why is the amount so small and not what has been stipulated in the agreement? One Mexican gold dollar (coins) in 1878 weighed 1.7 grams of gold. So, 5300 X 1.7/1000 = 9.01 kg of gold. Compare the value of 5300 Malaysian dollars to 9 kg of gold. Giving away money is not an offense. Can give or stop giving any time.

@@hopelope1703 The Malaysian government pays RM5,300 per year as rental for Sabah to the heirs of the Sulu Sultanate. Malaysia doesn't call it rental or lease but cession money and has been paying this since the formation of the Malaysian Federation in 1963.

There is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and is easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. Philippines which is not a party to the trial requested permission to intervene. To comply with Article 62 of the Statute of the Court, the Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve the Philippines' historical and legal rights (only found in the 1973 PH Constitution) over North Borneo and to inform the court of the effect or effect of the court outcomes of the trial on its claim to the territories. In that trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were present. On 23 October 2001, by a 14 to 1 vote, the court rejected the Philippine's request on the ground that there is “no interest of legal nature” (Section 93). China emperor set 100 year deal with the British for Hong Kong, while the brainless last generation of Sulu Kingdom have a crazy dumb sounded "as long as the moon and star existed" kind of deal. What a joke last gen of Sulu Sultanate. No wonder Sabah folks better off with the British and later join Malaysia, let the Sulu Kingdom self destruct themselves by joining a Republic, another fool decision by the Sulu Kingdom. Not even Spanish can conquer them entirely for hundreds of years, but can get fooled by Manila folks to join an anti sultanate republic system.

The British is the reason of this issue. If they rent it to sulu before, they should return it back instead of giving it to malaysia. Just like what happened in territorial claims of philippines in west ph sea, it is very clear that it's part of the philippines but china insists that it's their territory. If philippines have right in sabah then they should push it the way they push their claims in west ph sea.

Sabah was ceded by the Sultan of Brunei to Sultan of Sulu in 1704 and Malaysia was only formed in 1963. People live in Sabah paying their rent through taxation to Malaysia and Malaysia paying rent to the family of the Sultan of Sulu. This is a classic feud between renters and owners...

That is more correct. And in international law will count the " proceeding" of post-colonial administrative rules. Annulate 1885 ? Than Sabah and Sulu are under Brunei....But recent international law would simply mean that things remain : the Philippine universum is old and rich, divers, amazing, but the Statehood is postcolonial...and only that ought to prevail....in international law.

Fun fact : Sultanate of Sulu is no longer considered a sovereign entity or kingdom since 1915, thus any claimed political sovereignty of the sultanate was formally abolished in 1915, still all of their descendants of the royal family are still recognised and honoured as de facto royalty by the people in Sulu and by others but not as legal government entity, they don't even have a government office let alone governing a whole states like Sabah. Be realistic, having some research never hurt though.

Also the Sulu's sovereignty never penetrated deep in the jungle of North Borneo. To claim the land based on the lines drawn on a map is simply foolish. Also, the natives of North Borneo people don't even recognize the Sovereignty of Sultan Sulu even in the early days, to this day they don't want to be associated with the Philippines.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Secondly, all pnoy should read the following documents, which are as important as 1878 BNBC-Sulu treaty : 1. BNBC-Brunei Treaty 1877 2. Spain-Sulu Treaty 1878 3. Protocol Madrid 1885 4. BNBC-Sulu Treaty 1903 (annexture tu 1878 treaty) 1. BNBC-Brunei treaty 1877, brunei ceded whole sabah including the so called claimed sulu area to BNBC has proven that brunei never admit sulu dominion in sabah. 2. Spain-Sulu treaty 20 July 1878, Sulu has relinquished all his territory to Spain 3. Madrid Protocol 1885, Spanish renounced all sovereignty in borneo is under British. 4. BNBC-Sulu treaty 1903, sulu reconfirmed the their previous 1878 treaty as surrendered. The ambigous word 'Padjak' now replaced with 'menyerahkan' or 'serah', which means, surrendered or hand over in english. Try googling the meaning of serah. We maintained our stance that sabah was never in sulu's hand neverthelessly, the second narration was just to distrupt your happy wet dream. 😂

If you called it rent, where is the agreement between Sulu and Malaysia? If none, it is just like what pirates and mafia do for a living. Why in the 1878 agreement, was Malaysia not mentioned? Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Why is the amount so small and not what has been stipulated in the agreement? One Mexican gold dollar (coins) in 1878 weighed 1.7 grams of gold. So, 5300 X 1.7/1000 = 9.01 kg of gold. Compare the value of 5300 Malaysian dollars to 9 kg of gold. Giving away money is not an offense. Can give or stop giving any time.

Sulu’s ownership of Sabah can be disputed. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid

While the rest of Philippines where Conquered and Subjugated by the spanish colonial, Muslim Tribes fought back and kept their Islands to themselves even up to this day. If a Sultan of Sulu is a Citizen, then how come he was able to rent SABAH To the British? Malaysia was even paying rent for many years since 1960s until 2013.

During the 50s-60s-70s and even earlier, grade school students were taught that Borneo was part of the Philippines, was even on text books as part of Philippine geographic history fyi .....

The latest Philippines Constitution (1987) indicates North Borneo (Sabah) does not belong to the Philippines. It supersedes all other previous legislations that have now become invalid. Note: Philippines Constitution 1st: 15 November 1935: Philippines Commonwealth - exclude Sabah. 2nd: 4 July 1946: Republic of Philippines - exclude Sabah. 3rd: 17 January 1973: - include Sabah. 4th: 16 February 1987: - exclude Sabah. Baseline Law: 17 June 1961 - exclude Sabah RA 3046 18 September 1968 - include Sabah. RA Act 5446 10 Mac 2009 - exclude Sabah. RA Act 9522 PH playing hide and seek on Sabah.

Sabah is part of Philippines historically. They grabbed the opportunity to land grab Sabah when they gained their independence from Great Britain. The true owner is the Sultunate of Sulu, which is historically ang integral part of the Philippines up to the present.

In those times there was a "Philippine universum", but no Philippine common Statehood. In the oldest statehood there was Sulu, and older, Brunei and Sabah had been part of Brunei.... Sabah is part of the "Philippino universum", but belongs to the state of Malaysia. Don't cut the child in two, foster it together.....
