What do you mean? He is there for firing a firearm in public. He is responding by saying it was not a firearm to begin with. His response is directly relevant to the purpose of the case.

If you watch the video he goes off the actual point why he is there and talks about something else "his response" as you say didnt mention anything about firing it in public. To understand why his comment is not off the mark, we first have to understand how a firearm is classified as a firearm in south africa. in South Africa, a firearm is not classified as a firearm based on how it looks. A firearm by law is any item that contains a barrel capable of launching a projectile of a certain size and weight at a certain velocity (I can't remember the figure from the top of my head, but it is listed in the firearms act). So the difference between a toy gun and real gun, is the type of projectile it shoots and the speed those projectiles fly threw the air. So if you shoot a toy gun outside... that does not mean you are shooting a gun, its still just a gun. A toy gun looking like a real gun is not relevant to the above, but there is one exception where it actually counts. in law, there is a crime called "brandishing a firearm". In this charge, the act of display a real firearm or any object that looks like a firearm is a crime. But in Malema's case, I think they only charged him with firing, but not brandishing.
