It depends on where you're seated. I can see the GM's POV though. Imagine having employees working under you and instead of consulting you on matters that will directly impact your department's operations, they bypass you to speak to the owner. The owner has no clue what goes on in the warehouse. They don't know how short-staffed the GM is, especially when he has to deal with perpetual absenteeism from an employee who doesn’t respect him enough to ask him for time off. I would have fired him too. And clearly the owner was in support of that decision.

If dude didn’t have a record that showed he should have been fired prior to this incident then I think JJ would have handled it differently. Can’t sue for wrongful termination when u should have been fired already. He got arrested on the job in a company car while on the clock and they let him keep his job and now he wants $5000 for wrongful termination lol🤦🏽‍♂️🙄. The irony does not escape JJ. That would be like me sueing somone for damaging my car after I already crashed it right before and wanting the full value of a brand new version of that car. It’s not reasonable with zero evidence of accusations.

Maybe, and that would be wrongful termination. However, he had no evidence to support any claim. He also DID deserve to get fired for many reasons, but didn't so that shows leniency. I do believe that the manager said that Mexican thing, but doesn't matter as that had nothing to do with the employees race, creed, or religion in regards to wrongful termination.

No is absolutely no excuse for a judge snap judgement without understanding the full case and seeing to all the evidence. Judy failed to look into the evidence thoroughly and discriminated against Rhodan not out of race but because she doesn't care.

I believe JJ made a rush judgement without giving herself a chance to learn more detail of the case. I've seen how some managers abuse their power at work. They'd do in their power to push any subordinates or powerless people out of their sight. I sense this case is no different from many cases I've seen in the past.

She does that a lot, and rules based on her own "feelings" about a case, then slams others for having feelings. It's true he had no evidence but she was clearly biased here due to the plaintiff's "court" situation.

I agree; a rush judgement. The plaintiff had a lot of supporting documents JJ wouldn't even allow him to enter/show her...I know other plaintiffs have had docs that proved ridiculous but she could only make that judgement after hearing a couple. This guy never got a chance and I saw no attempt by him to play the Court.

You are right the abuse was the employee taking many days off leaving the company with no employee in the warehouse.When presented with the option of working less hours so another person could be hired to fill the gaps, he declined.The employee was definitely abusing the company.

@@bnellaniyah No I am not an employee. The guy was taking off time for his court appearances and expecting the company to shut down warehouse work while he did that. he then refused to share the job with another person so the work could get done. Yes he was abusing the company.

you are not listening closely, she asked him after multiple incidents of him coming in late, and him taking days off, even him getting arrested in the company truck if he got fired after all those incidents, he himself admitted no, and the mexican claim that he is claiming the defendant made, the judge was asking for actual proof that the defendant said such a thing, also the mexican joke would be offensive to mexicans not blacks, at most it would show that the defendant has a discriminate against mexicans, which isn't even a race, fact is that the plaintiff is a irresponsible person himself, and whether the defendant is racist that is debatable, however there was no sufficient evidence to prove it in court

@@mexicanspec It is not the employee's responsibility to fill your warehouse. It is the job of the employer to fill the warehouse. This is a problem most of management have these days. They never plan for someone getting sick or actually spending their leave. It is not the responsibility of the worker to manage your schedule. If they have leave they are welcome to take THIER EARNED TIME OFF! Denying their time off is wage theft in my opinion. Employers need to stop whining about people using their benefits and get their shit together and hire enough people that if someone is sick, their business doesn't shutdown or they need to accept the shutdown and shut up. Maybe Mr. Manager should have got his ass on the line to fill the vacancy for the day, that is what I do for those that work under me when they need some extra help. Treat your employees with respect and they will do likewise.

It's easy to say "no evidence or proof" in a black and white world, but sometimes judge judy explores the grey area. She didn't do that here so I feel the plantiff was a bit hard done by also

The defendants actions appear as retaliation. Plaintiff needed more evidence. OSHA may feel differently about this case. He fired him after he said he would discuss his comment with the owner. 🤔 I’m surprised he got away with this one. The commission should have been discussed.

Pretty sure OSHA doesn't deal with allegations of wrongful termination for racial discrimination. This isn't a workplace safety issue. On firing him for saying he would discuss his comment with the employer---there's no shred of evidence supporting that the defendant made the comment, beyond the plaintiff alleging that. There is evidence that this guy frankly isn't that great of an employee and demanded a raise, both of which are valid reasons for firing someone.

I worked in a warehouse for 15 years and I'm sure he said it. So what? That's not why he fired him. I had managers tell me worse stuff than that and I'm white. Was told they could get a trained monkey to replace me. It's wrong but not a reason to sue.

Judge Judy's privilege really shows sometimes. "oh 5 months passed and you never got the commissions you were promised? thats somehow your fault and now you don't get them". some people need a job and can't just leave because they don't like something. just because he wasn't in a position to leave and waited 5 months doesn't mean he wasn't promised those.. She never even asked the defendant about the commissions. she just didn't like the guy for whatever reason and didn't want to give him anything.

He had no evidence of discrimination in firing him so it wouldn't have mattered who he filed with for that. If he wanted to file remarks of bigotry it might work with a lawyer. A warehouse is always filled with guys like this swearing and making bigoted remarks of all races.

I'm sorry the hardworking father didn't win his case. He should contact the State Labor Board about it, as well as the NAACP, to hopefully win some compensation. Obviously, the guy he was suing took offense & fired him right after giving him a raise. I feel the young father should apply with WalMart or with any manufacturer near his home, warehouse personnel are always needed everywhere.

Unfortunately he probably can't now. His claim of unlawful termination + whatever else has been settled as unfounded by Judge (arbitrator) Judy, and typically you can't put a defendant in double Jeopardy for the same claim.

I think that some people in the comments missed a lot of things that Judge Judy said. Due to the plantiff taking days off, coming in late to work or leaving work early due to his son or court days, it made it difficult for the company to keep up with the daily schedule since he was at some point the ONLY warehouse guy in the back. Which meant that the company had to put front-sellers in the warehouse, making them double-work. I wouldn't want a person like that working for me (sorry, not sorry). However, if the plantiff did do other work at the company then he should've been compensated for that. The defendant does give off a shady vibe though with his smirky face urk

I completely agree, speaking from a management/owner perspective, the plaintiff is a bad business decision, complete with the excess baggage containing numerous excuses to take an unreasonable amount of days off, knowing the staffing situation, in addition to that he got arrested while in the company vehicle, leading to possible fees such as towing or impound. The juice just isn't worth the squeeze with this one.

Hell naw… white people have this stigma that black people are lazy and do not show up for work… she saw missed days then her racism kicked in and blinded her… he is the only warehouse worker, so he probably was being over worked hence he asked for a raise… he had a legit excuse for being late or missing days… he said because of his sons health condition he only missed two at the most 3 days out of a year!!! The days he missed from work, was because of court which he had documents for proving his legal obligations for that day!!! He Literally showed how a coworker(who probably was white) missed more days collectively for a camera shoot!!! I notice white people follow this code… it’s like the mandatory minimum laws.. nomatter if you wanna be lenient on the decision because of the code it’s a no tolerance…

A company will assess if you're a liability or an asset. IF they kept him throughout the court cases, absences AND an arrest in a company vehicle, he was doing SOMETHING right. They kept him going to events, and even mentioned that he was great at upselling the items. They kept him because he was clearly selling way more than the trouble he was causing. They had more than enough grounds to fire him. Late, ARRESTED in a company vehicle, leaving early, etc. Something is not totally right with this case.@@jackmermigas9465

I have never asked for so many absences in a year all my life! The plaintiff got in car trouble on company time too. And, he was prepping to ask for more time off??? He seems like a good guy, but you can't run a business with someone that unreliable. They really tried, but it just wasn't working out. I'll bet the owner didn't really grasp day-to-day operations/understand how his absenteeism was affecting business. She fell for every one of his sob stories, and kept giving him time off, meanwhile the defendant was busy trying to correct the schedule and make sure his duties were carried out. He offered to gett a part time warehouse guy, and let the plaintiff keep some of his hours, but the plaintiff demanded to be full time, yet couldn't realistically hold a full time job. The defendant fired him because the owner didn't have the courage to be honest with the plaintiff.

It’s not sound business for a company to depend on one employee. All employees are entitled to time off of work for whatever reason. Either have enough staff to cover or the manager steps in and covers the shift. It sounds like he was working in the warehouse, doing sales and attending expos. He should be able to request time off

Reading the comments it seems people either don't understand the case or live in a place between reality and fantasy. 1: The Plaintiff is an ex con, he took a lot of days off for court dates, the defendant did his best to accommodate the plaintiff, allowing him to do so. These court dates would make the Plaintiff take multiple days off, upwards to a week. He was the only one working in the warehouse so the company had to use the people in the sales department to take over his job on multiple occasions. 2: The company just about had enough of him, from getting arrested on company time to taking multiple days of, he was given so many chances. I mean the defendant even tried to reason with him by giving him less hours and hiring a part time worker to fill in the days or hours off, he tried to work with him. 3: He was never given a raise, he claims that the defendant was about to give him a raise, it's all hearsay. 4: The plaintiff threatened the defendant that he would sue him by using the race card, this according to the texts, Judge Judy read the texts and it was clear the plaintiff was blackmailing the defendant.

Everyone is right in this situation... Employee though he had very reasonable outside issues wasn't really reliable, especially when he was apparently the only available full-time warehouse worker in his specific role and expertise puts not only the Company but more importantly his other co-workers in a bind. From what everyone is agreeing on in this is that other Co-Workers who were not apart of the warehouse team were being pulled to work in that department. Also, they were having to hire another Part-time guy. Also, on top of that going behind the GM's back to talk to the Owner who isn't there on a day to day basis (and knowing the ins and outs of the business) about having time off after the GM allegedly agreed to give him a raise is a slap in the face as well. It maybe retaliatory, but if I just gave you a raise and then you turn around and going behind my back to make me look bad then that's another problem. Hopefully the Plaintiff gets a job with more flexibility while the Defendant hires a guy who is more reliable.

Exactly. That’s what got him fired. Nothing else. If you have a job you’re expected to show up and work. Can’t/won’t/don’t/ do that? You’re fired. Simple. Doesn’t matter what comments that the defendant allegedly made. Plaintiff can’t prove it and they were not the basis for his firing. JJ made the correct decision. You can’t just claim discrimination or retaliation because you’re pissed something didn’t go your way. That’s why it’s so hard to fire truly poor employees nowadays. Got to really make sure you have a “good enough” reason to do so so you don’t get sued. Most companies understand that stuff happens but there’s a line. Plaintiff was now unreliable and we’re spending more in labor to have him employed, and probably getting PTO for all his time away, as well as having to hire and train someone else to do his job while he was away. And the fact he was arrested in a COMPANY vehicle on COMPANY TIME? Surprised he wasn’t fired then. Good ruling from JJ.

It's hard to know for certain without seeing the messages and knowing the full extent of what was going on, but I'm getting the impression that the plaintiff was becoming increasingly unreliable and using a good relationship with the absent owner to undermine the manager's decisions. The sales commission was probably a red herring except that it might indicate that the plaintiff was at one stage doing good enough work that he was being considered for an incentive that wouldn't usually come with his position but the manager ended up having second thoughts.

I have learned (the hard way) that if you give your work enough chances to adjust to your absence, they will permanently. I love JJ, but sometimes she’s too “let’s hurry up and finish this case”, and this is one of those times because had she interrogated the defendant enough I guarantee he would’ve tripped up once or twice to make JJ rethink the ruling.

I think JJ figured she had no real leads to get the defendant to trip up. Maybe she would have given it a try if the statment would have been more consequential AND she thought the defendant was a dummy. With neither of those things, the chances of succes were just too low

Judge Judy was correct. Some people think they are entitled to take off whenever they have an excuse. Makes it hard to run a business. Not someone I would want to hire. When you have job, show up and do your job!
