Mark Steyn illustrates the need for a Constitutional Amendment to require all Judges to run for reelection every two years. If judges are going to make law like legislators, they must run for reelection like legislators.
If Judges can be appointed by a POTUS, can a Judge be removed from the bench by a POTUS if they abuse their authority?? The Judge in questions seems to Legislating from the Bench, which is NOT the Judicial Branches Authority, EXCEPT in matters of Constitutionality before the Supreme Court. Can another, "Higher" Judge suspend his ruling until ruled on by The US Supreme Court? Anyone with expertise on this subject who could comment???
Kuzin V Knee!! - Yeah, not wholly correct. Not even the Supreme Court Justices are allowed to legislate; their job is to merely interpret what the Constitution meant at the time it was written and apply it to today's issues, not according to an ever changing social dynamic at play. The Constitution is not a living, evolving document as the Left wants to make it. But even they crossed over the line by their decisions on Roe vs Wade and also gay marriage by doing some clever maneuvering, and making new legislation. They got away with it too. A lower court judge would not be able to suspend judgment in a case before him/her because the parties are seeking a quick decision; waiting for a Supreme Court case to rule would take probably over a year or two and there is no guarantee the SC will even agree to hear a case. They also would not hear a case that had no final judgment by a lower court judge because the whole idea is to either sanction the existing judgment or overrule it as unconstitutional. A judge doesn’t need to do anything here except change the law as it is already written, which he can not. The Federal law says that cities are not allowed discretionary funding if they do not comply with federal law. Why did this judge even do this?

But the judge doesn't have any control over federal money so what good does his order do ? Didn't the attorney general spell this out in his recent speech, that these judges do not supersede our president ?

Mark Steyn makes an excellent point about the ridiculous amount of power of judges, and the abuse of that power. Part of the American Revoluion was to eliminate the power of unelected judges. Over the years, judges got their power merely because they said that they had the power and the American People were too timid to challenge them.
One of the things I love about Asia is they don't carry PC baggage around with them like we do in the West. If you steal signs and damage cars in Singapore, you're getting caned -- even if you're a US citizen; if you shop lift in China, you're going to jail, even if you're a US citizen; and my personal favorite....if you ask Japan if they will do their part by taking 5000 Muslim refugees, you will get a very polite, "Ahhhh.....no thank you!" ...complete with a very nice bow.

The Judges don't have to commit a crime to be impeached by Congress. Congress can impeach for any reason. But Judges that rule in favor of harboring illegal aliens are breaking the law so it should be easy to impeach them. Trump needs to start telling the lazy congress that if they don't start impeaching judges he won't support their re-election bids.
following the rules of impeachment are almost a dead end due to the crap that has to happen: for all intentional purpose they can remain on the bench until they die or withdraw voluntarily. It is lifetime job security. Supreme Court justices have said that a legal loop hole should be a writ of scire facias filed on behave of questioning if a judge violated "the Good Behavior" Clause. This is the only quick possibility of "nailing" a judge's ass to the wall. Federal Judges were not supposed to be political hacks for any party. The reasoning for giving them "lifetime" terms was meant to allow them; the thinking of the day, to think critically in terms of the constitutionality of any legal motion/case brought before them and judged solely for that reason/merit and not be swayed by re-election travails and or illegal payoffs with the compensation in their annual salary on par with private practice salaries with the added bonus of job security AND salary until one retired or left the judgeship voluntarily. Our founding fathers were trying to prevent political bullshit from happening but as Madison so clearly spelled out in one of his Federalist Papers treatise: Man wouldn't need laws or rules if he didn't have a more often than not corruptible nature that looked more of a devil than an angel. That is the problem!! We by nature are often more like devils than angels and laws are made and judged by imperfect and often contemptible human beings.

The Law exists to serve US. That’s “us” as in the working, voting taxpaying citizens who pay the salaries of police, judges and public prosecutors. WE do not exist to serve the law. Increasingly, it seems as if the courts are no longer to be trusted, simply because they use their position as a mechanism to advance personal socio-political agendas. Unwillingness to apply the law of the land in a consistent, even-handed manner means that they have tried to make themselves sovereign, above the national legislature, and behaved in a manner which is essentially arbitrary. The whole point of the Magna Carta was to curb arbitrary action. If they refuse to act in a way which upholds this very basis of Western Law, then they are treating the taxpaying voters with contempt. This fifth column of some courts and compliant police will ultimately be defeated. In spite of them, we SHALL win. We have to win because to lose will lead to an unthinkable new dark age of the soul.

When elections are held it is up to us to research the judges on the ballot and when it asks if a liberal judge should be retained vote no! I decide which are liberal based on who appointed them, or their rulings, or both.
The Judiciary has been chipping away at the Executive Branches Authority for years now. We've all accepted the Supreme Court for settling disputes between the branches. However, Presidential Executive Orders should not be able to be touched or changed by any single Judge throughout the Country. The challaging Judicial Authority should have to petition the Supreme Court on the matter and only by majority ruling from those Justices should their be a change made against the President. The President's EO should be followed or they face arrest for their interference. Is he or she, not the most powerful person in Government?
The US constitution is mostly to blame for this. If you empower judges with the ability to strike down existing laws then they'll run with it and start running the country by themselves. UK judges don't have this power.

Until March 6, 1819, the supreme court had zero say in setting law. It wasn't until McCulloch v. Maryland that the supreme court threw out the written constitution (saying it became void the moment it was ratified because at that precise moment, it became a sovereign, and it placed itwself as the head of that sovereign). It turned America into King George and everything that we fought a war to escape. However, the Robber Barons didn't want people knowing that, so they designed, funded, and wrote the curriculum for mandatory public education that would teach American lies about their own history. Why in a constitutional republic would less than 2% of Americans have ever read the constitution? we deserve what our ignorance dumps on us.

It nice to see Mark talking to people he obviously respects. When he's comfortable with the company, values them and doesn't have to waste his time explaining the obvious to them he expresses his views and information much more enthusiastically. It makes for more interesting and nuanced TV to hear a real conversation rather than watching an adult witnessing an explosive CNN temper tantrum with disbelief.
