Aslamu alykum janab Gamidi saheb, air ilyaas bhai . Aaj sy pahly aap ny iddat ky nikah per difrent jawab dia tha lekin aaj wo total chang ha , aap ny kaha k iddat main khawand ka haqq talfi hota he . Lekin aorat ko bhi to poochna chahye kia byaan deti ha . Aaj pahli bar dekha ha apni 50 sal ki zindgai main k gamdi saheb bhi apny byaan ko badal dia ha . Plz agar ho saky to wzahat ker dain . Main points of this lecture by sobia bhatti……………..Q: Divorce law according state religion is different in whole world than how can Muslims follow it ? *** Q = In Pakistan 🇵🇰 state religion is Islam , parallel system is following , state law (which passed by parliament) & Shareeyat ( Quran,s law ) contradiction is in front of us , how we will solve it . Ans = First we will see Is it personal matter or state matter ? State only interfere in these issues if anyone is damaging people rights, life ,wealth & respect. Marriage,divorce matters r personal but sometimes in personal matters people damage rights,life , wealth and respect than for stopping this by legislation in parliament state will make law , if any school of thought wants to get help by law than they can . *** As a Muslim if that law is against ur Islam than avoid to go in court & show patience or leave that country. *** Q = (9:50 ) For getting label of married why state make law even here no one is damaging rights or life ? Ans = This state law is for facilitating to people, by marriage agreement people accept their rights and duties . In my opinion we would reform this marriage agreement ( نکاح نامہ ) because women & men thoughts has changed according this modern society. * Man was ruling in the house because he was looking all expenses of house now woman is also earning so she can get more rights so shortly I want to say this law is only for giving protection to couples & we can reform this نکاح نامہ marriage agreement. * By fighting we can’t purify ourselves. So for stopping issues God said write agreements. *** Q=( 14:40) In Eidat time ( 4 month menses period cycle ) widow or divorced woman can’t marry ? Is state interference here? Ans : Here State is trying to protect father,s rights .Man can also approach with his wife in 4 months.***Q : In Pakistan 🇵🇰 by parliament law passed in National state now 60 ./. Suni sect & 40 ./. Shiya sect is here , if state law is against our sect than wht will we do ? Ans = State law is giving protection. If ur sect have conflicts with law than don’t go in court. 2nd solution is this we can reform law , suni will follow suni legislations and sheya sect will follow sheya legislations . We have example: In subcontinent English empire allowed to solve issues according people religion & customs. …..to be continued
