Wow! I didn't take away from the video that you were teaching us to do illegal propagation. I thought the illegal part of it only entered into it if you were profiting by the selling of said propagation. I still am grateful for knowing the technique.

I didn't give it a second thought. My local greenhouse owner told me to split and divide my hibiscus to keep it happy. I wouldn't lose any sleep over it. 😉

Jenny, I love watching your videos and I have been so happy that you are back. I watched the video that you are talking about. You explained everything about patented plants being protected in that video. I thought as long as you don't sell it, it's okay. I watched a video with Dr. Dirr giving a talk in front of a crowd at a garden center, I believe. Someone asked him how to propagate hydrangeas and he was willing to explain how. I am pretty sure the Twist n Shout is one of his plant introductions or else it was an offspring of his introductions. So, I don't think Dr. Dirr would mind you spreading that plant around your garden or sharing it with family.

You my dear are an amazing gardener and I know that you have no intentions of doing something illegal or bad and that you are just a home gardener whom might I add has your master gardeners certificate. I know that you are not telling people to go out and propagate patented plants. You are just stating that plants may layer and propagate themselves. Carry on my dear friend. Love your channel.

There are other content creators that do this in their videos all the time and teach you how to propagate AND how to set up a way to sell the plants from your own gardens or yard. Anyway, I’m glad you made the video and glad you made this video. I wouldn’t want anything to happen to you Jenny! ♥️😊

Love to you-- as someone who watches a lot of your videos, I know you would not do anything intentionally wrong. Please do consider another layering video as I would like to see how to do it.

I'm glad I got to watch part of the video before it was taken down--had to go to the grocery store and run errands! I got the gist of it though thankfully! I'll never know what I missed! Thanks for posting the mea culpa. I just had strawberry plants that made new plants by runners in the fall and just replanted them to make more. It's smart gardening!

Patents do expire after 20 years just so you should be aware. The fact that it was patented and is a brand name does not matter as much as when the patent was filed. You see this with roses all the time for example, other growers selling a brand name rose that they propagated once the patent expired. This is also why many plants get retired and they're always on the lookout for the latest newest plant.

It happens accidentally sometimes when a lower branch touches the ground, to me that’s a happy surprise; if you’re not selling it I don’t think it’s a problem…

Just saw a video posted by the most popular garden content creator. She divided a PW perennial into 15 plants and spread it around her garden. Sure it was a patented one and she divided it for the health of the plant because the center was dying out. Not sure what the fuss is about if it is a plant you purchased and you are using the naturally occurring tendency for the plant to reproduce itself and moving it around your garden for personal use.

I had a hydrangea plant do this on it's own! A branch had been touching the mulch and rooted in. I also had a spirea come with 2 plants in one pot- it must've done the same thing. Plants are so amazing!

that happened to one of mine and I planted it. Was I suppose to throw it away? Same with my Hellebores . They spring up on their own . I am so tired of the "Patent Police" who monitor garden videos!

Well done for clarifying. I think you're ok personally though, because as a home gardener, you had no intention of profiting from or sharing propagated cuttings.

It's an honest mistake period. We run across that at a plant sale, can't donate plants propagated from a patented plant. And also the correct department inspects our plants for sale for bug disease, etc. As a master gardener you learn things.😊

Hi. Was watching your show earlier and you mentioned you could not grow Azelas or Rhododendron because of deer. I have never had a deer eat either one and a do have them visit my yard on a regular basis. FYI

As a practical matter, it is not worth the time, effort and cost for patent holders to sue individual home gardeners for propagating a few patented plants. I suspect that they realize that plants will be divided in due course when they get congested, propagate themselves by natural layering and suckering, and be propagated by cuttings etc. for home use (not sale) and that is built into the price structure.

As far as I’m concerned as long as your not selling your propagations it’s okay for personal use. As long as your not mass producing plants to give away it’s alright. A propagated plant or shrub here or there is NOT going to bankrupt the original grower with the patent. And where did they get the original plant from anyway ? Sure they spent time and money on developing certain features or improving those plants or shrubs but since “ creating “ the new plant or shrub their propagating those plants and shrubs themselves for free. SO in my opinion a propagation here or there is not going to bankrupt them or take away thousands of future sales of those plants because MANY people aren’t propagating those plants for their own personal use. Selling them yes a BIG no no, propagating them for personal use okay by me. Besides if I can get a few more plants from my originals it leaves me with more money to buy some of their other plants. To me it’s a win win. I’m sure not everyone feels that way and maybe it’s a patent law but as long as I’m not growing them with the intention of selling them oh well. 🪻💚🙃

I believe you were very clear at the end of your last video. If there is an active patent you cannot propagate and ‘Sell’ the propagations. It’s the making of money off of someone else’s creation. For your own use it’s yours. The only thing I am concerned about is people traveling with plants. Disease and insect eggs are not easy for anyone to detect and can be spread widely with this action. I’ve recently seen another who packed a bunch of plants from another state and brought them here. Ugh!! There has to be enough plants in your own area to satisfy your gardening addiction-I know I’m satisfied!! We have new terrible bugs and diseases all the time. They get that way from imports and travel. Examples: Spotted Lantern Fly can fly only about 100’ and it has made it from PA to IL in a year or two. Pine trees/wreaths brought in to our state has brought fungal and pest diseases to our pines. We can’t even transport fire wood from county to county and yet ‘some gardeners’ think they should travel plants and soil on planes--Arghhh! Stop It!!

Wow I didn’t know the spotted lantern fly is now in IL. I live next to the county in PA where it was first spotted. Not many here the last few years.

@@heatherk2693 just read it not long ago. I think it was from an extension website. Didn’t mean to sound too harsh on the author as I’m sure we all mean well, but there was another video recently and she brought a suitcase of plants back from FL on the plane! I just hope this isn’t a growing trend and just be happy with the plants that are either in your area or can be ordered from places that inspect them-at least I hope they are inspected. I was shocked also how fast that SLF has made it here to IL.
