1) Consent of a drunken person: 📜
2) Alcohol and road traffic accidents:
• As blood alcohol level rises to 30-50 mg%, there is deterioration in driving ability!. 🚔🚘Alcohol is reaction time, creates false confidence, impairs concentration and judgement, 🧠produces muscular incoordination, decreases visual and auditory acuity👁️👀🦻🏾. It leads to accidents.
• Statutory limit of blood alcohol levels in different countries (Table 19.1.5).🇦🇹🇦🇬🇦🇶🇦🇱🇦🇸🇧🇲
• S.185 of Motor Vehicle Act, 1988 (Amended in 2019) deals with driving by a drunken person or by a person under influence of alcohol. Whoever while driving (a) Has as BAC of 30mg% (i.e. 30 mg per 100 ml of blood) detected in a test by a breath analyser or in any other test including laboratory test👃🏾; OR (b) is under the influence of a drug which makes him/her incapable to proper control over vehicle, shall be punishable as P = 6m or F (210,000) for 1st offence and P = 2y or F (215,000) for repeated offence.💰💸💵
• S.202 of MVA 1988: A police officer in uniform🦺🚔 may arrest without❌ warrant any person who in his presence commits an offence punishable under S.185 of
MVA 1988.🇮🇳
• S.203 of MVA 1988 deals with breath tests👃🏾 to be conducted by a police officer on a suspected drunken person. It suspected person refuses to undergo breath test, the police officer may arrest him without warrant.❌
• S.204 of MVA 1988 deals with laboratory blood 🩸test of a person who has been arrested under S.203 of MVA 1988 (as above) to be conducted by a RMP. 🧑🏽⚕️The doctor can examine such arrested person without ❌consent under S.53 of CrPC by applying reasonable force if needed.
3) Article 47 of COI prohibits⛔️ use of alcohol.🍻🥃
4) Alcohol and Criminal behaviour: Incidence of suicide, homicide and accident increases. In drug-facilitated sexual as-sault, alcohol has been used.
5) S. 510, IPC: Misconduct in public by a drunken person. 🕺🏻Punishment is simple im-prisonment for up to 24 h or Fine (£10) or both.
6) Alcohol and trauma: If a drunk person sustains head injury (resulting into EDH or SDH) and dies after some days, the alcohol disappears from blood but it will be still present in EDH or SDH. It is b'se the blood of the EDH or SDH is clotted and confined in a closed space, that is not the part of circulation and so alcohol level remains as it was. So in case of delayed death, EDH or SDH must be preserved and sent for chemical analysis.🧠
7) Foetal alcohol syndrome occurs if alcohol is consumed by a pregnant woman.🤰🏻
8) If husband is habituated of alcohol, it amounts to cruelty towards wife.🤬
9) Dipsomania®: An excessive desire to drink alcohol.🍻🥃
10) Alcoholics anonymous: It is an international self-support organization consisting mainly of ex-alcoholics who encourage one another to abstain drinking alcohol. It was established in the United States in 1925 and now has branches all over the world.
11) Auto-brevery syndrome (Gut fermentation syndrome) is a condition in which excessive ethanol is produced in GIT through endogenous fermentation in patients suffering from intestinal🦠 candidiasis (Candida albicans). The patient may be arrested by traffic police d/t high level of alcohol in blood.🩸
12) Dry days are specific days when the sale of alcohol is banned. National holidays such as Republic Day (January 26), Independence Day (August 15) and Gandhi Jayanti (October 2) are usually dry days throughout India.🇮🇳
