It has a been a awhile since I listened but you have to prove harm was done. I don't remember about intent. I don't know about how the 2cnd law team wrote this case but she said on the first one it was too much about Thomas Markle and that would not be revelant to her case. Defamation lawsuits are the hardest to win, even when you think you have a really strong case. I think most questions will be deemed to be "unrelevant for the case" and thus not answered...
