The Los Angeles district attorney is looking into new evidence in the twisted case against Lyle and Erik Menendez. The brothers have served over 30 years in prison for the murders of their parents, Jose and Kitty Menendez, back in August 1989. Well there's been a lot of controversy on whether the abuse the boys suffered really happened. Gypsy's abuse was easily proven with medical documents of the forced pretend illnesses that her mother told everyone she had. I believe with all the new evidence coming out the Mendez brothers will be released in the spring of next year

It's not right that the SA wasn't allowed in the 2nd trial. Their testimony was heartbreaking. The way people treated boys that were abused back then is wrong. They need to be set free!

Also the letter was allegedly written 8 months before the murder and both the recipient, Andy & Erik testified. And yet neither of them mentioned the letter, which would’ve been key evidence? @@bellaisapepper If I’m facing Life in Prison or Death penalty, I’m definitely remembering it, because if what was written in that letter is true, which was abuse as a teen/adult, then. That would have fresh painful memory. Again 8 months before the murders & it alleged continued assault. Lawyers would’ve prepped Andy & got info from him before his testimony. Even in 30 years in prison, when the verdict judgment had been handed down, they he should’ve remembered, he had a lot of time on his hands to do so in prison.

I feel like too many reports gloss over the fact that Lyle testified that his mother was s’xually ab’sive towards him. Kitty wasn’t just complicit in Jose’s abuse of her sons, she was an active participant.

Totally deceitful pair of villainous "parents". I listened to the original court case and believed the boys. There was one doctors evidence which I considered as collaborative with regards to abuse. He had examined the boy on one of the occasions he attended the emergency department at the hospital. The injuries he had sustained were consistent with abuse trauma.

Anyone gullible enough to fall for the "Abuse" excuse needs help. They could have walked away they were plenty old enough. They went on 700,00.00 shopping spree. That is very telling. In prison for 35 years is enough time for them to be in prison. They are in their 50's & they haven't done anything wrong in prison. The one time Erik said no to him he had a knive at his throat. The man wasn't to be messed with. I do believe the parents failed miserably and that the father was a child s/a'er of the M brothers and other children as well (the info has been out there for many decades). I believe the mother was an enabler of her husband's abusive behavior. The M bros deserve their justice; unfortunately, they murdered their parents in cold blood, so the parents cannot defend themselves in court. Will be curious how this turns out for the bros.

Is not about them being innocent, they have never denied they planned it. However, their mitigation facts were excluded from the second trial, taking the possibility of lesser charges, just to push an outcome. Is a constitutional right to present a defense, the prosecutor pushed a narrative and invalidated their experience, that is corruption.

Idolization, seduction, body dysmorphia, desire for attention, etc. Every message she sends out (in particular to impressionable young women) to the world is garbage. Surely she advocates for certain convicted criminals for early release. However, you won’t hear the other side from the jury, family testimonies, etc. of why said criminals were convicted in the first place. I don’t allow Netflix form my opinion on a subject and certainly won’t entertain the words of a career jezebel to sway me a certain way towards anything. They were terribly abused their entire childhood and then spent 35 years in an all-male prison, where I am sure they have experienced more of the same. Abuse changes who we are, and often, abused boys grow up to be abusers themselves, so before I join the "let them out" chorus, I need to know what kind of therapy they've had and what kind of men they have become. They are now in their 50s, and whether or not they're a threat to society has yet to be determined.

@boring_elderly_millenial There are some people in prison today who have said that they actually learned how to be a criminal after they were falsely imprisoned the first time. It does happen that way, sometimes. I think it depends on the individual on whether they have the potential to reform or just become a better criminal. I think that the place to begin is with reform, but have them re-evaluated on an individual basis.

Following the same rationale, their parents might have been abused and traumatised as kids (hard to say as they have been killed), so as a result they shouldn't be held accountable for their actions, as in the end they might also be in their own ways, victims of society or their parents. Everyone failed everyone so we should condone violence as it's someone else fault, the notion of free will doesn't exist so we are clueless victims, with a few exception society defines as monsters (these guys don't have traumas they are just bad) and the rest should be released based on a popular vote on social media.

I have followed this case since it began all the way back in 1989 and I was one of those people who was saying lock them up for life! While I totally believe there was another choice that the Menendez brothers could’ve made at the time after 35 years and with everything that has come out, it’s time to let them out of prison. Clearly they do not pose a threat to society and I now believe they have more than served enough time!

I watched the new documentary on Netflix and it seems the prosecutor had a personal vendetta against them she had no sympathy and was very angry! And it was unfair they couldn't use their SA defense!! Isn't everyone entitled to a defense?

I would love to see them out. And yes I am old enough also to know this case. If there is no evidence to prove they were sexually interfered with, then there is also none to prove it didn’t happen. Both Lyle and Eric to me my whole adult life seem to be telling the truth.

Not just that evidence, but all the key evidence from the 1st trial that was omitted in the 2nd because the judge claimed boys couldn't be SA. Over 50 witnesses (family, friends, etc) who testified about the SA was excluded. Plus, the jury was given unreasonable sentencing instructions, forcing them to choose between convicting of 1st degree or saying no crime was committed at all. The DA was up for re-election & desperately needed a win after losing high-profile cases like Rodney King & OJ, & they made sure to get a conviction in the Menéndez case. At most, the bros should’ve received imperfect self-defense/manslaughter, which was an option in the 1st trial but not in 2nd. This was clearly an unjust situation that deserves to be retried, at the very least. Otherwise, free these guys with time served!

no. they wouldn't have to do that. this was a special high profile case that had with two completely different trials because the first had two hung jury deliberations and the second trial (the solution) omitted evidence from the first to land a conviction. Most trials aren't like that. If ANYTHING, I think they would have to look at trials that might have done similar tactics, and used the same judge.

you would only revise other "life without parole" sentences if there was reasonable evidence to justify reviewing it. That is evident with the case of the Menendez brothers. If other jailed persons with life without parole have enough evidence, then they too would have their case reviewed.

No, it’s a case by case basis. In this case evidence that rightfully should have been considered to determine guilt was withheld only to be considered at sentence. But once you’ve determined the charge they’re convicted with aka first degree murder the only mitigation at sentence is death penalty versus life without parole. This is a miscarriage of justice. Cases without any new evidence or indication of potential miscarriage of justice would not be revisited

I was a little girl when the Mendez brothers were trial for a second time for the tragic crime of them ending, their parents lives. I had a question on why they didn’t confess to the psychologist about the abuse that was going on with their parents, but they confess to the crime and so I decided to google the psychologist and peoples magazine has a very interesting article about the psychologist and the confession that they made to him in confidence. I think this case is a lot more complicated and that the more you peel back the layers the more you find interesting things about it.

If they were bragging about what they did, they wouldn't include what their parents did as bragging. The thing is, law is what is supposed to determine the outcome of their cases. Some places consider what they did as self-defense, but California law doesn't recognize ending child Moe Lesters lives as self-defense. It's going to be very difficult for the Menendez boys to walk out free men.

It was his ex that went to the police with these tapes and the reason why they made these tapes immiscible in court is because they threatened him, and the judge found that this no longer breaks client privilege confidentiality because they made threats to him

And it’s hard to think why the cousin, Andy, who did testify at both trials, didn’t mention the letter in his testimony, especially at the first trial? And the other theory that the letter was sent to back up the impending murder. It’s just so hard to know with this guys! If only walls could talk.

⁠With all due respect that’s incorrect. They only have to report if you threaten a future crime, or you threaten to harm yourself. Confessing to a crime in the past is very much protected under patient/doctor confidentiality. In this case, because the brother threatened the Dr, that is the reason why the conversations were not protected. In most states they have to keep this information private unless given permission to release it or if they say they are going to commit a crime in the future. Some jurisdictions require mental health professionals to tell authorities if their patient admitted to a crime, but there's special stipulations. Generally speaking they are not supposed to reveal past information if there is no threat to people being hurt in the future. In this case it's a toss up. I would say I understand why they spoke up, but I will also add they should have come to the conclusion they were not a danger to others and that they killed their parents because of the abuse. It's not like they were violent criminals.

I grew up in Orange County, CA just south of Los Angeles in the 80s. I remember this case vividly. I distinctly remember comments like, "boys can't be r*@#$ because they have to be aroused for anything to happen." We have come a LONG way since then. I'm no fan of Kardashian but she got this one right. If it was the Mendendez sisters, they would have been left off or not charged at all. And there would have been resources to help them before it got to that point.

Yes, very possibly they could have been convicted of a lesser crime. That is exactly the issue that caused the mistrial during their first trial. The jurors could not agree on the level of homicide-1st degree or manslaughter.

After all that these men (boys at the time) experienced at the hands of their parents, I agree that they needed some help and rehabilitation. But, they did not need to be banished to prison for the rest of their lives. They were tortured and traumatized since early childhood. They lived in fear of their parents their entire lives.

I don't think that even girl's would've been treated much better, because in the late 80's/early 90's SA was still treated like a "they asked for it" kind of thing... male or female. That started to shift with the release of films like Jody Foster in "Accused". It's not even that society hadn't evolved in the understanding of SA, but it also didn't even understand things like narcissism & Narcissistic abuse. I think more than the Mendendez brothers not being girls... the real issue was the parent's wealth. Had the Mendendez brothers come from a poor family with no inheritance to gain the outcome may have been different. It's the wealth that's always used against them & their motives & caused a dismissal of their claims despite all the actual evidence of abuse.

Herein lies the challenge: They premeditated and planned it, they were adults at the time of the crime (didn't live at home/had other options), they attempted to conceal their involvement and THEN they spent their parents $$$$$....... It doesn’t matter what other victims do though. It matters what these unique individuals did in response to their abuse and why. This offers an explanation rather than an excuse for their actions but also mitigating factors relevant to sentencing. Level of punishment is informed by level of culpability, mitigating circumstances, minimum punishment for justice to the victims and perps ongoing risk to the public. Life without parole is rarely justified in my opinion for a victim who kills their abuser even when not strictly carried out in self defence from imminent risk but rather as their perceived only way to release themselves form ongoing danger

The jurors never would have convicted if they knew what had happened like they did at the first trial. It was the same judge the second time and he said he learned what he did wrong, so said I won’t allow the abuse excuse. They were denied a defense and victimized over and over again. It was wrong from start to finish and you can’t get any more wrong than that.

This case and similar cases like this who receive a well produced film, mini series and/ documentary, portraying a small scope of the events surrounding the crime. True crime genre is setting a very dangerous precedent for cases that have been prosecuted, as stated by most prominent forensic psychologist. Many people who watch these mini series or true crime dramas walk away with a perception that is very obscure and often it redeems or convicts a defendant suspected of committing a crime. This is the exact reason why real trials are not held based on public opinion alone and thus proves the importance of the role of a Judge who is supposed to be impartial and responsible for distinguishing which information should and should not be presented to avoid a case being tried based on emotions or feelings surrounding the defendant’s actions.

Their father was so powerful and he had threatened them that he himself would end them if they ever bucked up to him. He had all of the money, he had all of the power and he had been mentally and physically abusing them their entire lives. Your comment is asinine.

I remembered that the prosecution portrayed them as a couple of spoiled brats who were money hungry and their behavior immediately after the murders confirmed that. The SA is new to me and maybe they deserve resentencing.

I wish justice would be served for Dominique Dunn, after watching this Monsters Movie. Who cares about Lyle and Eric, they're both two spoiled rich brats that should have been put to death. Sweeney murdered Dunne and I totally forgot about that case. I was young when it happened but he father Dominick Dunne had some great law shows that he would host. Why is her murderer still walking the street and why doesn't anyone care about that?

I’m no expert but if this was about money you’d think it would be planned properly. If it was premeditated, they would’ve had a rock solid alibi. If they did it for money, they wouldn’t have sat there waiting for the police to come. If they wanted an early inheritance they wouldn’t have left guns in their car. If they lied about the abuse, Erik wouldn’t have sat in the court room biting his finger to stop himself from crying 🤷‍♀️ Monsters try to force the tears out, not bite themselves to force them to stop.

It was first degree premeditated murder. Just cos Kim Kardashian gets involved doesn’t make it any less first degree or any less murder. If they were abused, they were not threatened at the time of the murder. It was not self defense.

Cousin Andy passed away, and while his mother (Jose’s sister) was going through his belongings, she found the letter and turned it over to the legal teams. This was back in like 2001-ish.

It was in his cousin’s belongings. A few years after the cousin passed away, the letter was found in his belongings. The letter was found 6 years ago.

There are so many victims in prison for life that will never get out because they're not the famous Menendez brothers. These two slaughtered both their parents. How many thousands upon thousands of other victims THAT WENT THROUGH THE SAME THING made different choices? Ran away? Went to the authorities? They didn't have to murder them.
