The plaintiff hired the defendant’s moving company and paid in advance. However, after the job, the plaintiff claims the defendant overcharged his credit card, so he’s suing. The defendant says she initially gave the plaintiff an estimate before the job, and he agreed to the extra charges on the day of the move.

@@BREEZYM6015 it’s called a business choice. If you don’t want to do business with a price structure like that then don’t hire that company. Just be be aware for a business to not use a model similar to that and to stay profitable they will need to overcharge some customers more than others due to so many unknowns in the estimating process. It’s just how things are done. Sometimes you are the bug and sometimes you are the windshield. I personally prefer a more simple model but as a business owner in the service industry I understand the decision for using that model.

Moving companies area a scam. ALWAYS have them come and view the items in the house/apt and give a hard quote. We had to move our daughter from Georgia to Maryland and we listed EVERY single item and then told them we would have 25 boxes sizes 2x3x1.5. We were so exact and they gave us the quote. The movers showed up and we had everything listed. They quoted $2,500. Once they had the truck partially loaded they said it would be $6,500. I flipped out made them unload the truck, lost a $500 deposit. Gave the workers $250 because they were good guys and cancelled it. Rented a truck for $ 650 and my daughter had friends load it and her husband had friends unload it and it cost us around $1,300 plus the lost deposit and $250 I gave away. Moving companies started coming up with all kind of crap and they can be a rip off. Learned my lesson.
@TheGamerDaniel
@TheGamerDaniel 6 месяцев назад
You should have gotten your deposit back because they changed the contract. They only get to keep your deposit if you just change your mind for no good reason. In your case, they breached the contract, so they have to give you back your money. You're such a nice person for giving the workers $250.
@jvillebil13
@jvillebil13 6 месяцев назад
@@TheGamerDaniel I could have sued and went to court but it was 4 hours from my house and she was in now living in Baltimore and I live in Florida. In the end moving was a pain because I had a stroke a few months before and my wife drove the truck. She hated it, but we ended up saving money in the long run so I didn't fight it. The movers she said were nice and we didn't want them to get caught up, so I just told her to give them the cash. Firm believer in doing good for others comes back to you.

@@tchevrier They said they had to wrapped the furniture, the boxes were to heavy, it was going to take longer than expected. I was home in Florida and my wife and daughter were there in Georgia so I kept talking to both them and the company on the phone. The lady on the phone was probably the biggest jerk I ever dealt with. I knew once they had our stuff in the truck they would hold us hostage. It was a total scam. Just glad I rolled the diced and hoped we could find a truck all in a matter of hours. I had moved many times early in our marriage but we always did it ourselves, but we're too old for that now, plus we are financially set. I could have paid the extra $4,000 but it was the principal to me. I gave them a scalding review. Oh I also forgot they were supposed to show up 24 hours prior and check everything out. They didn't call or show up and were 4 hours late and just showed up. We learned our lesson.

Any moving company would be foolish to touch any "extras" until the change has been added and initialed by the client on the contract. If they don't want to acknowledge the charge(s) you simply don't touch that stuff. It's their problem, not yours. It's not about being greedy, it's about being open and honest about any charges. No surprises. They can't reverse the charges when it's written in plain english and initialed by the client on the contract.

this guy said he should have checked the yelp reviews etc. alot of moving companies run some bait and switch scams. like lowballing on estime then showing up and adding a ton of extra charges - which it sounds like these guys were - especially when they start throwing around things like "cubic feet". this guy managed to get his stuff delivered. but there are some companies that literally hijack your stuff and put it in storage at their place until you come up with an exorbitant amount of money. check reviews - and look at the low scored ones and the middle ones. Be willing to pay a bit more - you get what you pay for.
@juiopop2365

I was a professional mover for 15 years. Everything she said was standard-the moving software calculates a square footage based on the room on the truck/size of the truck. People don’t understand that we as movers DO NOT MOVE LOOSE ITEMS. That becomes a liability to us-you think that we can load the truck and cram clothes, lamps, books, etc in nooks and crannies, that just doesn’t work. Not only does it take much longer, but it is a logistical nightmare. The estimate for boxes was spot on-10 extra boxes at a minimum of $4 per box, our wardrobe cartons are $15 each. Brown paper pieces (quad layer) are $4 a PIECE. If the use a bundle of brown paper, that’s automatically $100. People also don’t realize that you aren’t really covering a third man in hours, you are paying what the two men would have cost you in overtime if your job had not gone over. My biggest advice is don’t do the estimate over the phone, and if you do, send lots and lots of pictures. There really cannot be enough pictures. Understand that many companies will not move items inside of drawers and furniture-which means that is EXTRA TIME. Every single thing in the moving industry is an up charge. Save yourself money by moving as much small things in your car, especially if your move is local. For long distance, EVERYTHING, and I mean EVERYTHING is going in a box or getting wrapped. That truck is covering hundreds of bumpy roads and pot holes. Last, go with a REPUTABLE company. Cheap movers will get you broken furniture. You get what you pay for. I completely disagreed with the Judge on this one. Having been out there when a customer sees that your truck is bigger than expected and adds and adds on. It they two hours over with three men, imagine how much more over it would have been with two men. It’s all about perspective.

I think the favor amount seemed unfair. Movers had to do extra work and time because the client withheld amount of stuff being moved. Movers charged extra $800 and client felt $200 should have sufficed, but of course he says that now after he had his discover withdrew the payment per his request so he was cheating the company/movers. They collected $800 and he felt $200 should have worked, then he should have had to pay in-between $400.

Maybe you should go to the home in advance to see what they have and sit with them and do a contract than there wouldn't be this kind of recurring problems that all these moving companies seem to have and get the total right the first time and not tell them after you have all their stuff being held hostage on your truck !!

The defendant was actually pretty impressive. She did her homework. But that's messed up that he is getting so much more than what he deserves.

The moving company’s “helper” that appeared in court did not answer the judge’s questions to her satisfaction, neither did the helper provide proof that the plaintiff agreed in writing to the additional charges that were assessed. Hence a victory for the plaintiff.

Two different rates and more than double the estimate for a job that the movers took 53 minutes more and added an extra man? Maybe movers should look at the job first not take the client’s word because that was their first mistake, they are a contractor and I don’t know any contractor that makes a bid and charges before job is done yet alone add in up charges to be paid before job is done! Movers were being sneaky and deceiving.

The plaintiff was definitely overcharged, but idk if I agree with how much they had to return to him. Just seemed like a throw away number JM liked the sound of, not any actual judgement. Guess it's just some real rough rough justice lol

It doesn't take a rocket scientist to decipher moving expenses. Plaintiff is a cheapskate
