I am watching this in relation to the Dallas case of off duty police officer Amber Guyger shooting an unarmed man in his apartment which she thought was hers. Now in this case I presume the defense will be mistake of fact. She thought it was her apartment and that she was shooting an intruder. However, with this kind of defense, to me it puts the burden of proof on the defense to prove that the defendant made a reasonable mistake and the burden of reasonable doubt on the prosecution to show doubt that the mistake was reasonable. What are your thoughts?
