Engaging in Insurrection is a CRIME. For Trump to be disqualified, Trump would have to be convicted of Engaging in Insurrection by a jury beyond a reasonable doubt. However, this is a CIVIL proceeding so the court would have to "PRETEND" that Trump is "Guilty" of Engaging of insurrection and disqualify him from the ballot. So the court would say that Trump is "Guilty" of insurrection but he really isn't because the court is "Pretending." (because its a civil proceeding and not a criminal proceeding. The Court effectively NULLFIES a crime of Engaging In Insurrection, basically saying that Trump committed a crime but he really didn't.)

What Is the Disqualification Clause? Fourteenth Amendment, Section 3: "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability."
