Info ON Blakely Factor:
The discussion was over the "Blakely Factors". Blakely is when the prosecution wants an enhanced (greater) sentence than the normal sentencing guidelines.
There are TWO Blakely factors submitted by the state:
1- Defendant posed greater than normal dangers to other people as she fired into the vehicle
2 - Potter abused her position of authority as a license police officer in full uniform.
State says defense agreed to have a "unitary" trial, meaning the jury would also hear about the Blakely factors. Defense said they never agreed to that and they want a "bifurcated" trial. Judge grants that. This means:
Bifurcated means to separate this issue from the guilt phase and the JUDGE will decide on the Blakely factors when/if there is a conviction and will solely be up to a judge to determine if the sentence will be enhanced.
MOTIONS:
Potter prosecutors filed two motions today after the problematic testimony from Mychal Johnson on Friday.
1 - Motion to keep defense from eliciting expert testimony from non-experts. (remember Johnson testified deadly force would have been justified)
2- Motion to permit State to elicit testimony related to union membership (Potter was Union president at one time) for the purpose of establishing possible bias in various law enforcement witnesses
Charges: Note: Both prosecutors and defense agree the shooting was an accident but prosecutors say her actions were criminally negligent.
First-degree manslaughter (added in Sept.) - “recklessly” used a firearm - causing Wright’s death. - Up to 15 yrs in prison - In Minnesota, a person can be convicted of first-degree manslaughter if they cause the death of another while also committing a misdemeanor - in this case, reckless handling of a firearm.
Second-degree manslaughter - requires that prosecutors prove only that the defendant acted with "culpable negligence" as the defendant consciously took actions that created an "unreasonable risk" of causing death or great bodily harm. - Up to 10 yrs in prison
Former police officer Kimberly Ann Potter, 49, stands trial for killing Daunte Wright, 20, in a disastrous traffic stop. Potter’s attorney has also said that she will testify. You can watch jury selection in the player above. Opening statements are scheduled for Wednesday, Dec. 8.
There is no dispute that Potter fired her gun. The question is whether Potter’s actions constitute first and second-degree manslaughter under Minnesota law.
As seen on body cam video from April 11, 2021, officers with the Brooklyn Center Public Department pulled over Wright for a traffic stop. Officer Anthony Luckey began to handcuff him against the driver’s side of the car. He suggested Wright was about to resist.

A cop for 26 years but uncertain of the training she’s received over the years? Never pulled her duty weapon, worked as a crisis negotiator for many years, but claims to have never been in a stressful situation? The prosecution did their job! Lord have mercy on her soul.

I watched another ex officer of 15yrs who went through this & he said there was critical tactical errors from the onset of them trying to make the arrest. He said they should have told him to turn the car off & closed the drivers door. If they didn’t do that they should have taken him to the rear of his car or the front of the patrol car & then cuffed him. That way when he attempted to take off he wouldn’t have been able to get back into the car If they had done that this incident would not have transpired The fact your saying she was also one of the main training officers as well as a FTO that’s major issues This officer that watched also pointed out that there has been several officer involved deaths in that police district - so it’s very clear that there needs to be a complete overhaul of this department it’s policies & training

She could have softly walked her into answering questions like “Why did you think you’d go to prison?”, or “What in your experience would be the reason suspects go to prison?”, but she just couldn’t help herself from completely screwing it up.

The ambulance thing seems a little off to me. It almost sounds like they knocked her out for a bit before driving her to the police station ( which is so weird ). I have a lot of questions about this ambulance thing. Who called an ambulance for her ? Why did she get in the ambulance ?

@@sarahrose4126 She was collapsing on the side of the road over how distraught she was, because she just shot and killed a man without ever meaning to even take out her gun. Weather you believe her or not - to her fellow officers on scene it must have looked like a psychotic breakdown. I mean, she entirely stopped to function as a cop, she even waved her still loaded gun around while whining about going to jail. Also they probably ordered four or five ambulances (one shot, one passenger, two in the other car, very fluid situation). It's very likely that one of the crews was like: "Hey, that officer sitting on the curb crying into her hands... is she okay? Was she hit? Does she need somebody to talk to?"

If you watched the trial, you’d know that even officers with extensive training have experienced pulling the wrong weapon on accident. The reason they have training on the matter in the first place is because they know it’s something that does happen.

Wow, great finish… the prosecutor literally walked Kim down every motion that led up to the shooting, and you could hear the emotion from Kim as her own voice was used to confirm what was put on video display before a live jury. That was gruesome. The prosecutor just ate Kim alive.

She's so confrontational with the prosecutor. Her answers were almost head scratching. Her constant " "If that what it says" "I guess" After 26 yrs she should've had plenty of situations like the one with Daunte. You have a taser that you have to spark test everyday before shift. She went a few shifts without a spark test. She's so evasive with her answer's.

@@freedom1439 Yeah, I think she harmed her defense by taking the stand. But then again, it's _really_ difficult to put up a "reasonable use of force" AND "honest mistake" defense without having the defendant speak. In the end it probably doesn't really matter. It's pretty clear what happend - she meant to use the tazer, mistook her gun for it and point blank shot him, then was so distraught over that that she stopped to function as a LEO - so the only thing we have to wait for is if the jury thinks it is reckless for a well trained LEO to mix up their tazer and their gun... I personally hope they do, because I don't wanna give cops this excuse, but I'm not on the jury, so...

She was going to correct the trainee later for not taking the subject to the rear of the car. Would this of happened had she said bring him back here. Two reasons i can think of so he wouldn't be able to get back in the car , and to get out of the road. Mistakes need to be corrected immediately, in my opinion.

That's the main thing I keep coming back to with this case. I'm a paramedic and unfortunately I have been in an RTC with the ambulance. It was definitively my partners fault (he was driving) and the impact was mild, but shook us good. The very first thing my partner did after both cars came to a stop is that he jumped out the cab, ran over to the car he just smashed into and started treating the people in that car, while I was requesting backup from dispatch. You can make a mistake, but you can't stop doing the right thing entirely because of it.

Some people are just not cut out for the job. I know she had no intent to shoot this boy but she did. We are responsible for every round that leaves our weapon. I can also tell that most of the people commenting here have never been put into a high adrenaline situation unknown dangerous situation, where everything is happening at once. Try it you will be amazed at the different perspective you will have. What you remember happening vs what actually happened. She will have to pay the price for the mistake she made. That young man paid an ultimate price for resisting arrest. And probably would have been released from jail in no time at all.

She’s doing her own “CHARACTER ASSASSINATION”, no pun intended! Her attitude and sarcasm are a complete turnoff ! Before her testimony, I did feel some level of compassion toward her. But she’s making it very hard to do so now. In my opinion. Her memory also seems to be VERY SELECTIVE as well. Even for the simplest of questions. She was definitely ill-prepared for this by way of her attorneys.

I wonder what other things she had no experience in that her department deemed her as an expert on? A police department is a mini military org. and you will continue to be promoted if you’re a good soldier until you reach incompetence. That has to be true after years on the force. Are you claiming she should be pulling them more often? That makes NO sense.

@@markp.7165 She's been there 26 yrs in a low crime area...but she's been loyal, showing up every day, on time. They've scooted her through the ranks for that, but in essence...she's not actually experienced much. The fellow officers with her that day have so far testified they were prior combat vets, or came from larger cities with more crime. She was in over her head but it worked...till one day it didn't.

These situations can happen no matter if it's you're first week on the job or you 26th year. Second, would that argument not apply to thousands of officers all over our country in small towns and other low crime areas? Does that mean they are not qualified? Just to be clear here I am not saying she doesn't bare some blame here she clearly does my point is that Mr. Wright does also because had he not tried to flee the police he would still be alive. He made a mistake that cost him his life now the question is what will her punishment be for her mistake?

She is not a very likeable person in my opinion! I watched this entire testimony and I just keep saying how awful this has been so far. There are a lot of “I don’t know” “I suppose” “if that’s what it says”….it seems as if she can’t remember anything at all. I understand the trauma involved, but to me some of this testimony seems untruthful and hostile. The jury will see through it. Taking the stand was not a good idea for her. Sadly

@@paguardian3123 I don’t plan to do anything. The justice system works in this country. And I believe the verdict will be GUILTY. I understand we are a human and humans make mistakes but mistakes have consequences. People accidentally steal things and are still charged with theft. If a citizen accidentally shot another citizen believing they were using a water gun for example, they’d be charge just the same as Mrs. Potter. Just because she is an officer doesn’t excuse her from the consequences of her actions. She doesn’t deserve a life sentence for this but in my opinion, she deserves some prison time. This mistake was unacceptable

By her reaction, all the crying etc… for a 26 yr’s is VERY ODD. Could it be possible that she never used her gun or taser on duty because the male cops were overly protective of her, proof is, how they fawned over her after she had killed someone, that she never had to. She appeared to feel more comfortable & confident in the roles of “trainer & Union Rep”. Based on the video from inside their squad car she seemed irritated & snippy with Ofc. Lucky, & for some reason wanted to exert her authority. She grabbed all the compassion for herself by not trying to see about anyone else but herself. “Way to protect & Serve”

Sadly I think this goes to show that the overwhelming majority of police officers in the United States, and most likely the rest of the world, are woefully under-trained. At the beginning over her cross, the prosecutor mentioned that she had over 1700 hours of training over a 26 year career. That amounts to 60 hours a year. Also, the expert witness that went up before her testified to "slip-and-capture" where people often will mix-up processes and under stress, revert to the first training they had. During cross-examination, she mentioned that when she first started to carry a taser, that she initially carried it on the same side as her gun. I'm willing to bet that that was the last time she really had intensive training on the deployment and use of a Taser. Sounds like exactly the type of process that the expert witness had just finished testifying to. The worst part about this is that if this prosecutor had any tact and skill at all, she probably could have gotten a confession out of her on the stand, but all she got was a crying woman saying "I'm sorry" and "I didn't want this to happen."

Officer Potter is a prime example of what is wrong within a lot of police departments, very limited in basic law, training not taken seriously, daily checks of equipment not being carried out, not known the difference in weight, touch of gun and taser. It all adds up to disaster. This officer 26yrs, thousands of man hours, hundreds of training hours, training instructor, union representative. Wow absolutely shocking and extremely worrying.

It's clear she's been warned about how Prosecution questioning sets up everything to get to their end game attack. They should never have allowed her on the stand. She's far too emotional, defensive and remorseful to ever be seen in a positive light. Clearly, she's remorseful at having shot Mr. Wright, but it doesn't convey well on the stand. Comes across like she's only remorseful at losing her job and going to prison. Which is exactly the direction the Prosecution took in the questioning.

The amount of time she sits in silence after a question is asked was very strange. Even her own attorney had to coax her to answer and speak up. She had to get on the stand, there was no way around that. But it wasn't great for her. She better pray the jury bought her fake crying. I didn't buy it. The only time she looked truly remorseful was when she spoke about how she had to quit her career.

Hearing Ms. Potters answers today, i wonder how all the theoretical exams and tests look like, and on what level they are. One thing i learned today listening is that it's obvious they don;t train/learn you not to contradict yourself.

@@prayingmother It doesn't really matter if it was an accident. If she felt that the life of the other officers or herself was in danger, she was justified in deadly force, so if she meant to Taz him and shot him by mistake, it really does not matter. You do not get hours to examine 24 frames a second. She messed up, and she should pay, and she will the rest of her life in many ways no matter the outcome, but she did not meet the elements of the crime she was charged with. The more significant issue in the last two nationally watched cases is that prosecutors overcharged the crimes. They do this all the time. Kim, Kyle they had resources write or wrong, to defend themselves. The poor people they do this to daily across the country do not. They are stuck with public defenders that do not return their calls or often even talk to them until the day of a hearing to the trial. They do not have any vested interest in winning the case, and meanwhile, the prosecutors have unlimited resources because they are spending someone else's money. You want to help out disproportionately charged minorities press for criminal justice reform that stops overcharging cases and punishes the state if they bring issues that the jury believes were not warranted, even if it is only the payment of legal fees. This would give people the opportunity to get better counsel as cases would possibly be taken that might otherwise fall to a public defender. Also, the state should be required to pay large bonuses in cases that public defenders win to have a reason to fight for the defendant.

@@raeth2309 I was a public defender. I cared immensely about my clients and I was devastated by losses. Just because you pay a lawyer a bunch of money does not mean you are going to get the best advocacy possible.

I thought she did awful. Even though her tears were real. She demonstrated that she was carrying weapons, that she didn't know how to use. She answered the trading questions with "I guess so'. And "I don't know". She believed she was using a taser, but payed no attention in training. Soooooooo why are we supposed to believe that she isn't responsible for her mistake?

She was obviously instructed by her lawyers during the lunch break to change her demeanour and start whispering her answers with a remorseful twist. It was infuriating to watch because quite frankly..I don’t think she gives two craps whatsoever that she killed Duante. Guilty as charged.👎🏾

Interesting you say this Dan. I'm only 25 minutes into the cross and my initial impressions are that they dressed her like a granny, to make her soft, yet her demeanor is very hard and unlikable. If she can't be more amiable than this, there is no way I would put her on the stand! I look forward to seeing the change after the break. I'm assuming her attorneys were seeing the same thing I was. I would have thought they would have ironed that out, before putting her on the stand. First impressions are powerful!

Her performance was very weak. Not much of a performance at all, really. Alec Baldwin, though?!? Now THAT was acting. That was a real performance. I've never seen an actor ham it up so much. Why would an officer’s rookie status prevent KP from correcting improper procedure in front of a suspect? Isn’t that what training involves? She couldn’t let the suspect know that the arresting officer is a rookie? That doesn’t seem like sound reasoning given the risk of things going awry when proper procedure isn’t followed.

Because you don't do it in the moment because then the rest of the time the trainee is then focused on the mistake and not finishing the task. You wait until you're back in a safe environment to assess what went right and wrong so the trainee can actually learn from their experiences.
