MoFi-Gate: Settled to pay $25 million sanction...if you take action! 

In order to proof ownership, in the settlement paper (pdf attached in the video description) it says that you must send a picture or photocopy of the serial number of each record.

What makes me laugh out loud is that all of us audiophiles didn’t even know the difference. 😂. I’m happy with every single purchase I’ve ever made from them.

This is a typical American settlement against a company that clearly committed fraud ! The lawyers make out , MOFI makes money and the consumer is screwed ! Where is the punishment for MOFI?

5% cash back sucks. The 10% credit should be more like 20%. Glad I haven't purchased ANY MoFi stuff in the past few years.

Too many hoops, rather than being forced to offer fair compensation here. It is more about protecting Mo-Fi from getting defrauded into paying a credit to those that do not deserve one.

The most devastating for MoFi would be sales in the future. Who can believe them anymore? Buy from other sources and be happy!

Great video! Thanks for breaking it down. In any case, I'm in Canada so not included in this lawsuit. I only splurged on one MoFi a few years back, and that was for Miles Davis - Kind of Blue 2 x 45 rpm in the soft touch box (and to be honest, I prefer the traditional 2 LP jackets that ex: Acoustic Sounds stick to) thinking I was getting an analog sourced recording. The feeling of being duped at a premium cost REALLY pisses me off; thankfully it was only the one. I can't imagine how it is for people that have a few dozen or more from that list. In any case #2, I will make it simple. MoFi will never get another penny out of me. I vehemently reject all forms of hucksterism. In 2023, thankfully there are so many other existing and emerging sources (the OJCs being the latest) competing for hard earned dollars. NoFi to MoFi.

Thanks, very informative, I have quite a bunch in the list and should still consider what to do. However, having purchased in Europe via official online retailers, it is totally outrageous we are not covered in the same way.

I understand people are mad I'm mad but at the end the records sound amazing . I will continue to support.Mofi I would hate for the company to go out of business. That's my personal opinion.

Thank God I don't own any mofi records because i dont keep the receipt for vinyl records unless they are warped or scratched from the factory. Most of those titles are years old! They made it impossible for people to get their money back. That angers me more than the digital step! Naughty company i would never buy anything from them ever! Good luck!

I own some MoFI records, and I'm very happy with them. I also own a few non-MoFi records that are "audiophile" versions (Namely Supertramp and Alan Parsons') that are very proud to show they were digitally mastered. So, no fuzz, no big deal.

I'm sorry... but I think this is silly. I agree that people shouldn't lie. However, what counts is how the record SOUNDS, and none of this other stuff really matters. (Did your record magically start sounding worse the minute you found out it was mastered from a digital file?)

I just received a letter in the mail. There is still an ongoing lawsuit Stephen J. Tuttle V. Audiophile Music Direct. Class Action Settlement. LOL. Again, terrible shady company. I worked there for 5 years. The owner purposely keeps the low numbers #001 to #099 for himself to resell at later date on the market at jacked up prices. One of many shady practices.

I will be more than happy to buy their copies as long these are as close to the original re ord as possible and SACD hibrid. I can feel the painstake some "audiophiles" goes through.. but these is only BECAUSE OF LACK of TECHNICAL KNOWLEDGE... in audio systems..

All I care about is record companies able to survive, if they go bankrupt trying to payoff the settlement- not worth it IMO.

Thanks for letting us know! I've got my records and receipts ready to go here. Please keep us informed when the next step in this process is announced. I guess the lawsuit is only under US law, hence why it's N/A elsewhere. Perhaps other class actions will occur in other countries. Don't get me wrong, they are great sounding records, but I was definitely under the impression that I was buying a AAA release, and it's disheartening to see they are not. Whether you enjoy analog recordings for the sound they offer, or, even just for the "craft" of the process that is involved in keeping it all-analog, it is a worthwhile hobby and I am glad to see we will hold companies at least somewhat accountable for dubious marketing.

I notice there is no provision for just sending them their record back and getting a refund. If the deal sounds somehow credible and a judge signs off, the lawyers can get their money which is their major concern.

Thanks for the report. I have a number of MOFI lps. I would be curious to know if there is a list available indicating which had the DSD step, and which didn't. I have no intention of seeking refunds, I would just like to know..

Who in tarnation has receipts for lp purchases made 5 or 10 or 15 years ago. If a receipt is mandatory, and if ony 2% still have their receipts, and if only a fifth of those will prove or go to the trouble of proving they still own the record, we could be talking about only $100,000 here.! If half elect to keep their records and take the 10% discount. Maybe that 10% discount will get Mofi enough added sales that we could be talking $0 here. These payouts will not hurt Mofi too much. Hardly anything has been written on just what happened in the 1980s when they were doing all analog from the master tapes. Would they send them the master tapes by mail, by secret courier, by armored truck. Were there guidelines as to how many times they were allowed to play the master tape? How would they be able to check up on that? Is playing the master tape limited to once or twice now. How many times were they allowed to play it back then? To press out all those copies. Why has that changed, and why aren't they doing things like they used to.

I’m in the UK, and don’t own any of the eligible records anyway 😂 But, at the very end of the day, for me it’s about justice and a legal recognition in full public view that what they did was wrong. Even if you’re eligible, yeah - not great refund options, but it’s more about breaking down the sheer arrogance of that company when they tried to play down this whole controversy. Its not the right place for saying Thanks to You for very good CD-Tip in one of your older Videos: Some days ago I bought online a used and very cheap Copy of the Album by Bugge Wesseltoft called "New Conception of Jazz". First Impression was: Oh shit, very hard kind of free Jazz. But since I listened once more and more I began to love that Music. The used CD sounds great, audiophil I would say. I guess this sends a message in an industry with outrageous margins - give customers something resembling your marketing or risk legal action.

Just to let you know Music Direct and MOFI will be reaching out to its customers who purchased their products . Settlement is not totally finished No not all claims will have to complete by 9/23 cause they by contacting us in Oct of 23 . Feel free to call MOFI . As for recites if you purchased them for MOFI or MD or an authorized dealer they will be able to give you a listing on what you purchased.

5% refund isn’t worth the hassle and I can’t imagine many will be able to find receipts from 2007. Even if you bought all the titles on the list you might get $500 back (maybe worth it?) but for most people with only a handful of the records it seems like too much effort unless you want to return for full refund.

Question about current ownership. How is this to be proven? Will current owners be required to take photos of their records to send along with their receipts? Seems to me a rather difficult expectation to enforce…

Yeah, they should have been truthful about it, but I still get a laugh out of all of the golden-eared audiophiles who were perfectly happy with their full analog records and even bragged about it, until they found out the reality and realized that they aren't as perceptive as they thought. Poor dears.

So is the 1st option (full refund) mean that you have to return your records to mofi? Re option 2 - Doubt the 5% cashback represents the loss in value of the records following the scandal....

It's not a "sentence". That word is only used for punishment in a criminal trial. This was a settlement of a civil lawsuit. Nobody is going to jail.

I have precisely two MoFi records and I've bought them only recently so this is a non-issue for me, but honestly, these are very sensible steps to jump through in order to get compensation, and on top of that I think the lawsuit is a bit of a toddler's response in the first place as pretty much none of MoFi's marketing material stated 'ALL ANALOG" anywhere. 🤷🏼‍♂️

How can you prove you still got the records then that sounds like a get-out clause

When I heard the amount of the settlement, i assumed it affected 40 customers, 40,000 would seem to be more in the trillions with MoFlation factored in.

This is a stupid settlement. this only satisfied collectors who are nothing more than resellers who are like antique dealers. I will always buy MoFi products.

On your vid about lubricating cassettes, can I use any silicone spray? I'm in the usa and I'm having a hard time finding the two you had in the vid over here. I've never done this before so I don't want to ruin the tape with the wrong product

Great video. I have a title that qualifies for a refund and I have the original receipt. I was looking in that pdf, but can't figure out how to submit a claim. Maybe that information hasn't been released yet?

I have no stress with MoFi at all. They stated in 1978 that they had intentions to use digital equipment in their signal chains. Anyway in my mind a DSD transfer is still from The Original Master Tapes. How can they do a DSD transfer without original tapes of that album? I'm not an analog purest in that respect. And lets not forget that the original tapes may be in rough shape and the label can stipulate that MoFi can only use them one time through the process. So a DSD transfer is going to be needed. For me MoFi gate is much adu over nothing special. Addendum: All of the MoFi titles I own all sound good and I have no desire to sell them. I even recomended a few titles because the LPs do sound that good.

To be fair, don’t think Mobile Fidelity was convicted in court. It is a negotiated settlement with plaintiffs. This would put the dark cloud over the company behind them so they can operate company without this legal overhang. Thanks for the info!

I normally buy Records vintage of the year they were first produced. I have one Mo-Fi 45RPM album in the box MIles Davis Kind of Blue. My Canadian 1st pressing was better..so it was a let down.

Usually they implement lots of obstacles that one will give it up. What will you do wit your MoFizzz?

It was a really arrogant tone those engineers used when they said it's a source 250 times more accurate than cd, so it doesn't really matter. They probably feel pretty stupid now, even if they do get to keep most of the money

I find Mofi Gate bullshit. It would have been better if only people can get a refund who (in a blind test) can hear the difference between a master tape and a DSD copy. In every review and every YT video I only heard that people loved the sound. So you buy an audiophile product, you love the sound and only AFTER you hear DSD is used you don't like your product anymore? Proves my point that so called audiophiles or some of them don't enjoy music at all but love splitting hairs and like to complain and whine a lot. If I was the judge in this case I would condemn Mofi to give some money to charity and promise to give customers in the future exact and honest product information. Case closed.

Coming home from the after-hours scene, took several years of me listening to instruments and playing harmonica instead ..sober, strong and glad to have the experience. I am enjoying listening to all those .."that was awesome" mix moments.

I have only two lp’s. From mofi, they sound very good so my only issue is they lied. Moving on, really I have other things to do.🥱
