Mother of man "over-served" alcohol at Kelsey’s restaurant before fatal car crash speaks out

A Kelsey’s restaurant in Hunstville, Ont., will lose its liquor license for 45 days beginning this month, after the Alcohol and Gaming Commission of Ontario claims a patron was over-served alcohol and died in car crash.
As Caryn Lieberman reports, the man’s mother is now speaking out about the dangers of drinking and driving and the role of society in helping to curb the problem.

Sorry but as a facilitator for a workshop on alcohol and impaired driving, we need to understand the facts. The first part of our brain to be affected by alcohol is the judgement part. After as little as 2-3 drinks, our judgement decisions change from what they might be when we are sober. So it becomes up to those around a guy like this to take care of him, and stop him from ordering that many drinks which he certainly should not have been served. And then allow him to leave? Alcohol servers have a responsibility to understand the effects of alcohol including NOT GIVING someone another drink when they ask.

Blaming the service staff for not babysitting an adult is absurd. About ten years ago I got a DUI. You know who I blamed? Myself. It wasn't ANYBODY ELSES fault but my own. If you can't take responsibility for that, you're not responsible enough to have a car in the first place. That's why when you get a DUI they take your car away, not go around shutting down the liquor store you bought the booze from.

Even if he wasn’t over-served, he would still be intoxicated enough to be in a fatal accident. Can’t blame the restaurant for his bad decision.

They would over serve people so badly at the casino I worked at, they would fall off their chairs plastered. But as long as they kept playing the casino made money.

this is why being a bartender is way more work than people realize. It's the bartender's job to keep an eye on how drunk people are, and they are liable if something goes wrong even after they have left.

It was their responsibility to stop serving if they're showing obvious signs of impairment and they should have checked. If you have friends over and you do nothing to stop them from driving home impaired and something happens, legally you are just as responsible for what happened as your friend is. You can disagree with it all you want, but that won't change how the law sees it.

@Rocksteady246 "Under the Liquor Licence Act, it is illegal to serve customers to intoxication, promote prac- tices that may encourage customers to become intoxicated, or serve someone who is showing signs of intoxication. Licensees who do, can have their liquor sales licence suspended or lose their liquor sales licence permanently."

in Canada we have programs like safe-serve and a concept called a 'Duty of Care'. They got him blackout drunk and sent him out the door without ensuring he had a way of getting home. @Rocksteady246

This woman is very reasonable, and I applaud her for making her story known, the details are a good lesson for both drinkers and servers alike. She didn't come out trying to displace blame from her son, just illustrating how the checks and balances put in place by our liquor board were not followed and part of the overall circumstances that led to her being a grieving mother.

Ok everyone, put the pitchforks down. They said, "her middle child, 22 year old..." They aren't trying to say he is still a child. They are just saying that If you're a parent, those are always going to be your children no matter how old they get. Also, not trying to defend this guys heinous actions, but do places not cut off patrons anymore? 18 shots seems a little excessive for one person Anyways, at the end of the day this video is still extremely tone deaf and the message they are trying to get across isn't the right one. "Don't do this so your mother doesn't get this same call one day." How about, "Don't do this so you don't kill any innocent people." Buddy got so lucky he didn't hurt anyone else. If you wanna call him "lucky"

Any patrons drinking alcohol must give their keys to the bartender and get the key once tested for alcohol levels are okay for driving

This why it's important for waitstaff and Anyone involved working on a premises that involves the sale of alcohol to have smart serve. If the waitstaff are coming to the bar to pick up drinks at a large place with a lot of customers, it is not realistic to expect the bartender to keep track of it all. The waitstaff have to be trained to recognize yellow flags (you want to avoid the red ones) know the legal limit, size of customer/time passed/amounts consumed . Sometimes people come into an establishment already intoxicated, the hostess and waitstaff have to be versed in smart serve to know that person must not be served. There's no way for the bartender to know, if that customer sits away from the bar, to see the signs of intoxication. and this is why anyone working where alcohol is sold must have smart serve.
