In this episode of Litigation Whiteboard® Attorney Steve discusses the motion to compel arbitration and potential ways to fight it.
WHAT IS A MOTION TO COMPEL ARBITRATION?
A motion to compel arbitration is a lawsuit filed in order to force the other party to arbitrate their dispute instead of going to court. This is typically done when there is an arbitration clause in the contract between the two parties. The clause will specify that any disputes that arise between the parties must be resolved through arbitration rather than through the court system. If one party attempts to file a lawsuit, the other party can file a motion to compel arbitration in order to force the matter into arbitration. This can save both parties time and money, as arbitration is typically faster and cheaper than going to court.

Hey Steve great videos. I know you cannot give legal advice, so as a friend a friend opinion, if someone is ordered to non-binding arbitration during a civil suit proceeding and the arbitrators require a hefty deposit and bill quite a bit per hour and the pro se party cannot afford to pay it, how do you get out of arbitration when it’s non-binding anyways? I can’t find any case law or anything to reference

Generally speaking (not legal advice), if I was having financial difficulties and representing myself in a case I would let the judge know of the issue and see if there was something that could be worked out. Most judges would be reasonable. Best of luck!! Steve

I have a question I have a complaint in progress and my attorney just contacted me with an update of my case but kind left me scratching my head. I’m the plaintiff who filed the complaint, the other side attorney (defendant) requested a Motion to Compel Arbitration and they have a hearing date. Now my attorney said that they will determine how they will move forward on my case after the hearing what does that mean? Basically can my case be stop and not be able to move forward and what is Motion to compel arbitration? Hope to hear from you sir
