NVL is when you know you can live but decide to choose the decision which would kill you 100%. In this scenario you could even consider it being NVL if he doesn't try and kill K because he knows his getting shot to die so why would he not try and kill K to live.

If you think about it for half a second it would make sense. Everyone knows how CG operates and Hazel knew there was zero chance he gets out without being shot. Might as well try and fight your way out or get K's blood on the scene so cops can pull it up when he tries to give the story.

It's already been explained, I think it was Koil, if the person with the gun makes it clear they're going to kill you, you can run or fight back since that's the only way to value your life at that point.
