The thing about the judge in the film is that it is accurate. You are completely at the whim of the temperament of the judge. If they don't like your lawyer then he gets less favorable calls and judgment. It's kinda nuts.

Just FYI...both disclosure and discovery are distinct and separate things in a legal case...they are related, but definitely not the same. Disclosure covers the things that each side in the case are required to tell the other side, but discovery is the stuff that each side does to find things out on their own. So, in this case, as soon as Vinny initiated discovery by asking Trotter for the Prosecution's files of evidence then Trotter was required to provide those copies of all his files as part of his required disclosures. 😁
@johnnehrich9601
@johnnehrich9601 4 месяца назад
Yes, the concept of discovery is rooted in English common law but in America at least, it was practiced more in the abeyance than in reality for years. The original 70-odd Perry Mason novels (unlike either the tv series or the recent HBO series) were written by practicing lawyer Erle Stanley Gardner 1933-1973, and much of the drama came from the way the one side - mostly the prosecution - could play tricks, like putting witnesses in outlying motels, or not disclosing important information. It was Brady v Maryland in 1963 which really strengthened the concept. But even at the time of this movie, most of the public - including Vinnie - were not aware of this. I remember watching this movie at the time it was released and when it got to the post-deer hunting conversation, was both stunned and also thinking "well, of course, how fair." PS - If you like courtroom drama, I'd recommend you watch and react to Billy Wilder's 1957 Witness For The Prosecution, based on a work by mystery queen Agatha Christie. I defy you to guess the ending.

21:27 All the materials - - witness list and their testimonies, transcripts of depositions, and any other evidentiary findings - - are called "discovery." But providing and sharing the information is called "disclosure." (And, of course they want to make sure you give all the information - - full disclosure." Just thought I would clear that up as an American. I know our legal terminology might differ a little bit.

22:50 another cultural reference for you Brits, or people from other places: Marissa Tome is definitely playing a full stereotype of a New York Italian Princess. With the hair and the nails and the heels, the attitude, the way she talks, and definitely with the clothes she's wearing. Like the leather outfit she had on earlier and this crazy floral bodysuit she is wearing. in the middle of the woods. with heels on. So, it's a stereotype that I think tends to be true enough for people to recognize it. No offense to anyone, of course. I personally love all the different colors and flavors in the American palette that we get from different origins/ethnicities we have here. I love the spice.

According to the internet (and when is it EVER wrong), the bird was an eastern screech owl which can make a whole range of sounds including screeching. All the screeches we hear before we see the owl were added post-production. When Vinny comes out of the cabin, the owl lets out one final screech which was authentic. The crew considered themselves fortunate the owl screeched that one time on cue.
