This is what’s wrong with our society. Why would you leave for them for them to continue breaking the law? Lawyers sue people all the time. Is this wrong? If they break the law sue, Sue again. Let’s see who gets tire.
If the company is still breaking the law, then sadly, another person would have to go through the same thing. Therefore, during your settlement, one important thing that needs to be changed and in force the companies polices, laws (state/federal) and training. I pray that it won’t happen again. But, it will. Also, the company will be “smarter” to make sure that won’t happen again. For my peace of mind, I would leave. Yea, the money can be good. However, my peace is more important.

Hi Vince!! Sixty days passed after I submitted my claim in federal court. My employer finally responded, and they asked my attorney how much I wanted to drop the suit. I'm still working for them, but they make me wait 12 months, dealing with retaliation harassment, making my health condition a lot worse; what is the cup in this type of scenario for me to have an idea? I don't trust my attorney, but I had no choice. It was too late and difficult to find a new attorney. Please help me get an idea of how much I should ask. Thank you
How often are Demurrers granted without leave to amend? This is against a government entity by the way. My lawyer said that they are willing to settle, but why has my attorney not ask for a settlement if they are willing to settle?
My request for accommodation was recommended for denial by my supervisor for “refusal to accept effective alternative accommodations”. The alternative they offered me isn’t effective and my provider wrote a statement listing out concerns that go unaddressed by the alternative accommodation I was offered. I guess my question here is, who decides if an alternative accommodation is effective or not?
Wait a minute Vince, so you're telling us that if part of a settlement that you negotiate for your clients includes a provision to stay with or go back to same employer that you'll keep them as a client in the event the employer does something wrong again. and that your limit is about 8 times? Personally I'd think that after the third time the client employee as well as your firm really would be best off taking the employer all the way to court for a big pay off.
