Plaintiff's objection to Uniform Child Support Order Modification

my objection to the modified order for child support
directly reflects our incomes

My ex didn’t support my child. She had two e tea curricula activities, of of which was free by the school (soccer) and the other (swimming) taught by childhood friend - no charge on both. She wanted to play the piano but I couldn’t afford it because I would have to pay for that and transportation to and from; she understood.

You would think but the courts do make the parents pick a permanent custodian. My son and his wife did that and he was sole custodian and she had to pay 50. A month. But he never took it.

Exactly. That must be the starting point. 50/50 shared custody and zero support. Divorce is a separation of income so this equalization stuff must end. You get a raise she gets a raise -- hell no.

​@@krissy0894the problem is the courts allow the mother to either have a court appointed attorney or push her lawyer fees onto the father while the father has to foot his own bill. The courts are HEAVILY in the mothers favor every step of the way while the father is expect to simply figure it out.

It's not the dad's responsibility to pay her rent, utilities, food, health care or transportation. His responsibility is to HELP pay for the child's school, clothing, medical, after school activities. And his inheritance is not up for her to dip into, regardless of how he spends it,or how he receives it.

Actually, my brother and I grew up in a divorced household and my mother had full custody. She did have to use some of the child support to help cover some of the utilities and food.

@@melstarr1864 so.. she used it correctly? lol legally fyi, child support once it hits the recipients bank, can be spent on anything, even mummies new shoes, so long as the children have base needs met, your mother could have taken HER child support payments to the casino, and thats legally fine, so long as the kids have a roof, lights, water, food, medical and attend school.

@whitejodeci8926 no. She used it for herself. She couldn't afford to pay childcare for her to work AND party, and decided his inheritance should also be hers. He was using his inheritance to pay his bills and pay for his kids and paid child support from his job. She wanted child support to be based on his inheritance, which it can't be.

Actually c.s. is intended to allow the children to have the same level of lifestyle as if the parents never split. Both are responsible for the children. But child support is used for anything for the benefit of the children i.e. transport, shelter, food, gas, sports, clothing, clubs, and any other needs/lifestyle of the children. Medical/Dental/eye is a separate issue and the parents can choose to split the bills equally, pay per portions, or one be solely responsible.

Yeah much better than average. He fell prey to it a little at the end but I can imagine it's difficult to hold your tongue when somebody is talking about you (especially if you disagree). I think this could go either way, it sounds like mom got cut a lot of slack while dad got slapped hard and neither of them understand why. I was pleasantly surprised to see so many people agreeing that its crossing a line to demand a cut of his inheritance, if not legally then at least morally!

Actually, she is getting SNAP by. TANF is money that can be used for rent, utilities, clothing, etc. SNAP was formerly known as food stamps.

@MDBredBeauty Yes you can. We already have averages, EXTRAcurriculars are just that, EXTRA. A man shouldn't have his kids taken away from him along with 25% of his income. If you receive child support, you can claim it as income for loans, apartments, houses, TAX FREE, along with government assistance. If you pay child support it is DEDUCTED as qualified income so now you qualify for less places to live, loans, and you DO NOT qualify for any government assistance.

She said something that caught my attention. She said that she wants to give her daughter everything she needs. Parents sometimes confuse giving the child everything they need with giving them everything they want. If you're struggling financially, you dont need to put the child in multiple expensive extra-curricular activities. Maybe put them in one activity or let them find things at school that they can get involved in that dont cost a lot of money.

You have to love the bias shown by calculating the mothers hourly wage down at 35hrs a week and keeping the father who works in the exact same industry unchanged and at 40hrs a week as if his income is not permitted fluctuations like hers is. Then list his inheritance money as a family gift so they can include that too. I certainly hope the judge sees through the BS and fixes the suppoet order.

Judges salary is paid for by child support pool... He has an incentive to issue high child support orders. His paycheck depends on it. He's probably not even a real judge he's a magistrate.

I know a guy who has full custody of the kid and still pays $1,000 a month child support because she claims she isn’t working. She got a job as a stripper after they split and he showed the judge a video of her stripping and picking up all that money as proof she is working and the judge just threatened him with stalking charges and kept the child support the same.

I knew of a situation where the mother and father shared 50%/50% custody, YET the noncustodial parent was STILL required to pay the custodial parent the minimum monthly child support DESPITE the custodial parent making more money than the noncustodial parent!

The judge asked her if there's ever a time she works more than 35 hours. She said yes during the busy season. That busy season lasts 8 months out of the year. So she is working more than 35 hours for at least 8 months out of the year. And the friend of the court had the audacity to put her at MINIMUM WAGE, which is half of what she makes.

Sorry but one thing I do not agree with is that just because my ex gets remarried I should have to agree to allow the new spouse to suddenly become the babysitter and raise my kids while I am at work. That being said I also do not expect my ex to cover child care cost during my parenting time. I will figure that out and what they choose to do on their time is up to them.

Inherited property is the sole property of the recipient! The wife should NEVER receive gain from it! Not even the children are entitled to it until the PARENT is gone! @@joey3947 agreed. When I divorced I set up tax free savings accounts for each of my children, I the liquidated my funds and divided them equally among them. I then showed in my will this was their inheritance, I maintain control of each account until my children turn 25, making it a 2 signature system…my x then tried to sue me for the money, the judge actually laughed and told her she will have to sue not just me but each child as well..she also told her it is legal AND because 1/2 the money was ours because the divorce was recent, not a judge would overturn my decision…the only downside is if I touch that money even with the child before they are of age(25) she can take it all… It will however cost her our children, they live with her and disagree with her lifestyle…they see EVERYTHING… Yes I was broke for a few years, I am doing well again now…I will never marry or even cohabitate again..learn from my mistakes.

I was a single mother, no child support, no alimony, no child care. I worked in food service, had my own place, car, took care of my child. I never asked for anyone to help me. If I needed more I cut expenses, worked more or got another job. It’s not that hard. It was worth it, in the long run, as I taught my son to be responsible. I refused to live off my ex husband. Or even ask him for money.

Mom is bitter because he got somewhat of a windfall after they separated. As far as extra curricular activities are concerned those are not the reponsibilty of the parent that doesn't have prime custody to pay for. They can willingly help but it isn't a requirement to.

Actually under most states blanket rules they do if the costs go over a certain $$ amount. I could have gone after it numerous times but I landed on my feet post divorce and he did not, he paid his ordered amount and was a good dad with visits and time spent, did all the dad things I asked of him. Was he great to deal with, no, but we made it work so neither of us had a burden we couldn’t bear.

So many people are ordered to pay child support and they don’t pay a dime!! They hide, jump state to state, work under the table Ect. Take it from someone who is owed almost 200k in child support. I never took my Sons father to court for child support he took me to court for a DNA test swearing I cheated because he thought he was sterilize, long story short he’s NOT!!! I never ONCE!!! She did say the child was going ro start the next weekend. Also the dance costumes can get expensive and if he is purchasing them he could easily spend more than she pays for her to take the lessons. But yeah she said she was just starting so almost sounds to me like mom decided hey as added bonus lets add money for activities. Dance and tae Kwon do on same day. Thats over exerting the poor child and why i say she did it purposefully.

Exactly... Income must be irrelevant after divorce. That is the purpose of divorce. The courts use the legal system to equalize income (no!) or penalize men for profit via Title IV D reimbursement at .666 cents for every dollar extracted per month from men.

It's his inheritance, not income. It's protected in a trust. How he uses his monthly check is his business. Dance classes aren't a necessity. So stop signing her up for activities that she can't pay. She should speak to ex about these activities to decide if child can do these and he helps payment. He paid for her dance outfit.

As a person who always paid her own way, always worked a full-time job, paid taxes, etc., the fact that this mother is getting housing assistance, food stamps, probably free health care for the daughter, while working less than fulltime and turning down promotions and fulltime work is infuriating. I (as a taxpayer) pay for her housing and the food in her mouth while she sends her daughter off to dance class and tae kwon do.

It is the father’s failure to pay enough child support including after school activities that is the shame here. He doesn’t need to live in section 8 housing. He doesn’t have to borrow a car. And children whose far wealthier fathers don’t make sure their child is properly supported don’t deserve any classes that serve to socialize and enrich their lives bc mom is doing the best she can with what she does? Bad misconception of what child support is, is that one person pays more to support a kid just because they make more. The idea is it’s an equal 50% to each parent so if one parent can provide more for a child it will be cost offset for the time the child is with the other parent. Here it seems the time is fairly equal. Child support is not a supplemental for one parent not making an equal income. It is time, money, and care cost for the duration the child is with that parent. Very simple but sadly there are a lot of rules that can be twisted to cause one parent to endure that majority cost.

In my state, by law, child support is related to total family income. Both the amount of overnights and each parents income and expenses are used in the calculation. If parents share custody 50/50 but one parent makes more that parent will pay more. This helps equalize the child's standard of living and lessens the likelyhood that household income will factor into a child's preference for residing with one parent over the other.

Child support should be fixed per state, then applied 50/50. Example, It should not be more than 400 per month with each parent paying 200. Fathers should get primary custody since research shows better outcomes for children in father only homes vs mother only homes. As for paternity fraud women should be jailed and the children sent to grandparents, other relatives or given up for adoption.

In our state it’s to make both homes as equal as possible. So if a mom has supported a dad through medical school and been there for him, if they divorce and he has all this money and a nice house and the mom is barely making ends meet.. the kids goes from one extreme to the next and it should be a balanced home life for the kids at both homes…

@irishwv3 I'm sure it's different in every state and I'm not a lawyer but looking at how child support is calculated, it's income and percentages, not personal expenses. If the guy in this case is paying the court ordered support, he doesn't have to itemize and justify his spending just like the woman didn't have to itemize and explain what the child support given was spent on. This is a money grab. He doesn't have to pay rent or a mortgage so she wants him to pay more. He isn't making any more money. If his daughter has extra expenses, he should step up as the dad but the mom doesn't have a claim on money he didn't have to spend.

You still have to pay for your house, even after it's paid off... Taxes and Insurance make up the majority of most mortgage payments. In a lot of places you'll still be paying well over $1,400/month for a $300,000 house even when you own it outright. Government just has to get their money. Lol

Not sure where they live but insurance is optional if you don’t have a mortgage, and is usually cheap. I have a $650k house and pay $1,100. A year n insurance. Property taxes are another thing entirely and again based on the state can be really high.

She IS NOT intitled to his inheritance. Even the government doesn't tax inheritances. It is NOT considered income either. So she is concerned about money. His money.

Six states collect taxes on inheritance. It is sometimes called an Estate Tax. It is applied to assets such as a home or money inherited and vary as to the size of inheritance and relationship to the deceased. (Not sure why that matters) Usually due within a few months after receiving inheritance.

Don’t worry, there are plenty of men who collect child support and/or alimony from women. It’s not uncommon at all. For every one of these men being forced to pay more support than they believe is fair, there are 3 more that will never pay a dime for their children.

She's also jealous that he doesn't have to pay for rent/mortgage or car bills so she wants him to pay more in child support? If she changes things outside of the order then she needs to change the order. The end. She can't complain about things she's use to. Everyone needs to take responsibility for actions and not the actions of others.

Why assume bad faith, unless you're transferring some personal greivance to their situation? A lot of these types of calculations _are_ based upon hypothetical earnings and whatnot; without a Family Law atty to work it out, you get what you get with the courts unfortunately.

@@VictheChick That is literally not how it works in court. Both parents submit their taxes and other financials to the court. There is no voodoo as to who makes what magic. After the judge decides what percentage each parent has with the child, who is main parent and what their financials are; the judge then renders a percentage as to what the secondary parent can afford in childcare. If there is any deviation that needs to happen, it has to go through the court so that it is properly followed. Also, if parents have a change income, they go back to court to change the childcare payments. Also, I didn't assume bad faith. I listened to her and she said because he doesn't pay for rent or car and she does, he should pay more

And no, I'm not suggesting some sort of child support voodoo exists. (Lol, I like that phrase though!) Just that complications can arise when calculating this stuff, when adding in certain hypotheticals or inheritances, pensions, etc. -- and some states are more straightforward than others. But either way, both parents seem reasonable enough here, so why villify anyone?

Here’s an idea if you really cared about your kid you would have more than one job if you’re not even working full time. Extremely lazy and a drain on the system and she also says she’s working towards a management position then says she’s unable to take management positions when offered those thing’s directly contradict each other

Sounds like Dad got a $300,000. headache as his inheritance. Mom makes no mention of Dad now having to pay property taxes and fees , insurance on the house, or maintenance and repair costs on said house. Also, I'm sure someone could get daughter to Dad's place easily for care.

@@californiadreamer2580I seriously I can’t imagine. I live in Texas and complain about property tax. We don’t have income tax and I heard it is pretty high in California. I think if our house was paid off we would be paying about 900 a month in tax and insurance. So def not a “free” place. Luckily it won’t be paid off for another 25 years. 😂 really looking forward to that.

@@Starnote16 to add insult to injury due to the various disasters (most of which could have been prevented with proper oversight by the people already paid by taxpayers to do it) here in California, insurance companies are cancelling/ non- renewing homeowner policies up and down the state, and have been for over a year now. Guessing you can imagine what that means.

A friend of mine is a doctor who worked insane hours in a trauma center. He also had a private practice. He made the decision to back way down on his career because he wanted less stress. He was capable of more than doubling his income, but he chose to make less so he could enjoy his life. I know of no law that dictates the type of job or minimum income you must earn.

If you have a child to care for, then you have a responsibility to go out earn as much as you can to care for that child. Choosing to reduce your hours to reduce stress at the cost of your ability to feed & cloth your child, is the fault of the parent that choose to reduce their work hours or pay.

I highly doubt the kids are missing meals have holes in the soles of their shoes and a threadbare potato sack as a winter coat. if you have a child your responsibility is to adequately feed and clothe your child. and to actually be present in their life to provide oversight and guidance as they grow. Working so many hours that home is basically a crashpad and subjecting oneself to high perpetual stress (which tends to follow you home even after you clock out - in more ways than one) when your income is sufficient and you don't have to is an irresponsible parent.

@@aarone.5179 Yes, but your comment is on video ware the mother has chosen to work fewer hours, and turned down promotions that came with pay raises. Even though the father offered free child care if she need to work more hours. Yet the mother is complaining she can't afford some of the basics to take care of her child. The only impediment to her being able to provide is her personal choice to not work full time on a regular basis, or accept the promotions & offer of free child care. Which means failing in the very first responsibility to provide for the child. Even if this means working more hours to do so. When you choose to have a child you willing take on such responsibility.

I worked insane hours and it almost killed me. Turns out that I had a heart defect. Now I can barely work. You definitely can't be there for your kids if you are dead. My uncle has been a doctor for 42 yrs and he works INSANE hours. Even when he jas time off, he gets called in all of the time. I don't see how he does it. At my last job, a 55 hr work week was a slow one, and I was on call 24 hrs two weeks out of the month. I still don't see how some of those doctors stay sane. My GP only works 1pm-5pm, 5 days a week. I could handle that. Lol

There is no way that she is staying at a job for more than 4 years or she only earned $1,700 a month. Also, she is saying she can't get into management because she has to be available from 11:00 to 7:00 and she doesn't want to do that to her daughter, but she's staying there for future management positions? She says she works at a resort so I'm assuming she makes tips of some sort which would greatly supplement her income without her having to claim them as income if they are mostly cash. That means that she probably makes a decent living, is trying to get more child support from Dad, and is receiving Medicaid, food stamps, and possibly rental assistance from the government. Mom's story just doesn't add upright.
