A Mum argues that her partially sighted teenage son could not have committed the murder he was jailed for.
Garry Newlove’s murder stormed the headlines back in 2007. He was attacked by a group of teenagers outside his home after confronting them for vandalising his van.
Jordan Cunliffe was 15 at the time of the attack, and was jailed for life under the controversial Joint Enterprise law alongside two other teenagers.
Jordan was due to receive transplant surgery to treat Keratoconus, an eye condition that rendered him partially blind, just three weeks after the attack took place. Jordan’s mother, Jan, argues that Jordan could not have been complicit in the attack if he could not see it happen.
Guilty Bystander explores the dramatic stories of people convicted under joint enterprise law. They are in prison for a murder they were not present for, or even knew was going to happen.

He wasn't that blind that he could wander around, in the dark with his mates getting drunk and causing trouble and vandalising people's property. He may have an issue with his sight but that does not make him innocent. Mr Newlove's wife and 3 daughters witnessed the attack and saw the damage all 3 (+)of them did. If he can't even take responsibility at this point, bearing in mind this took place 15 years ago, and his mother is still patting him on the head and telling him it's not his fault, then there isn't much hope. A fully grown man is dead because this boy and his mates decided to get drunk, start vandalising people's property and when confronted, decided that grotesque violence was the right response. Then they ran away leavng a man dying in front of his own house. Whether he landed any kind of kick or not, if that was me, I would still feel responsible and would find it difficult to live with the consequences - that I hadn't helped/intervened. Rather, this boy/man, and his mum decide to try and avoid any responsibility for the catastrophic results of their actions and to add insult to injury, use a disability to try and water down his responsibility. I rememver the case, and remember that they were all laughing in court. If he wasn't responsible and was scared to intervene, why the shallow approach in court, and denial of responsibility to this day? Why no remorse? I don't even have to watch to know what his mother will say. If that had been me, my mum would have been embarrassed and mortified that I was involved in such an incident, in any way. Never mind absolutely beyond angry. Yet this boy (now man)'s mother is still telling him it's not his fault. No wonder he ended up the way he did if that was/is her approach to parenting.

If you don't have Keratoconus you wouldn't understand!!! Ive had it since I was a teenager!! .....Ive had 3 cornea Transplants but am now registered blind!! ......I can walk around in the dark!

A blind lad was out at night so how could he see? I don't think the mum has any compassion for the victim. Her son was there and clearly isn't deaf either. Minimising her sons involvement is ridiculous. The victims family saw what happened didn't they? Also why was her 15 year old drinking on the street? That isn't something every teenager does and reflects her parenting style.

Technically most legally blind people can see to some degree. But if he had enough vision that he could navigate dark streets while drinking without any aid, then he definitely must've had enough vision to see some amount of the attack. He also could hear it. It wouldn't have taken much visually (if anything) to figure out what was going on. Generally someone screaming and shouting in pain right in front of you is pretty obvious.

Why would he even be out at night with a group of obviously belligerent youths although often groups do have a member who is physically or intellectually disabled. They use them and abuse them. Joint enterprise needs to be used very carefully.

Why would someone who was trying to keep her relative alive , come up to a complete stranger, allegedly distanced from the victim, fling their arms around them, and ask for information? It makes no sense. Also I agree that the accused may have eight impairments but he is not deaf, it must have been a long wee if he heard nothing of the altercation. I think he probably had some involvement.

As a visually impaired person myself (40% vision in one eye) the fact that his mum is using a disability to say that her son is innocent is sickening. Also, not every visually impaired person has a guide dog or uses a white cane.

My 2 step sons 12 years ago hits a pedophile both attacked him in a tescos they never killed him but charged with wounding with intent due to the peado having a bleed on the brain. They both did there sentences without tags still on licence didn't appeal and my wife never was in denial on there offences she stood by both . In fact the oldest of the boys has adhd is back in jail for not staying in a hostel with pedophiles ..

I remember this horror in 2007. It was heartbreaking for the Newlove family. It was a MASSIVE case in England at the time. He'll be out of jail now. But I agree with the jailing of gangs.

Yes and if you remember it as well as you claim to, you’ll recall how politically motivated it was and no doubt be very worried how still is! No one truly believes in bad law especially when it’s delivered to a severely disabled child. Or do you? And as the KC says now parasitic Accessorial Liability has been abolished he should be first in line to have his case reviewed in the very least. If you listen she says her son Jordan cried out like a injured animal and the prosecutor then looked at her and the jury as to say I wasn't expecting him (Jordan) to do that (cry like a wounded animal). If he's such a sweet innocent boy with a disability then why didn't he try and stop the beating? He could of saved that man's life but it was dark he couldn't see because he's blind. I'm really sorry I don't believe this for a second it doesn't matter who done they where vandalising people's property, getting drunk and for fun beating a family man to a pulp and it must of been some beating if he died!! We need way more information on this because a post mortem would of taken place etc. Maybe I've been watching too many true crime programmes but I hope this is a full programme because they're so much information missing.

What happened, his caters set him off to one side while the rest killed Gary Newlove and he didn’t hear or see anything? Course not. These teenagers attacked check this out "two disabled" kids(how ironic ) at a bus stop, and another group of two lads ,they were on a rampage that night, it's all on Google,they had previously been sitting on Mr newloves car ,and swearing at him ,and other residents had there properly damaged in the street,his three daughters told the court what happend,this documentary is an embarrassment,also he was sat laughing in dock and mocking proceedings,and then cried when sentenced,had blood found on his jacket,and was denied parole for drinking and gang activity in prison.hes so blind he went to a normal prison,the chips were borght after the group kicked Mr newlove to death,he was seen as one of nine attackers by eyewitness,sorry love the scummy lil sh*t is bang to rights ,and if he's blind it's called karma.

He was laughing and joking in court. She maybe would get more sympathy had she known where her blind son was at night time. Allowing him to hang around with someone who had just been let out on bail for an attack is hardly responsible parenting. Eyewitness accounts saw him there, he had blood from the daughter on him. If he was so disabled why was he left on his own for long periods of time?

I have Keratoconus & have since I was a Teenager...I have had 3 cornea Transplants (all rejected) I amniw registered blind.....But I can't Agree with this Mother!! Her Son Would have seen this happen....I had/have it So bad but I can see Movement and Some colour!! I would definitely see a man being kicked to death!!! Not like a fully sighted person would see it, but i would know what was going on..... His Mother is Wrong In what she's says!!

What everyone on this video is failing to mention is that this gang terrorised the Newloves neighbourhood endlessly. They then, with no care for the consequences kicked and stomped on an innocent man, to the point where he had bruises of shoe prints on his body. This was a sickening attack and even if Jordan didn’t participate, he would have heard the commotion. He is as guilty as all the others. Rip Gary.

He died due to a single injury to the neck. There was no shoe print to the head. Check the pathology report it will show a very different picture to the Daily Mail lies and myths you appear to have bought into. I’ll email it to you if you’re truly interested in truth and justice. As a parent of a deaf child, always keep tabs on we’re they are and who they are with. If I don’t like the group I will tell my son/daughter so. The mother can protest the child’s innocence all she wants, but was she actually there? Was she the child’s eyes? Like I’m my sons ears? No I’m not. Jordan will only know truth about what happened that night and the mother wasn’t even sympathetic towards the gentleman who was murdered.

They all used to live near me in Warrington, they were all wrongens and all deserved there sentences it was only a matter of time before something bad was going to happen around that area, how can he be blind yet be out at night come on some ones dad and husband died, all deserved longer than what they got doesn't matter about there ages.

"Kids eyesight is so bad he didn't see or hear anything" I didn't know eyes made u hear I would stand by this law like the guy said if it wasn't the case people would just get away with murder left right and centre. If the two said noone else was involved it was just us then that would be different and I'm sure if it was just the two they wouldn't bring an innocent blind kid down with them I'm sure there would have been mention the blind kid wasn't involved but there wasn't noone would bring their pal down if he was innocent.

If he could see well enough to be allowed out independently without any assistance required he sure as hell would have seen enough to be able to be involved. No one believes this kid stood there dumb as a door nail knowing nothing doing nothing and completely helpless. She would have done better to claim he was bullied and threatened into taking part because they picked on him for his blindness. At least then she may have fooled a couple of people. I cant decide if she knows the truth and is making excuses, or if she genuinely believes everything her kid has told her because she believes hes an angel. Most reasonable parents would say 'he made a stupid choice spending time with older boys, drinking, and being influenced by the wrong people which put him somewhere he shouldn't have been', but instead she makes it seem like everything that happened is 100% normal and a day to day activity for all 15 year olds. Honestly locked up is exactly where he should be. One day he'd end up as an abuser with the excuse 'boys will be boys'.

Google shows everything, her son was laughing and joking, with his killer friends in the dock from beginning to end, apparently,this documentary doesn't say that.and says he cried like a baby when sentenced.hevwas also denied parole for his conduct in prison,gang activity and alcohol consumption ,he wouldn't have gone to a prison if blind in first place ,surly!

If I had a partially blind 15 year old I wouldnt a call from the Police at 1:30am be the first I know where they are, if he can hang with mates at the park, get himself some chips and wander the street with other thugs all unaided his eyesight cant be all that bad. If there was just a hint of parenting then he would of not been there to get nicked.

Regardless of the disability, rehabilitation or treatment is in most cases way more useful than letting potentially violent prisoners out of jail aged 30 something who have been psychologically damaged even further by the institution. What does it serve society or anyone if we condemn everyone who commits a crime, or is at the scene of a crime like this. It is horrific what happened to that man, it is tragic and it cannot be taken backever, still I don't believe that making it worse does the family or the victims memory and justice. Should someone be held in full responsibility for something their friends did? Research on the bystander effect shows this, many people have been known to not intervene to help vulnerable people who were murdered across the street from them by people they knew it's a well supported phenomenon that describes how around 60% of people witnessing a crime in a group dont help. So 60% of you guys judging are included in that. It is also possible and more more than likely for some individuals that they may freeze when part of a group that is witnessing a crime or standing by. Anxiety levels and adrenaline responses of fight or flight may also cause a person to freeze; a secondary trauma response or survival mode to witnessing the violence or traumatic event, a shut down. Research has also shown that children who witness parents or adults that attack siblings but don't target them, can be equally psychologically traumatised by the experience. Wherever the responsibility luys, surely it is better to rehabilitate than to condemn people (especially children), to an even longer life of crime, like it or not that's what the legal system does. That's what the prison environment does in most cases exacerbating violent tendencies and antisocial behaviour and then they let them out to do it all over again. The only good that can come from this is rehabilitation for those who can be helped. Otherwise folks, you're paying taxes to make the situation potentially worse because the likelihood they'll get a job on release after cases like this is minimal and so turning to crime again is the easiest option all whilst you're paying their benefits. (Just something to think about).

But the point is he was not a bystander. He may have been fully involved and may have dealt the killer blow. The prison system may not be the best place for an offender's rehabilitation but we imprison people for public safety. I would say early release of someone who kicked someone to death is an insult to the family of the victim

@Liza Im6still in favour of rehabilitation rather town life sentances for young offenders, I'm sorry if that hiryd anyone's feelings but economically and socially it works put better if there is a chance that person won't offend again woth the right help. I day this from someone who has been a victim in the past of sexual physically and mental abuse, personally I'd rather see the person who hurt me learn and become someone better however I don't know how I'd feel for a long time after if my child died or husband, still the law is there to be a bon bias intervention when we cannot act ourselves because we are in so much pain. So ultimately I would hope that a person could be given a second chance.

My partner himself has been found guilty of murder because of joint enterprise even though the prosecution has agreed he didn't inflict any of these injuries. Before this happened I was like alot of people niave that there are so many people in prison doing sentences of life simply by being associated with someone who did do the crime. All my boyfriend did was get out of the car at the wrong time and that's him in prison for life. Someone who didn't get out of the car was found innocent, simple as that. Whilst every case is slightly different its really sad to see that people think leaving negative comments, if YOUR family member was in this situation would you appreciate it? No1 should die at the hands of anyone else, however no1 should be held accountable for someone else's decision.
