It’s a dilemma from the consumer side of things, because you take a risk of spending good money to have equally crap quality representation. At least with the PD hey you’re not out thousands of dollars. Ultimately, there’s no substitute to using your own brain to evaluate how your attorney is doing. But even then you still need to know what to look for and that’s where these videos are great!

look at how many men spend 20 yrs in prison and some attorney starts going through evidence oh the prosecutor never introduced those witnesses there is a video of a man in chicago behind bars where they litterly hid evidence on so many files in the basement of the dept the attorney looked at the old wooden filing cabinet one went back to the early 40s. When looking for evidence they tried hiding the cabinet after 20 yrs 1 spot now moved it to a basement. Franks violations...

The point was the public defender has 90 to 200 defendants on there case load! And if they can get someone off there case load quick they will! They will come to you early in the Ballgame and say hey there's plea on the table! 5-10 year cap! Alot of times this is a test to see if their defendant wants to fight the case Or is looking to plea negotiate! If you find yourself in this position! Tell the "public defender" that you want him or her! To sit down and go over your "Discovery" with you before talking about any plea!

My rule is I do not plea deal no matter what, I always go to trial, 3 Jury trials so far and all Not Guiltys across the board. DA and Prosecutor always stunned. 😱 😨 of coarse I was innocent in all 3 trials. I am a law abiding citizen~

From now until I die, if I ever have to face serious legal trouble, I will never again take a plea. I had a court appointed attorney/public defender very strongly urge me to take a plea deal a month before my jury trial date. It was the 3rd offer, and it had started with 2 felony convictions, 5 years probation, no prison time. Next offer was to take 2 convictions, and 8 years probation, no prison time. The DA went HIGHER on the punishment because I had immediately refused the first one, and because he had only offered the original plea because he "was in a good mood". I told that lawyer that I guess we'd be going to trial, and I was planning on dismissing him as counsel to buy more time. One month before the jury trial, we went in one more time to hear a plea offer. Lawyer tells me that they can't find my evidence. Nobody can find it. The sheriff's department had lost the evidence sometime in the 2+ years since the arrest, while I had been out of jail but couldn't live my life fully with the knowledge of an inevitable court case. DA offered to dismiss 1 felony, give me a few years deferred on the second, no conviction if I successfully complete probation. OR I could ride it out one more month and go to jury trial. IF the evidence hadn't "shown up" by then, it would be no-billed, dismissed, I would walk scot free. BUT if the evidence somehow DID "show up", I would be subject to the maximum sentence, and if found guilty by the jury I would be facing two 20 year sentences. He scared me into taking the plea, when there was no evidence to convict me with. They make it fast, so you don't get time to think or consult anyone else. It's all in your face, now or never, hurry up and decide. Meanwhile, in the hallway, you're watching prisoners being marched up and down the halls in chains for their court appearances, 2 deputies holding their elbows so they don't trip over the ankle chains. Yeah, they rush those plea bargains in so fast while they tell you what the worst possible outcome is if you don't accept, and they keep your head spinning. They've got an inside man on my team, wearing an expensive suit and pretending he's working tirelessly but my case "doesn't look promising", head slowly shaking back and forth while he looks at me like he's asking what I choose for a last meal.

That is what public defenders are for. They work for the courts, not for the public. They have no interest in getting charges dropped or doing any due diligence. You are not paying them enough to care.
@thelawofficesofrogerp.fole7886
That’s a broad statement. I disagree. It’s up to each individual. Lots of private attorneys plea everything and fail to research the case and prepare it properly. You can’t lump a group together.

I recently got a public defender in Indiana. Never returned my phone calls and when I finally showed up at his office on my own to discuss my case, he literally told me I would have to give the prosecutor 'something'. Mind you, he had 0 evidence in front of him at all. How is this even ethical?
@thelawofficesofrogerp.fole7886
@thelawofficesofrogerp.fole7886 2 года назад
Well not sure it’s ethical issue or lazy issue. Hire an attorney. You often get what you pay for.

@@thelawofficesofrogerp.fole7886 unfortunately I don't have the money to hire a attorney which is why I have a public pretender. And I agree, definitely get what you pay for, but at the same time don't attorneys decide if they want to be a public defender? That is why many times people say money can buy your 'freedom' so to speak. Also why I think it would be unethical because that sends a strong message that just because you don't have money you belong in jail etc....

I gave $10,000 to an attorney that I hoped would get false charges dismissed or plea bargained to nothing but was forced to plead guilty for leniency. Was honestly framed for being a character witness. As a community minded businessman, didn't deserve this but because of the lawyers ego he didn't communicate or understand or put truth in perspective for the judge. He went by cop report (lieutenant) which had high personal incentive to frame someone to advance himself for his political agenda.

I am not in your state however I have a few questions regarding my rights, in criminal case also on law enforcement protocol, and an asst. public defender situation that occurred yesterday at our first time ever meeting which was 4 min before our first court appearance. I just stumbled acrossed your page on here searching my state & county laws. I have been reviewing my case and decided to search any info on the public defenders and searched my court appointed public defender finding out she is an asst. Public defender I decided to ask her a few questions to see if she thought she would be able to defend me fairly. She answered them however she seemed irritated and then one part of my case defense is crucial i believe she went in court room when we were done and asked the prosecutor about parts of it which idk but may have been my way to get the charge dismissed based on the witness evidence reports etc. I am in desperate need of perosnal advice all the local attorneys are all in cohoots with one an other and the judges. I have had my parents family lawyer and others tell people to not use our local private attorneys in any case where some of the evidence has them involved to go to bigger city around us and hire. I need someone like you here even to educate. I may represent my self which that would be a lose lose so I am panicked and dont know what to do. Thanks in advance

But the other one claimed I threat the person but doesn’t know what i actually said to him that was threatening. Do I take this to trail ? I told my lawyer I am not taking the plea because I never t made threats.
