More power to you, brother. Service connection is service connection whether it happened 5 months or 60 years ago. I was in from ‘79 to ‘92, applied in late 2019, got 80% right off the bat, increased to 90% for the secondary of depression (could barely get out of bed some days and thinking about…well, you know). With the crazy VA math I am technically at 94%, one % point away from being rounded up to 100%. I got fired for the first time in my life this year- memory issues and problems with stress adaptability and anger. I am unsure if I should even try for another job in my field I have been in for 40 years. I am going for 100 this month. I wish you a good VSO as I have- Ex-Marine, or someone knowledgeable to guide you through. This is not the time to ‘buck up’, it is time to tell the truth and stop covering things up or minimizing them.

Thank you. This bridged a gap over an otherwise gaping hole in my process of trying to get benefits for 30 years now. My C&P examiner stood behind his profession 100%, but never once, made me feel as if I were falling into yet another dark place thats so common in my day to day. He too was a bridge for me. It's good to know that just watching your video shows that you, Alfred, and Alison, keep the human element of understanding. That's comfort that helps ease the complications, and sometimes, embarrassing talks, someone like me feels, and has to go through, and having to explain, when otherwise, an uncomfortable conversation to share with strangers. Your videos are very helpful.

I had a private doctor DBQ and refused to go to VA Back C&P exam. I instructed the VA to rate me based on what I submitted. They did and I went from 20% to 70%. 38 CFR is clear, for new claims they must rate you, even without their C&P.
@showmeyourdaleel6568

That doesn’t work for PTSD. A VA doctor or va paid doctor must diagnose it. You can submit a private opinion, but for PTSD the VA wants you to use their expert.

Actually, any pre-existing condition, especially personality disorders, could be proven to be made worse by service (reinforcement of negative actions), and are therefor, very appropriately (any condition aggravated by service), service connected. Discounting all such disorders, as non-service connected point blank as this Psychologist did, shows a lot of bias.

@buzzsawyer2289 Год назад
@@MrOmar0021 Yes I understand your reply but I think my question was unclear. So let's say you have three symptoms chronic sleep disorder, depressed mood, anxiety and one other that falls into the 30%, but then you have three symptoms and a 50% similar to the previous and three symptoms in the 70%. Do they give you 30% because more of your symptoms fall in that range? From my experience I just got rated 100% PNT The majority of the symptoms did fall into the 30% but they went with the more severe symptoms. That's my update. The reason I asked the question is because in doing research I noticed that there was a site that said it would be 30% cuz more symptoms fall into that range. I sent it a statement of support a claim to rebute this in advance. I don't know if it help but they did rate me at 70% which is what I wanted!
@MrOmar0021
@MrOmar0021 Год назад
@@buzzsawyer2289 🔥❣️🔥❣️ Yes regardless of you having 30% 3-4 symptoms and the amount on the others, by VA Law and 38CFR they have to rate you in regards to the worst symptoms of each disability. Which seems it’s what happened in your case and is correct ! BUT in most cases Examiners/Raters make the mistake in ignorance of the VA Law and rate based on the higher amount of symptoms in lower %.
@buzzsawyer2289
@buzzsawyer2289 Год назад
@@MrOmar0021 Yes And that's what I posed. I noted that depressed mood doesn't have any quantification of severity whereas near constant depression and anxiety does any have to leverage that over let's say the static symptom that shows no frequency. I read a post somewhere that that's how they figure out what range it falls in and I couldn't find any help. I lost so much sleep over it. Thank God I went with my gut your father statement is support acclaim. I got really good with regulations and statement support of claims from this recent claim. I'm now 100% P&T

I asked him to repeat the question and he said, "Ok, I've heard enough." The entire call lasted five minutes. It would have been shorter if I didn't ask him a question at the end. I had similar questions I was instructed to look at the va compensation calculator other then that I know from my own experience that If you have a 70% disability rating then if you get under a per say 50% on another rating it will not go over a total 70% but if you get a total 75% or between 75% and 80% they round up to 80% with the rating

@ketoman8873 it's wonky, but easy to understand once it's explained. Say you get a rating of 50%, that means 50% of you is still good. Say you get a second rating of 50%; that's 50% of your remaining good 50%, so it takes you to 75...which rounds up to 80%. At that point, you have 20% good left. Say you get another disability rated at 50%. That is 50% of your remaining 20%, so raises you from 80 to 90% disabled. Say you get ANOTHER disability rated 50%. That bumps you to 95% which rounds up to 100%. The higher you get, the more it requires to get to the next rating. I'm not saying it's right, but it's the way they rate

cfr 38 3.326 section A and B states that your own private doctors dbq is key word “adequate” I’m not a lawyer but I would highly say to never go to a c&p if you have adequate examination and records from your own doctors especially for mental health. It’s states they need to use your doctors report for compensation purposes. Never trust a c&p examiner they have NO right in my opinion to form ANY sort of diagnosis who the hell are they!! Your own doctor knows you better some some quack who makes a diagnosis in 15 minutes. Better off being denied and apealonf them with a lawyer these rating “idiots” aka specialist do not even know the CFR and the appeal will trump a moron who does follow the rules. I been there fk the VA study the cfr know the cfr and you won’t even need a lawyer and always select to take it right down to a hearing in person in Washington because that shows you mean business and the likely hood they even want you to go to Washington is nill. Cite the cfr and they won’t have a leg to stand on … but make sure you do at minimum have a lawyer look over your doctors dbq and nexus if you try and fight this on your own.
