Mr Femi Falana needs a podcast where he can teach the public about our rights. The man is an oasis of knowledge about Nigerian law and relevant judicial cases that matter to everyday Nigerians. Someone who knows him, please tell him to do this. Every time I watch Mr Falana speak on matters of Nigeria's constitution and the law, I feel empowered as a citizen.
Why should criminals or armed robbers attack people in their houses, but the people have no guns to diffend themselves. It does not make any sense. Nigerians should have the right to defend themselves and their family when attacked. All these armed robberies and unknown gun men attacks will end immediately.

So you can walk into a gun store and buy a gun or rifle and leave with it 30 minutes later after a national background check is run on your records. If there is something on your records that cannot be verified immediately you can come back for the gun in 2 days. If there is a felony on the buyers record for aggravated assault or armed robbery or a psychiatric condition the sale will be denied on those grounds. Most states require you to get a permit to conceal carry or open carry your gun on your person, in public. But you do not need any permit to have it on your property, that is in your car or home.

Ranching is not govt's business. Herders are private business men who should provide the infrastructure for themselves. These cattle herds are owned by wealthy politicians who pilfer our common patrimony and invest them in foreign choice properties. They can as well use the stolen funds to provide ranches. Nigeria cannot keep pampering a section of the country who are mostly foreigners and prioritize their well-being over other country men.

The Chief of Army Staff is misinformed about how a democracy works. The proper checks and balance that must exist in a democracy guarantees the right of self defense and prevention of tyranny of the Executive, the military or any other group. Nigeria needs its own Second Amendment laws.

Sir, can they equally make ranches for those rearing pigs? Because pig farming is on the rise. If they start attacking communities tomorrow just to get relevance,so ranches will be built for them. The issue of ranches should not be permitted, otherwise every business person will require Government to secure places for their businesses too.
Mr. Falana, I completely disagree with you on this issue of government funding ranches for private businesses. Some of these cattle’s are owned by wealthy individuals who ordinarily use the poor less privileged to grow their cattle 🐄. I respect the SAN but this issue is beyond politics of fulani herders killing people. The law is very clear on self defense but you just cannot allow all Nigerians to carry guns to protect themselves. However we must look at the consequences critically and assess it merits before lookin at this kind of proposal. Law and practicality of implementing the law matters and we just cannot accept blindly what the law says without assessing the consequences of implementing that law. Yes Falana is absolutely right in explaining what the law say but it is the responsibility of the implementing agents to see whether they have the capability and efficiency of controlling the consequences of individuals owning guns. United States should be our reference point in allowing Nigerians to have guns. With the corruption riddled country like Nigeria you expect people to respect law and those issuing licenses not be corrupt in giving licenses to irresponsible people to own guns. We have seen in this country where security agents have given their official guns to robbers to rob and receive returns. Mr.Falana(SAN) Lost my attention as soon as he started blabbing with regards to these killers Fulanis doubling or disguising as cattle rearers.Who knows,perhaps he may have ever been or he is still serving as their counsel or legal adviser,otherwise what's the sense,wisdom or rational behind making a case for them such that he wants the Government to use public funds to create a paradise for these fulanis in the name of ranching policy that is clearly aimed at appeasing the fulanis at the detriment of other ethnic groups,trades,vocations or professions.I thought these killer pastoralist entities were running their private businesses?How come now that some people are of the opinions that Government should fund these businesses?It doesnt make sense at all,even if other trades and professions would be given the same considrations and treatment,it will be an exercise in futility,not to mention how wasteful of resources the idea would be,and seeing how freely they are allowed as immigrants and aliens to be crossing and traversing the Nigerian borders at will from all over other African countries,this act in it self is very counterproductive and retrogressive to the Nigerian state.

Sorry for your loss but the fact is that politics is the reason why these invasions have not been curbed so far. The government will not give the people guns so maybe self-help is the only solution. My point about Mr Falana is that he is not really advocating for the right to bear arms, although he made it sound like it and it is a great sound bite. He knows fully well that the government will refuse any application from individuals about their right to bear arms but he says it because it sounds good. He didn't offer any realistic solution neither did he take the central government to task instead he apportioned blame to the military and legislative.

To discuss the right to bear arm, I would expect the learned attorney to go to the Constitution first and say where such right is explicitly stated. What does the constitution say? Is the right to bear arm guaranteed in the constitution? There is no such guarantee explicitly guaranteed in the constitution. Mr. Falana is discussing what is called exceptions. Based on Mr. Falana's exertion there is no such guarantee in the constitution except certain constitutional requirements are met. By Mr. Falana's standard he assumed that the is already extended to all Nigerians. That is not so. Secondly, in the United States, this question Is a very debated constitutional issue. The right to bear arm in the United is guaranteed to "a well regulated militia" which the conservative wing of the polity has interpreted "militia" to mean the citizenry. The liberal persuasion interprets militia to mean just that, militia. The right to bear arm is found in the Second Amendment to the United States Constitution. The United States Supreme Court in as recently as 2008 in a 6-3 landmark ruling stated that the right to bear arms in public places is guaranteed. There are selective states in the Unites States where citizens own and carry arms In public. To extend that interpretation to Nigeria, I find very disingenuous. The analysis here based on Mr. Falana's assertion is that citizens should break the law by first buying guns and then look for where they can procure a license to legitimize their criminal act. Look at the United States, access to to guns increases violence. In a country with tribal and religious violence, allowing every Nigerian to carry gun is nothing short of legalizing violence in Nigeria. Talk of other crimes like armed Robery and kidnapping, the society as a whole will be throne into anarchy. Simply put, Mr. Falana is wrong in law and public policy to advocate for the right to bear arm in Nigeria. Lastly, the idea of Nigerian lawyers always referencing the interpretation and application of American Law whenever they discuss the Nigerian legal jurisprudence is inimical to the principles of Supremacy. I understand comparative law and analysis, but it is in itself inappropriate that Nigerian lawyers do this very frequently. Go through American court decisions at any jurisdiction including the Unites States Supreme Court and see if you can find any reference to Nigerian law applied or mentioned comparatively. It does not happen because their constitution is Supreme. I respectfully submit.

The right to bear Arms for self-defense is the same all over the world so long as you obtain the necessary license. Therefore, what the guest is saying is not new. The Chief of Army Staff understands the constitution as well as the guest, but he is a military man who will not go out there to be preaching for Nigerians to bear arms as that is not part of the responsibilities of the military. A call for all Nigerians to carry arms for self-defense could result exactly to what the General was saying knowing the indiscipline that exists in the country right now. He is fully aware that Nigerians have the right to carry arms provided they have the appropriate license, but he will not support a call for it because the military is there to defend Nigerians. This is the understanding that I got from his commitment which was not made out of ignorance of what the constitution says about self-defense. This issue of Nigerians carrying arms for self-defense has been going on for a long time and the general is also aware of that therefore, the guest trying to rubbish the comments of the general is uncalled for in the sense that the military is the one that has to face the bandit, kidnappers and the terrorists and not the constitution.
