don't we already have a precedent? "The US Copyright Office specifically states that “Copyright does not protect the idea for a game, its name or title, or the method or methods for playing it. Nor does copyright protect any idea, system, method, device, or trademark material involved in developing, merchandising, or playing a game.” because of that disaster with what was it ... ridge racer? where they threatened to sue anyone else that tried to compensate overly excessive load times by playing minigames on the loading screen. which then exploded in their face because it was said once and for all you can't copyright game concepts and mechanics.

Nintendo has ruined it's image in my eyes, it remains a stale concept with more letdowns than Pokemon in their roster, not to mention that the game panders to anyone under 12 and fails to sell to the people who literally funded their brand all those years ago. With leadership attacking those who try to put a fresh spin on the monster catching and battling concept, they're effectively making it so their brand stays stale and discouraging change.

No minigames in loading screens, no enemies that remember you, no recruiting/capturing characters with items. This needs to stop before the only people making things are megacorps with libraries full of patents.

MGS V has that sort of mechanic. Lots do in fact. Patenting things like that would limit what smaller devs can create, and might kill indie games. Imagine if Ubisoft patented using "towers" to reveal things in an open world.

From what i heard, the patent is on the throwing a ball part, not catching itself. Though since they took the using ball idea from 60's Ultraman series I hope it does not stand up. That or something that prepares it like ghost busters sues for the who throwing a capture tool idea. My opinion is there should not be anything substantial enough there, as nothing was terribly innovative, but apple managed to copyright round corners when everything had round corners for years before rue iPhone so I have little trust in the system.

@@sjmcc13 The only way that would occur is if the patent gets shut down. If it were an American patent then it would be a different story (Since the American aircraft industry was saved by shutting down of the abusive patent the Wright Brothers had.) Sadly, this is a Japanese patent (Nintendo) and they are filing this lawsuit against a Japanese company (Pocketpair.) So, I highly doubt that this will go all that well for Pocketpair but I will wait with bated breath to see the outcome.

Nintendo does NOT own that idea of throwing a ball to catch or summon a creature. Nintendo does not own those patents. That was used in Starbound. Starbound was made in 2016, 8 years before nintendo filed this Patent.

Palworld's "Aim and throw throwable item to capture monster" mechanic was something that Pocketpair also already had developed and released by 2020 in the form of Craftopia. The patent that Nintendo has for Pokemon Legends Arceus for that same mechanic (though the patent itself that Nintendo has was way more vague than the concept I stated above for Palworld, since it stated any projectile that affected a field character or called a field character, way too vague since this would include grenades and airstrikes) was filed in Japan in 2021, it only went through in the USA in Sept 2024. They shouldn't be able to win this lawsuit if it goes as fairly as it should.

I think the last new IP they tried was Arms. Failed. The only newer IP they've had any success with is Splatoon, and it's over 9 years old now. They don't try anything new, and when they do it's gimmicky.

The only reason this is moving forward is that the patent protections in Japan are so restrictive. Most countries don't let you patent gameplay mechanics, but it's not quite that simple in Japan. I hope Nintendo loses.

Optimistic but unfortunately it can. The dialogue wheel, nemesis system, loop loops, dual reality, etc are some mechanics that have already been patented in the US and Japan. There are also some games where features had to be removed due to the patents being enforced in a few other countries, although it is very rare

Funny as it is, Activision actually owed 23 million in two separate patent lawsuits and the crazy taxi lawsuit which was in the US. They can sue all they want but it's the implementation not idea, unless it's specific a court will throw the case

Call me crazy, but I don’t think a “game mechanic” should be something that a company owns, and certainly not for multiple decades. If this particular practice MUST exist, then 2 years should be the absolute maximum amount of time before another game can implement it. Also, once that patent expires, it can never be ‘patented’ again.

On one hand it's the reason why we get so many good games from them, because they're not always just chasing the latest trend, but on the other hand it leads to ridiculous stuff like this and all of the dumb stuff Konami has done.

And the problem is in my opinion, Nintendo is a backwards company who rather hold everyone else back to not put too much effort into anything, instead of learning from competitors and getting better themselves. Competition is absolutely healthy for the market and innovation in general. Seemingly not if you ask Nintendo.

Them 'looking alike' is just because of fan service. They wanted to draw in people who grew up with & still played pokemon, & it worked.

Digimon has the Mega-level as the highest Digivolution stage. Pokémon's Mega Evolution is just a temporary power boost. Totally different things. Digimon doesn't have "Mega Evolution." Just Mega-level Digimon. Would you say something is ripping off Digimon if they say "Ultimate Evolution?" Or "Champion Evolution?" Rookie, In-Training, Fresh? They are all Digivolution stages. Sure, the high level Digimon often revert to their Rookie forms, but that doesn't mean Mega Pokémon reverting back to normal is a ripoff.

@@LaZd- No, actually, for patents you actually have to patent a very specific mechanic. If the specific mechanic is virtually identical in execution, that's a patent infringement. In this case, if the patent is "throwing a ball to catch a creature", it not only has to be "throwing a ball", but basically the exact same execution of the mechanic as well. IIRC, weren't people comparing the way this works to Pokemon Legends: Arceus when the game came out? Its not as simple as "any mechanic where you capture a creature and use them in combat." That's too broad. It has to be far more specific than that.

It's called patent trolling. It's pretty common these days sadly. It does nothing but make Nintendo look petty, and all Pocketpair has to do is point to the many examples of the same game type (even before the patent was made) and get the other devs involved. Square, Bandai, and many others would absolutely get it tossed as a frivolous suit. The fact lawsuits like this have been raised against nintendo too should tell how easy that would be.

I'm not a lawyer, nor do I know japanese law. But if the patent is indeed the catching mechanic as it exists in Legends: Arceus. That mechanic was already in the Palworld dev's previous game Craftopia which came out years prior to L:A, so it's possible they have prior user rights. Also, several claims in the patent refer to turn based combat system and other systems not in Palworld, not sure if that's relevant but it could be.

They did have the patent published around 2021, Palworld first trailer was 2022. Then again, Pocketpair also made a BOTW clone yet they didn't go after it, you know why? Because that game didn't get the same success as Palworld did. On top of this, Pocketpair also announced Palworld Entertainment, just like how Pokemon company came to be after Pokemon's success. Palworld is not just a competition in the game scene but also in animation media and merch. And they partnered with Aniplex and Sony Music Group of all entities, it's a serious expansion.

Me and my brother have had a rule where we promised each other to stopped taking Triple A studios as seriously anymore nowadays. As a tradition, sometimes, when we do get a game like Pokemon or Halo (just to name some examples) my brother does everything in his power to see how hard he can break a game at certain points. Some games we acquired at launch and tested at certain points like after updates, and others later on (like over a year or so). Trust me when I say that he is a master of breaking things that he can do it intentionally and unintentionally. Pokemon Violet was his choice during the new gen, and he still holds a record of breaking that thing over 20 times over certain periods till he stopped playing it. Palworld tho? He was DISTRACTED having fun, and not once have I heard a word of him breaking that thing on LAUNCH and other time periods. He also had Violet on launch day so it helps make these two a good comparison. There was also the fact that he even tried to break it and had to look up things online just to try it out himself. He succeeded one or twice at some point but it made us laugh that Palworld had better care of their game than Nintendo at the time. We stopped playing SV, and we still choose to pick Palworld regardless of its mechanics or not. Its about time Nintendo and other studios had a wake up call about tryin to cheat us gamers out on pricey broken games.

The bright side is that patents have to be very specific to be filed and to violate one you have to infringe on all the terms of it. So companies can't actually do that in a literal sense because you can't actually patent the idea behind a mechanic but it's execution.

It's a empty threat. 'Multiple Patent rights' could mean anything, which means Nintendo would have to declare what their patents are in general to video games. And if so, that gives them the ability to 'sue' every other Japanese games in existence for 'infringement' but I doubt the court would be happy that a corporation would blatantly attack the whole game industry over generic or vague elements. Lawyers on the other hand, is happy to have a job and to be paid. There is a good chance though, that Nintendo is not actually trying to do a legal battle, but a financial battle, causing Pocketpair to waste time and money.

Patenting game mechanics should not be allowed! Imagine if movies had entire narrative devices patented. When this happens, no one can build off of and improve upon existing mechanics except the patent owner. And if the patent owner doesn't want to, then the mechanic is doomed to stagnate.

The western world is just delusional and doesn't realize that most Japanese games are stuck in early Playstation 3 era visually and look like Ys X at best. Just look at Gundam Breaker 4, one of the biggest Japanese games of recent months. Japanese companies always try to play safe and go the route they've always taken, so anything ever barely improves. So no, it's not just pokemon or Nintendo. It's just that you are more exposed to news about Nintendo more over there.

Because it's subtle and vague enough, you can't prove it publicly because the public would just mock you. But this is how corporations get public acceptance over time, they blend the controversial with the norm over a decade until people think it's acceptable once they make a big enough jump. People on social media 'looks down' on groomers, but corporations are the biggest existence of them and no one really care enough to point that out. Consumers are 'groomed' into a ideal subject for them to exploit.

The worst part about this is Palword isn't even really a pokemon clone. Beyond the Pal's asthetic being very similar to Pokemon the game has MUCH more in common with Ark Survival Evolved. Its basically just a streamlined version of Ark with Pokemon instead of Dinosaurs. If Nintendo is going to sue for that, maybe Squeenix should sue Nintendo since the entire concept of pokemon from the taming mechanic to even the cutesy monster design is an absolute rip off of Dragon Quest. Hell, Maybe Wildcard should sue the shit out of Gamefreak and Nintendo since the only reason Nintendo went open world was because *ARK* showed how successful an open world survival game with taming mechanics could be. Rockstar could jump in and sue too since they did the 3d open world first. Did you pay your royalties to the creators of GTA when you made Breath of the Wild, Nintendo?

@@AppleInk I think they meant well in the beginning, you know Nintendo polish and all that. But now the polishing has become a threat lol. They look at their customers now as ink blotches on their perfect paper. What once was a sign of quality that every gamer could appreciate, a symbol on the box that it was going to be good. Now though, it just means if you do anything with that game other than play it, the Nintendo man will get ya! This is just my opinion but the shovel ware slide and the tarnish on that seal started around n64 and it’s just gotten progressively worse.

Patent infringement has long been used to protect companies by preventing others from innovating so that they don't have to innovate themselves. This is quite a sad state of affairs that competition has to revolve around such shenanigans because companies don't know how to keep their IPs afloat.

This isn't about the characters but about the game mechanics. That being said, being TOO CLOSE to existing designs absolutely is something you can win a lawsuit over, but its not a guarantee to pull it off.

So they show you the absolute horrible POS company they are by suing yet another, not their first but another small indie dev out of selfishness and greed trying to patent and sue for their monster catching thing. They already played their hand, they show they want everything and are taking the palworld devs to court saying they want to do this, even if they lose you'll still support them just for losing. So if someone tries to do something insanely horrible like nintendo they get your money still because their plan failed. This is the most important lawsuit the palwold has to win or the entire game industry is screwed like this video says. But of course you'll let it slide if nintendo loses anyway...Stop supporting bad companies that try to patent game mechanics and are doing stuff like nintendo does. Your just feeding their wallets and their ego even more to sue with. If they lose to palworld they'll just go after someone else to take millions from them. This would indeed create a dangerous precedent and seriously damage Nintendo themselves if they win. If they win I for one will not be buying and Pokemon Games and likely will not use my Switch again outside of playing Games I already own. Continuing to support companies doing this kind of stuff will be to our own detriment!

Nintendo took a page out of EA’s playbook to patent a gameplay mechanic. We could point to Namco as well, but hopefully everyone can see how this is a problem. We’ll see what happens next. The fun of watching a developing story.

They did have it around 2021, Palworld first trailer was 2022. Then again, Pocketpair also made a BOTW clone yet they didn't go after it, you know why? Because that game didn't get the same success as Palworld did. On top of this, Pocketpair also announced Palworld Entertainment, just like how Pokemon company came to be after Pokemon's success. Palworld is not just a competition in the game scene but also in animation media and merch. And they partnered with Aniplex and Sony Music Group of all entities, it's a serious expansion.

Ironically, despite the creator saying that they don't like originality, and the game at glance looks like a very on-the-nose tweaked rip off of a bunch of other games, the game itself is surprisingly original in concept. Like sure, all the individual parts aren't exactly new, but I honestly can't think of another game that plays quite like Palworld. It really is unique in the sense that it's a blend of genres and concepts we've never really seen together before. A new recipe, if you will, inspired by the cookbook by not directly from it.

Honestly ever since Yuzu lawsuit and Nintendo have been furiously trying to take down ROMs of games that are on old gen consoles that aren't on the Switch with copyright strikes to make way for the Switch 2, they have gotten overly greedy. Patenting game mechanics is the most pathetic gatekeeping monopolizing issue that needs to be adressed and updated to today or something. Like ubisoft patenting the ai remembering you is dumb. I feel like the "capture and summon" patent should be ruled as "too vague to be enforceable/too broad or generic to be acceptable" There have been many games that have had a similar system and if this does get enforced, where does it stop? World of Final Fantasy had Prismariums, YuGiOh cards (in the anime and video games) are similar in the way they summon the creatures and use them for battle, Bakugan summons creatures from balls to fight... There are so many games out there that have had or currently use a similar mechanic and the wording of the patent fails to draw a line between what is and what isn't acceptable. It's just too generic.

Nintendo will be paying all of them damages with a loss of patent for abusing the system. As a Nintendo and Pokemon fan, this left me perplexed; why would they wait a moment like this to sue Pocketpair for the monster-catching patent? Out of all the moments, why now? I love Nintendo as game developers, but when it comes to lawsuits and copyrights, they have really questionable motives. I haven't played Palworld, but I do think this is a very petty move to sue about the whole monster catching when it existed in different games like Digimon or SMT. Pokemon only popularized the genre. If the patent thing is going to be applied in the video game industry as a whole, does it mean one day Namco will sue Sega for Virtua Fighter for the 3D fighting aspects? (Not real, just a what if) This is really worrying, it almost feel like influence and inspiration will not be allowed in mainstream media in the future. (Edited for grammar)

I love Pokemon and really enjoyed Palworld. Nintendo is being a bully and setting a terrible example. Make better games and you will have better sales and success. Stomping on other people to keep yourself propped up really proves the quote "You either die a hero, or live long enough to see yourself become the villain."
