I found some basic point based on your debate that i want to mention here. 1) about the honorable Supreme court :- supreme court can make inactive those rules that make violation in fundamental right of the citizen , but here supreme court in a hurry to instruct the government to make and enforce the rule that is somewhere against the fundamental rights of indian citizen. 2) about the Government :- state government are in some kind of whirlpool of suggestions . Because of this, government has no clue about the mode of enforcement of this kind of law in prescribed way. 3) about the respected citizens :- when a citizen of india are not in NRC list because of unavailability of any legal documents then this not means he is not an indian people . Unavailability of such documents may caused by flood , fire or other catastrophic incident . Thank you again For this informative debate.

My mother from Bihar .. passed hslc 1979 and moved to Assam after her marriage ..now in Assam she has voter id adhar pan bank account lic, ration card .. but she is excluded from nrc

I myself is a victim my father has a refujee certificate of 1964 n he is also a diclared indian in foreigners tribunal.. My sister in included n my father n myself are excluded.....NRC 👎☹👎

Sir i am victim of nrc my all maternal paternal kit and keen are enlisted in nrc but my father brother and me were left.but my question is why there is no well sophisticated high tech border between bangladesh and india .as far as to my knowledge the border is porus in my paternal village even in maghalaya only a river separates our country so why nrc why no high tech border

The basic principle of 'Judgement' is, hundred offenders may go scot-free but one innocent should not be punished! What about those genuine citizens who are not part of NRC? This exercise is mainly to fix and weed out only Muslims as Amit Shah has already committed that all others except Muslims will be given citizenship. This is what the new saffron India is! God gives sustenance to every man born in this earth irrespective of his country, colour, creed, religion etc, but man imposes restrictions in all possible ways to fulfill his ideology and agenda!
I am not in entire agreement of the arguments given. 1. remittances : he is quoting 2012 data ( its difficult to find such old data) where he tells how remittance from Bangladesh is 5th largest , but latest 2017 data shows Bangladesh is the 25th country , top being Singapore from where remittances come from. Infact the same site shows how Bangladesh is the 1st in the list in terms of remittances being sent from India. This shows that from simple calculation that in 2017 ( $4033 million-$126 million= $3907 million ) i.e ~274 billion rupees as remittances are going from India to Bangladesh. Sarbananda Sonowal case 2005 which declares IMDT act as unconstitutional because burden of proof was on the people who declared someone as foreigner and not on the foreigner to prove he/she is an Indian citizen, where as it is opposite in rest of India and hence declared unconstitutional under article 14. This information is missing in the discussion while talking about Sonowal case. 3.Again similarly when another narrative building is made when its said that citizenship amendment bill (CAB) would be inevitably passed by the parliament and so NRC would exclude bengali muslims and CAB would include the hindu immigrants which although court will passed onto a constitutional bench would take time for final judgement. Hence NRC is a failed exercise. NRC as an exercise started to determine illegal immigrants. This became important for Assam because of its unique population where in absolute numbers it has the largest number of tribal people compared to rest of Northeast. While North east itself is full of different tribal communities ( which is half of Indian tribal population) while Assam has almost half of tribal communities of northeast with some population of tribal communities less then 5000. So when 50k outsiders come and illegallysettle near them and slowly occupy their land, get voting rights; there is loss of land rights, political rights, cultural heritage loss. When supreme court agrees to cultural heritage protection of Odisha tribals infront of POSCO onslaught why shouldn't it protect the Assam indigenous tribal rights due to onslaught of illegal immigrants. Research has shown how it is easy to make illegal documents which make some a valid citizen ever since the large illegal economic migration has increased in the northeast. Kindly read the works of "Kamal Sadiq- Paper Citizens" where his research shows how economic migration is aided by a corrupt bureaucracy at the borders of developing countries ( Afghanistan to Pakistan, Bangladesh to India etc). More importantly, it is the indigenous poor, tribal people who dont have documente to prove their citizenship claims despite living in their land since human life settled (hence called adi-vasi). Due to such forged document issues, hence two list of documents are sought one is post 1971 ( when Bangladesh became independent) and another pre 1971, so that those coming later on could be identified. But here reverse argument is presented to suit a narrative. Hence subsequent government ( like it is said in the discussion) has figures of 5million and thereabouts, with each data estimates by subsequent governments have only increased the numbers. Hence student organisations and people of Assam are up in arms and SC has ordered 10% reverification of data. Most interestingly, many officers were themselves found to be out of the NRC list who have been included many illegal immigrants in the list. 5. Only argument which is valid is the 1987 cutoff date vs 1971 cutoff date. This was due to 1985 Assam Accord where 1971 date was accepted. So when citizenship act was amendment in 1987 then this issue should have been sorted. 6. The discussion is critiquing the judiciary for interfering in the executive for doing the NRC exercise. But the question they slyly evaded is why did Judiciary had to intervene in the first place. It is because political parties across the spectrum has benefited from the illegal migration. Infact, of the parties AIDUF is an illegal immigrant party which has formed coalition govt in Assam. Finally, I would arge my fellow Indians to also know about the views of the people of Northeast and why they are up in arms. This interview presents only one side of the story of human rights violations, unconstitutionality. But there is also another side to the same story. What could be done is to regularize the migration, make it formal. Secure the land rights for the tribals atleast so that ethnic clashes do not occur.

It seems, it is the scar of partition ànd the mother part is having much suffering points still...No person would ever think of migrate if his part is not devoid of self-sufficiency..The additional part, now, has got settled in the local mind that religious supremacy may have more political voice in the coming days and can only be countered with ethnic supremacy.. Sir, I'm from assam and I feel that ft had made to harass the minorities, from my ground experience it is seen that the poor people are inhumanely send notice to proof their citizenship but their voting process is going on from decades, you can imagine how fair ft is by analysing sanaullah's case.

Someone has to exceed the jurisdiction to protect the larger interests of country. Moreover, tge doctrine of strict separation does not apply in India and thus Supreme Court can very much act as executive
Court is not protecting the rights of citizens by NCR, the common people were harassed and they were no where in own country that’s apathy towards humanity and increased the hatred ideological politics in India,which is always secular recorded in world politics,
So this just proves that which most Natives of Assam have already known since we are not considered Assamese, which is, the problem is in the definition of Assamese rather than people from other states coming or going into and from Assam.
Convention on Rights of Children gives right of nationality to every child born. It does not however say that all such children will get "Indian" nationality

What I understand from the conversation of these two gentlemen that the Indian Supreme Court does not have judges who can interpret the constitution , understand law and justice, national and international law regarding a human being. At present the Indian parliament is not wise and educated. Can India head toward banana republic?
Something sensitive like NRC should be done more conservatively. Only exclude people who are surely illegal, keep some suspicious people for more detailed verification and put other people with slight doubt or with spelling mistake documents back in the nrc list. That way only a few indians will be harmed. But instead lakhs of Indiasn are being badly harassed
NRC in the back drop of infiltration from the enemy countries particularly from the Muslim countries has made it controversial . On the other hand SC allowed it despite of some objections after keeping the sense of national security and internal law and oder issues .
NRC in Assam is an insults to the every citizen of our country stop insulting more. Jai hind. It is a matter of ashamed to say we belong to a country which is the greatest democracy of the world.
NRC is necessary, They are arguing about provisions. Congress is at fault first, they did not do anything about it and hence it provided an opportunity to BJP to do politics.

Bangladeshi Muslim illegal migrants should be given citizenship of India provided they bring along with themselves some land from Bangladesh!! Afterall land is the greatest resource that went to East Pakistan based on the demands of the ancestors of these people. Now they have left that critical resource given to them behind and crossing the border and staking claim on the resources of this side of the border..
