It’s really creepy to think that when the neighbors heard Garrett fall to the floor and went next door to knock, someone immediately locked the door from the inside then escaped out the back. To think they were that close to seeing who it was is crazy tbh

I don't understand why he was even put on trial. There were fingerprints of an unknown person on the window the killer used to exit the building. To avoid any reasonable doubt, those prints need to be explained to solve the case.

He's guilty as f. He lied about not getting along with the kid. He lied about going home to feed his daughter. She texted asking him what's for dinner. He lied about going home. His so called alibi was 300 years away and they met about 12 mins after the lady knocked on the door and called police. His ankle was injured. He didn't want to talk with police. He lied to his wife lol he was cheating in her with Tandy. Dirty man.

This is pure speculation on my part, but if Nick was somehow involved in the murder then he must have had paid someone to murder Garret Phillips. That would explain why he turned left possibly following Garrett home to signal the go ahead to the killer. That's why the prints don't match Nick's prints because the person who actually killed Garret was a hired killer. However, if this isn't the case I don't see how Nick could have killed Garret himself as there's no irrefutable evidence linking him to the crime.

@@tanishazoa138 what are you talking about, it was a tiny old scratch. His fingerprints and the dna under the kids fingernails didn’t match. I know a 12 year old boy isn’t the biggest but he’s definitely big enough to make a few scratches, scrapes, or bruises on someone….I mean come on!

The DNA came back to Mr. Hillary. There's a lot of other evidence and PROOF - including the fact that Hillary lied about his ankle - that wasn't portrayed in this video. If you care more about an innocent child being murdered than about a liar who only cares about himself, listen to the podcast by Roberta Glass about this case. She interviews a former defense attorney who took a deposition from this man. Or, better yet, depositions are publicly accessible, so you can read it yourself.

This case was clear cut if you consider the evidence, no DNA, no prints, and the racist cops forgot to plant a witness to have seen a black man running away from the scene of the crime. I am shocked that there was an even inditement to bring the case to trial.

This absolutely was NOT about "race;" it was obviously about the evidence - regardless of whether or not it was enough to convict Mr. Hillary of murder - that led the investigation to him. The evidence was obviously the camera showing Mr. Hillary's car as Garrett passed him; Mr. Hillary turning around to follow Garrett home; and his limping after Garrett's murder. Regardless of "race," there's no reason for him NOT to be investigated.

There was not enough DNA to test, pay attention, and the fingerprints don't match but he could've used his sleeves or something to lift it up. They had recently moved so who knows the prints could've been anybody's. I think he is guilty, he had motive, lied, acted super guilty with the cigarette and there is a tape of him following the victim, what more do you want. Guilty as fuck

*I think the ex boyfriend who's a cop had something to do with it. He even went to Nick's children's mother and tried to start confusion. Asking her if she knew that Nick was still seeing Garrett's mother. He was way too involved even insisting that he go with her to the police station AND calling the investigative officers on the case. I believe he couldn't stand that his ex was seeing a black man. THERE'S NO EVIDENCE THAT NICK WAS IN THAT HOME AND KILLED GARRETT. I HOPE THEY FOND THE REAL KILLER(S). Also, this WHITE OFFICER lied and stated that Nick was limping at the game, the day after the mirder. Smh, these racists police tried so hard to convict an innocent man with ZERO EVIDENCE. Nick was on video at the game walking perfectly fine.*

Fingerprints could have been from anyone who spent time in that room - not necessarily from the killer. The person who killed Garrett would very likely have worn gloves, which is why there was no physical evidence found. Someone enters the apartment wearing gloves; hits Garrett to subdue him before Garrett can fight back; strangles him; leaves through the window - all while wearing gloves. No physical evidence left. Killer goes free. I'm inclined to believe Garrett's mother. She would know who would want to hurt Garrett. The lack of physical evidence is how Mr. Hillary got off.

@@catherinesyme901 Actually, there is an excellent podcast by Roberta Glass about this case, and it's on RU-vid as well. There is a TON of evidence that was so conveniently left out of this documentary that proves this monster got away with murder. Roberta interviews a former defense attorney who took a deposition from this man, and this man contradicts himself ALL the time! I absolutely do not have any doubt whatsoever that this monster literally got away with murder and will likely kill someone else. I just hope he doesn't get away with it next time. One more thing: did you ever hear one single time during this interview where Mr. Haley expressed concern for Garrett? Did he ever say even one time that he hoped Garrett's killer would be caught? This is a man who claims he never had a problem with Garrett yet never once indicated the slightest bit of emotion towards a prescious, innocent child who was murdered! Instead, Mr. Haley makes this all about himself and hoe this has "ruined" his life. This isn't about him at all. It's about Garrett; yet, somehow, Garrett gets lost in all of this. That speaks volumes to me.

My main question about this case is, if it was a small town, was it hard to collect fingerprints of at least athletic individuals to match it with the fingerprints on the window? + He's a 12 year not a very young child, was he in trouble with any one else of his peers or so? I feel this case was wrongly investigated, they suspected Nick and stopped at that, how can you have only one suspect for a murder case?! I hope justice will be paid for this poor kid and his mom.

I heard that Garret had issues with some of the neighborhood kids. They had only been living there for a couple months. Also, there was another “suspect” Jim Jones who was a police officer. Someone saw him at the apartments about 15 mins before the murder. And the prosecution hid this from the defense. The mom had issues with him while they were together. She filed a complaint because he pushed her and another stating that she was afraid he would harm her children.

I don't like the mother. She is out for the ex. I get it. He and your son didn't get along. However, you should know better. He is a calm collected person who was on the stricter side (no tv during week is ok), it is not like he got out a belt. The police investigated which is what they were suppose to do but there was no hard evidence so charges should have been dropped long before and they should have taken a different route. There should have been other suspects investigated at the same time. The only fault I see here is that the police spent all there time on one man when there was no hard evidence against him to begin with and that gave the real killer, all the time he or she needed to get away with this.

This is an odd case. I’m glad the ex was found not guilty bc the rationale for the killing just did not make sense. I believe it was one or two of his peers who did this.

Itzy Zaza exactly because ultimately it seemed like they didn’t work as a couple because he wanted to raise his 5 kids with structure and she didn’t want that for her kids, I’m pretty sure he was too heart broken that their parenting styles was a conflict considering her went back to his children’s mother afterwards

I don't believe any judgment should be placed on a mourning mother,!!!!! especially when they were on the verge of a breakup and you have the entire prosecution team leading you to believe that there is no other suspects and the killer is Nick. it is very understandable why her judgment is clouded in believing he did. Her judgment is clouded by overwhelming amount of grief and what is being told to her by the DA. One thing we should never do is judge what a mourning mother feels or believes...It is actually very common for families of murdered victims to take sides with the prosecution and believe what the DA feeds to them, even when the person they convicted is found not guilty or let off on charges due to technicality. We have no idea what type of evidence was shown to her or what information was told to her behind closed doors. It's easy for an outsider looking in to make your said comment, but unless you're the grieving family who's lost a child to murder I do not think it's yours or anyone else place to judge this Mother's beliefs...

For allowing herself to be brainwashed by these people into creating a motive as they had nothing else to go on. These people failed Garret by not having any other suspects that they looked at. Nick did not do it & they let the real killer go. They refuse to look into it any further unless pressured.

No, the police seriously messed up. They should have looked into other suspects, done better interrogation, looked deeper into the fingerprints, and more. They seriously botched the prosecution and were lazy fucks.

Oh, thank goodness!!! 😮‍💨 I was watching the Hulu documentary on this case and I got so stressed out on Nick’s account I had to shut it off. Then I saw this of Not Guilty, and I feel so much better. I was actually getting sick from the injustice towards this man. I mean what the hell is wrong with this police department and the lawyers that sided with them. His DNA didn’t match!! The end!! The investigators missed something huge somewhere. I bet the murderer was an older kid from the neighborhood or someone Garrett had dirt on or even some pervert who's now still roaming around attacking children. Did they interview every single kid Garrett knew instead of just asking his mom if he had enemies? Parents never know everything in a kid's secret life amongst other kids. The wasted time and energy focusing on the ex boyfriend and then taking him to trial when his finger prints didn't even match really ensured that they would never find the actual perpetrator. Tragic and frustrating.

Just saw this on dateline. The only thing that is sketchy about the whole thing is him being in the parking lot of the school (what reason do you even have to be there at all?) And then leaving as soon as Garrett left school. To me, that's a huge red flag. Maybe it was some incredible coincidence, but why drive your car to a school parking lot, where you have no business being) and then coindentially leave at the same time this kid leaves? Another part of me feels like Garrett either was talking to some weirdo online, not knowing it was a weirdo, or a friend or two went back to his house with him and were either wrestling and took it too far or planned to hurt him...then bolted when they heard someone. Was this kids computer and cell checked? I feel like if someone the size of nick killed a kid that young, there would be way more damage done than a simple choke hold. Tell me if right here. You seen the build on that man. No way it wouldn't leave a huge mark around the kids neck

The defense Lawyers sucks! He didn't killed the kid in the hope that the mother would come back to him. He killed the kid out of anger and bitterness. He did it for revenge and also to hurt the mother for breaking up with him because she was ready to move on and he was not. The parking lot incident is no coincidence, he was stalking the boy. He lied about where he was going, he wasn't consistent about it. Who ever killed the boy, knows the boy, the boy let him into the apartment because there was no break in. Unless she has some other crazy boyfriend(s) we don't know about.

I think it was the male neighbor across the hall. He probably had it with the noisy kid or molested him so strangled Garrett to shut him up. His girlfriend covered for her live in boyfriend by calling the police. He opened the window but made the shoe mark in the yard prior to killing Garrett.

That was the only coincidence. No Dna. His prints would have been on the window and on that lock. But they weren't. So.... I think the kid walked in to someone robbing the place. That's the only thing I can think of. Also when the person jumped they left a footprint. Clearly that did not match the size of the foot of the accused and the shoes he was wearing. And I'm sure they went to his house and took all his damn shoes to find a match. Yet there was no match. Maybe he did do it, who knows. But the courts are very weird. They want evidence. Then again I can think of many cases where there wasn't even a body and people got convicted. Or people got convicted with no evidence. Just hear say, and someone else's word. It's crazy. Every case is different I guess

You know if he was found guilty and sentenced years later those prints they found on the window used to flee would be matched to someone. since there is already a man in jail and they would have to go through legal proceedings again they would chose not to pursue charges. I know the Steven Avery case is very different but if he would have never been arrested and charged they would have been seeking new leads maybe even fine the murderer. I really hope this mom finds peace knowing her little one is in paradise right now. we're the ones who are stuck to deal with the pain while they are the happiest they've ever been.

This whole case frustrates me so much. There is no physical evidence connecting him. Bottom line, that's it. It's all circumstantial. The same could be said for Jones. We don't accuse people of a heinous crime over circumstantial evidence. Now let's say Nick did do it okay, although I do not believe that based on the evidence, let's just say okay. To believe you can convict someone without physical evidence is absurd now if down the line you do find it and now that he was found not guilty.. Um. You are fucked. Believing they could get a conviction is so ridiculous to me. They had no evidence! I'm so glad he chose a bench trial. I do not trust people.

I can’t help but feel that Nick got away with murder. Just the fact that he left the parking lot right after Garrett past by, then he turned his car in the direction Garrett was going instead of turning right to go home (where he said he was) tells me he had something to do with it. Anyone sensible who takes a proper look at the case would conclude that all evidence points to Nick and no one else. The evidence is circumstantial but very compelling. There is also DNA evidence that is also not to be dismissed as invalid but was thrown out on a technicality. Two separate DNA tests that show Nick as one in 8 people within the whole of the US that could have been the murderer and the other test showed him to be one in 80.

Garrett skated by, and literally like three seconds later, Nick pulls out in the same direction. That is too fishy to me. But they didn't couldn't physically link him to the crime, so unfortunately they couldn't go further. How could somebody live with themselves knowing they did this?

@@Janice789 He has an alibi. His daughter testified that he was at home at the time Garrett's neighbor called the police to report strange sounds coming from Garrett's apartment. Also, turning left isn't a crime and he COULD just as well have been going to see if his assistant coach was at home (the coach lived a couple of blocks down). He visited the coach at about 5:21, having left his apartment at about 5:15, according to his daughter.

Good question, WHAT WAS GARRETT PHILLIPS doing at the school? Garrett had no reason being there. According to Tandy, the rule was to go straight home after school to do homework. At 430 she called him thinking he was home watching tv or playing a game. He was NOT. Garrett was playing basketball. Tandy told him to go home. He did NOT! FINALLY at 452 he is seen going home. Nick had more of a right to be there than Garrett.

lauren97harper they did but no one in the database came up. Also, when you get an ID, that doesn’t put you in the database at all. The only people in the database is criminals, people who have been arrested, and people in law enforcement

Aren't those of us fingerprinted for state or federal background checks in the system too? I've been fingerprinted for those checks when working with children and for federal security clearance for a temp job at a federal agency.

I’m late but very true he was there to watch a game so he knew he seen that boy and probably followed him but how did he get in without being seen and no prints of him there not even on the door to get in the house unless he had on gloves something is just not adding up

Very interesting case. I wasn't sure of my opinion until the end when the security camera footage shows Garrett skating down the sidewalk, then Nick's SUV pulling out of the parking space literally right after, then not turning to go to his house but in the same direction as Garrett. Then Nick states he is going to do something for his daughter, but his defense team changes the story, saying he's stopping by to see a coach, and Nick says he needed to stop by the office?... That's 3 completely different alibi stories! Look... I'm not racist and I hate to see racism affect the outcomes of cases when it does, but cases with white people in the defense seat, have also been tried and convicted with circumstantial evidence. Circumstantial evidence does not mean no evidence, and it does not mean fake evidence. It just means that it's not physical, and you don't always need physical evidence to prove a case beyond a reasonable doubt, as with the other circumstantial cases I've read about. Sure, the defense could have asked for a bench trial because they thought the jury would prejudge Nick/be racist, but then why would they not re-select the jury and wait for the right jury to proceed? To go through all the trouble of selecting a jury and getting the trial all set, then asking for a bench trial (I'd have to read more about bench trials, because I don't get what the point of our judicial system is, If the judge gets to make their own decision about a case sans jury...), makes it look to me like the defense thought they'd lose the case, but could maybe cry racism to the judge singularly, and he'd bend to that himself. Maybe the defense knew that about this judge? Same with that white Stanford kid who got no jail time. The case was not brought to a jury, only the judge, who went to the same college and played sports and felt that the rapist "wouldn't survive in prison", so he got off scot-free. A jury may have very well put him behind bars where he deserved to be in that case, but the defense attorney was able to argue the case straight to the judge. If anything, there may have been a reasonable doubt; not ENOUGH circumstantial evidence. But i would love to hear this case tried in front of a jury and let them hear all the evidence and see what their outcome is. Now Garrett has no justice. Maybe Nick didnt kill him. But it's an awfully big coincidence that he just so happened to be at Garrett's school, leave seconds after Garrett passes his car, and turn after Garrett down the same road, then produce 3 seperate stories as to where he was going. I just don't buy it, and I think that Nick may have gotten away with murder.

If Nick did kill this child, he best be repenting and asking God to forgive him, because if he doesn't , he will have to stand before the judge of all judges one day and his life will testify against him. You can't hide anything from God.

It has nothing to do with race. I mean there was that guy (who was white) thrown in solitary confinement for 2 years and never got to see a judge, he sued and won. The show making a murderer, where the cops blatantly planted evidence on a man because he had sued the police department and won. She dated a cop, she bumped him for nick and his ego was hurt, then his little cop buddies got mad that nick was gonna steal their girlfriends too. This is about injustice as a whole, not race. Instead of saying racism we should be standing together against injustice. No one deserves to be violated no matter what they look like.

Has nothing to do with entitlement, it has to do with finding justice for a child who was viciously murdered. There is so much evidence that points blame at Hillary, you have to be an idiot to think he's innocent. But unfortunately, not enough solid evidence (i.e. DNA) to convict him. I'd be pissed too if I were his mom, esp since she saw his temper and hatred towards her son.

People need to leave this man alone. He is innocent. While watching this video at first I thought he was guilty and in a matter of public opinion, he's guilty mainly because he didn't have the best relationship with his ex or her son. However, a thorough investigation was done and because there was no evidence to point him to the scene of the crime, he is not guilty. Evidence is evidence. I hate when race plays a part in the justice system because in some systems it does. But in this case they went by evidence and the evidence points that he was not at the crime scene the day the murder happened. Plus he had witnesses. If investigations aren't done, you're talking about putting an innocent man behind bars for what? Because he didn't have the best relationship with his ex or her son? SMDH. So no matter what or how you feel about the situation, he is not guilty.

This dude is guilty as sin. He stalked the boy at the school, then lied to police about where he went after, he had a visible ankle injury which he changed his story on several times, there are inconsistencies with his alibis and there was means (had key to apartment) and motive. The facts in this case make the culprit very clear. The fingerprint evidence could have been from cleaning people, maintenance or previous tenants. The police/district attorney really screwed up the case and because of that a killer walks free.

Wish I was sleeping his assistant coach said that he stopped by his home, Nick never said that, so odds are he actually did go do a quick errand for his daughter and drive past his assistant coaches house this distance for all of this is a mile so for hims to go to the coaches house and run an errand for his daughter and be back home could take 10mins max
