Hello friend, I'm a foreigner who married an Indian in India (Foreign Marriage Act) do I still need apostille if I do it through our local FRRO in if I'm in India? And if so is it quicker in India than doing it from the UK? Thank you so much in advance.
Hi it can be from anyone place. If the marriage is solemnized in India, Marriage certificate issued by Marriage Registrar will do. If the marriage is solemnized in foreign country, it should be apostled/ certified by the concerned Indian Mission/ Post. If the marriage certificate is in any foreign language other than English, it should be translated in English by authorized translator. In my case I was married under special marriage act in India and both of us were Indian still we had to get apholsted at MEA
I have only given name(first name) in Indian Passport and Canadian passport has only last name. When we landed In Canada, SIN was issued with last name only as my given name was considered as the last name automatically. Now when applying for OCI I am not sure what to do since I have only last name in Canada and only first name in Indian passport. Any inputs?
Hi the best would be to write to MEA/CGI on your case and wait for response. They do respond. Have that email attached when you send your application to avoid any penalization by BLS

@vvasudevan4393 see if you can do a walkin at CGI Toronto on Wednesday after you take appointment. They have open house every Wednesday. Check cgi website for sampark. When you send copy to BLS you can send email attachment.
@@canadatriedandtestedoriginal In Sampark, it is only showing 2 options- book appt for entry visa on emergency ground and book emergency appt for police clearnace certificate. Not sure how to get any apps through these as my issue does not fit into both of these. Apologies for so may questions, but I'm clueless now and looking for support. Appreciate your replies.

Do we still need to certify the Marriage certificate if it's issued by a member country of Hague Apostille Convention? There are contradicting statements on various websites. Some say that if a document is issued from a proper authority of the member country then document is already legal and doesn't need to be certified/apostilled.
Hi best would be to call the service agency(if in Canada it is BLS), note the name of the individual whom you speak to, date and time to avoid any future surprises.
Hi once individual acquires any other country citizenship he/she will have to surrender the India passport. Having not done that you don’t want to risk the OCI fee of 345$ each which you pay for application

Hi if you are resident of India the get it checked through FRRO how this will get processed. There is a wait of 2 years after marriage for you to initiate OCI. Do keep me informed how it goes

Hi if the applicant had ever been a citizen of Pakistan or Bangladesh, he/she will not be eligible for OCI www.mha.gov.in/sites/default/files/2022-07/oci-faq.pdf
@@canadatriedandtestedoriginal thanks for your response sir, yes is is for my spouse who has done 2 years military service as it is was mandatory during his time, now they reject saying because he did military service he can not get OCI, as me as it depends and we are married for more than 2 years.
@forcomments3914 ok now I get it. Yes military service done in any foreign country is basis for rejecting. When you fill the last part of form which has Yes/No any response as Yes gets close scrutiny. Unfortunately here they won’t.
@forcomments3914 I am not sure however you can write to MEA and see if they have some way to help which I guess might not be a case as it is the policy. Any foreign military service they don’t consider for OCI.
