Old disabled house bound dusty rusty rockhound here: Wowzer! That stuff is awesome! I would love to see how it is displayed i.e. jewelry, micros, minis, uv collections, etc. I love "bonus rocks" when you go for a specific type of rock and find other co-occuring rocks at same location....BONUS!!!!! Haha, glad you did choose to go with Jon! It was fun helping him stake out that claim. I know claims are a contentious topic with many, but the benefits of an ethical claim (such as here, Jon is happy to let people collect for a fee since he excavates material and assists with the collecting as a guide). Not only do you get the benefits of a curated location, people around the world who can't possibly travel here to collect, then have access to the specimens on the market. Its potentially a good system. Every system can be abused but I stand by my friend here. Mind you I am a left-minded geologist and in general dislike the antiquated claims system as a whole.

@@marywright4934 the legend is as follows, during a fight with the military, fifty penal Apache warrior's we're killed. Rather than die at the hands of the white man , they chose to jump off a cliff to their death. The women , gathered at the base of the cliff and mourned for a moon. Their sorrow was so great , they shed many years. As those years fell to the ground one by one they became what's known as the Apache Tear's. Anyone who possesses an Apache tear need not shed a single tear as the Apache women , shed Tear's enough for them too.

Limonitr is very tough to get off, sometimes iron out will work, but it can take many many soaks

You are probably confusing halite with hyalite. Completely different. Halite is basically a salt crystal. Hyalite opal is a type of opal that fluoresces and has less water content than precious opal.

Private claims for mineral specimens is an “iffy” subject. Claims are based on the 1870 mining law. I’m not a lawyer, but took a public land law class many years in the past. In general, claims were created to allow for development of economically viable mines. Specimens may not be considered to have potential to be an economically viable mine, hence such claims may not be valid.

Filing a claim does not by nature make it valid. I checked - case law is McClarty vs Secretary of the Interior. A claim has to have unique properties (this does) but also has to have economic value. If he can sell these specimens, that would appear to make it economically viable. In general, I prefer that people consider rock hounding sites on public land to belong to the public. Is he planning to make collecting and selling specimens a full time job? Charging people to rock hound on his claim would, I believe , be illegal. You come from the east where everything is private - the public lands of the west are what make it great.

The mining law rules and is constantly re-regulated for fees but never removed. If you can sell it, it is a viable mineral by definition. The form of the product does not matter. Size of operation does not apply. America is full of gemstone mines that are "not industrial" but perfectly valid to work. Dont forget we pay hundreds of dollars to run the entire system for each claim yearly.

Question is do we want all rock hounding sites on BLM or Forest Service lands to be claimed if they are only going to sell a hand specimen here or there? If he is truly making a mine, more power to him. As far as fees for access, the mining law does not allow restriction of public access to un-patented claims. I may be wrong on fee to dig, but I suspect BLM would say foul play. At Glass Butte in Oregon, BLM has stated that only a few older claims are valid. They may be using status as a designated recreation area to do that, and some lawyer may claim that is inconsistent with the 1870 law. However, I am glad they did that, since public lands are for public benefit, and many rock hounders having access to me is a better public use than one person trying to see if they can sell a few specimens. Again for the case at hand, I don’t know his plans or intent, I just know that less and less sites are available for public rock hounding sucks. A boundary in my mind is if a claim is not a realistic income source, then it should not be valid. It is one thing to use the law, it is another thing to do what is right.
