This young man was shot because he was a black man with a gun. I didn’t hear in the body can video the deputy asking him to drop his weapon or gun. That’s the first protocol step of de-escalating and disarming someone you view as a threat. So the guilt and the blood of this young man will forever be with this deputy because of what he has done. What in Gods name does an aggreeesive stare look like. 2.The boy barely had time to blink much less stare before that fool opened fire.3. Isn't this the same department where the cop shot up his own cruiser because of an acorn hitting the roof & he thought the guy inside was shooting? He could be preforming regular maintenance on fire arm , to make sure it was safe to have or use in an emergency .

The truth, Officer Duane shot that Airman because he was a black man with a gun in his hand, and thought because the airman had a gun the officer really thought he could lie and say he felt threatened and that’s why he shot him. He also believed he could use any excuse to get away with murdering the Airman, this is happening too many times from these officers. I also believe the Airman put himself in harm’s way by one being a black man and answering the door with a gun in his hand even he felt threatened or not. These tyrants are looking for any excuse to kill a black man , the officer never gave a command he just shot and killed this Airman without hesitation and with no threat to do harm . It’s obvious that this was Personal and that the officer actually believed because he was an officer of the law and that his chief would cover up this incident. This is 2nd degree murder but because of the lies and deceit and this being an officer he will probably get convicted for manslaughter. A month has passed and no charges have been filed, there needs to be a rally to fight for justice on behalf of the family.

Please let me comment as far as the situation is I am also a Vietnam vet and I appreciate what this man had to say I have watched this story from the beginning heard about the story from the beginning on the news because I am a citizen of Florida I'd like to make this comment and say this as far as the State of Florida is concerned when the governor gave everyone above the age of 21 I assume the permission to purchase a gun a lot of people have done so I'm not going to say whether I am a holder or I am not a holder but what I will say is this with the governor passing that type of a law that gave the police down here a lot of incentive to pull a gun when they see a gun and more than likely depending on the action of that particular weapon the way it is made the trigger may be a very very hairpin trigger with that being said that officer put himself in a very bad situation with that one particular weapon that he does own so anyone analyzing how fast those shots went off have to realize that that one particular officer's weapon was particularly set up as a hairpin Trigger he did not have to pull that trigger but bang bang bang bang bang bang. He should face charges and he should face a maximum jail sentence so so God be willing he's going to see Justice put in front of him.

Let's be honest, this Deputy got fired because of the media attention the Sheriff's Department was getting about this shooting. The Sheriff is a elected official got influence by the mob. This shooting was justified per Graham v. Conner. This Deputy got fired by hindsight and using hindsight is against Graham v. Conner.. Do you understand what are the Graham factors? Do you know what is SIRF? Every piece of information the Deputy knew at the time can fall onto it. Let's break it down. First let's define each factor and then show how this situation falls into it. 1. The Severity of the Crime "The “severity of the crime” generally refers to the reason for seizing someone in the first place. Officer Connor may have been acting under a reasonable suspicion that Graham stole something. Arrests and investigative detentions are traditional, governmental reasons for seizing people. Generally, the more serious the crime at issue, the more intrusive the force may be. There may be a reasonable basis for seizing someone who is not suspected of any wrongdoing. Reasonable force may be used to control the movements of passengers during a traffic stop.6 When executing a warrant in a home, reasonable force may be used to detain the occupants.7 The operative word under the Fourth Amendment is reasonableness. Reasonableness depends on the facts." The Deputy knew the severity of the crime as a domestic disturbance/violence call. The Deputy was told by the apt employee domestic disturbances are an ongoing issue with the apartment. Which shows an escalation issue. Based on training and experience, the Deputy understand how domestic calls make the LEO respond to often times a violent situation involving two or more people. In a place where there can be multiple different weapons. Certain times, one or more of these individuals have warrants and don't want to go back to jail. 2. The Immediacy of the Threat "Whether the suspect is an immediate threat to the safety of the officer or others is generally considered the most important governmental interest for using force. The greater the threat, the greater the force that is reasonable." After announcing himself twice as Sheriff's Deputy, the door opens with a man with a firearm in his hand. They are about two feet away from each other. I forgot what the AF pistol Qual is for SF. However, in my agency we do 1.5 meter hip shooting. A person can get one shot off in under a half a second while the officer will take .75 seconds to respond to that action. That is why distance matters. 3. Actively Resisting Arrest "Resisting an arrest or other lawful seizure affects several governmental interests. It may prevent the officer from effecting an arrest, investigating a crime, or executing a warrant. The Graham factors are not considered in a vacuum. Active resistance may also pose a threat." Based on responding to a domestic call at a location that is known for these issues and announcing himself at the door, the Deputy could reasonable interpret an armed person opening the door onto an uniformed law enforcement officer as a level of resistance. A reasonable person normally would not address a LEO with a gun in their hand. Even at their own home. 4. Attempting to Evade Arrest by Flight "Attempting to evade an arrest or other lawful seizure by flight frustrates some of the same governmental interests as resistance. Flight (especially by means of a speeding vehicle) may even pose a threat." The situation did not have any perceived factor showing flight. It is a tragedy that SrA Fortson was killed. It was an example of Murphy's law. That everything that could have went wrong did. The Deputy was giving the wrong address. The Deputy was giving information about past domestics for this wrong address. Fortson opened the door onto a uniformed law enforcement officer with a gun in his hand. However, sitting the precedence that a LEO has to wait until a person with a gun already in his hand points it at them is putting the whole career field in unnecessary danger.

Can cops get the same ROE we had over there.? I understand that is too unsafe for the officers here outside of the war zone. But that was perfectly safe inside the war zone.

If the domestic disturbance wasn't coming from Roger's apartment, then where was it coming from. Every one is forgetting the Karen call, she's liable if she fabricated the 911 call.

The Airman's family should sue that township for hire an incompetent deputy and sue the apartment complex. People have a right to not open their doors to police until they show a court order slipping it under the door. Both the lady who led the deputy to the wrong apartment and the deputy should be charged for the airman's murder.

Ok great explanation though - out the video , there are countless videos out there!!! With this horrific senseless murder, but there’s no mention of the apartment complex employee that made this call to 911, no common sense was displayed by the employee and the deputy, there’s a lot unanswered questions like did the employee check the residence apartment management listing, clearly hearing the apartment complex employee stating “apartment 1401 “ 3 times, I am retired veteran, so this situation doesn’t make any sense on so many levels. RIP Senior Airman Roger Fortson.

Well I have a lot of questions! Do we know what the domestic dispute ended up being about? Was there anyone else in the apartment with him? Did the person/people who called police accidentally direct the officer to the wrong apartment ? It may not be illegal to answer the door with a gun in hand, but it’s obviously a terrible idea when it’s a police officer knocking. Officers have no idea what kind of situation they’re heading into when called for a domestic dispute. Being met with someone who has a gun in hand or is reaching for one is perceived as a threat. If prosecuted, all the officer has to say is he was in fear for his life, and he very well may have been, even if the guy wasn’t intending any harm. I hope Brandon Tatum does a video on this. He often has access to information that’s not been released to the public.
