However, a tenant and landlord can negotiate terms outside of current regulations. That is, a landlord may offer a cash settlement to have you leave. Same with rent increases. If both parties agree to new lease terms outside of current regulations, this would be considered a legal settlement agreement. Check with a lawyer. Regulations only give guidelines for landlord and tenant in dispute.

We have a landlord in my city that pulls crap on tenants regularly, like eviction to re-rent at higher rates, tenants don't want to complain because they own lots of the rentals. What are possible solutions? A young family was evicted recently.

My previous tenants did not want lease agreements. We both wanted the freedom to terminate at any moment. Have i been putting myself at risk?

We rent a basement suite in Langley with a month to month tenancy agreement..our landlord texted us asking us to move out giving us 3 months saying they need the space to have more family move in. What can we do?

Hi there, sorry to hear that, moving is never fun. If the landlord has provided you with the appropriate written notice (text is not considered appropriate, there is standard documentation for this from the RTB), and given appropriate notice, they have a right to occupy the space. They however, do not have a right to re-rent the space within 6 months so be sure to keep an eye out for it on rental websites, if they do re-rent it, you could be eligible for up to 12 months of rent as a penalty. Does that help?

@@GermynGroup well they gave us written notice through a text message which according to the BC landlord tenancy bureau that's not legal in which case there eviction does not count so at the end of November when they try and force us to leave it won't happen..I also know they only want us out cus the police were at our place as my wife has mental health issues and our landlord doesn't like that and they admitted verbally the are evicting us over that. There family moving in is an excuse

Can't you get evicted for being late on payments? I saw it as part of the rule. Specially after payments been delayed 3x in 6 months. Though in my defense, the previous managers didnt bring this up, instead, I was told to pay before the 5th.

@GermynGroup thanks! I'm actually glad the new manager was upfront with me. This should be a part of the usual "10 day notice" email. 😅 I learned my lesson, it as a misunderstanding in both part and we're starting on a clean slate. Thank you!

Any information about giving notice for apartments. I gave notice and then immediately got a letter saying they would be conducting showings from Thursday to Sunday from 10am to 5pm every week until my last day and they would come at anytime in between those hours and let themselves in. I'm not cool with that, is this legal I would prefer notice of a exact time when someone's gonna enter my place not a anytime 7 hour window

Check the Landlord Tennacy Act (BC). I believe they need to give 24 hours notice for this, check the act

To be honest, depends on what the issue is, and what caused it. Always let the landlord know about any damage however.

Hi. I’m moving out the last day of the month but this last month has been a nightmare. My landlord ask to make visits to show the apartment twice a week. He only text me 24-30 hrs before and at the beginning I wanted to be open to this but now it’s kind of annoying. Anything I could do?

Hi Leon, sorry to hear that. It is an unfortunate reality of being a renter, the landlord has full rights to access the unit with appropriate notice. Technically you are supposed to get notice to see the unit through more formal means and with 24 hours notice minimum (but to be honest that is just making everyone's lives more difficult). Perhaps consider agreeing to some set days/times in advance together rather than a random schedule? Hope that helps!

Such useful information..thanks a lot! Do you help tenants as well to find a long term lease? I am moving to BC in May and looking to rent a fully furnished 3 bed townhouse in South Surrey (with good school catchments) for a year from 1st June. Because I have plans to buy house in the same area just after a year, I don't want to buy temporary furniture for short term as I am moving from abroad. So far I found furnished homes are pretty limited in numbers in most of the listing sites I am browsing

Lot of comments on RTB’s Google review is negative. They say arbitrator makes decision in favour of landlord and don’t listen to tenants properly. Is that true ? Also I have a situation going on too if you wanna listen

I’m always happy to listen! I think the arbitrator will largely make decisions based on the merits of the situation, but I think in most cases the tie goes to the Tenant. they also have to follow the laws and the laws are largely in favour of the tenants as well. There is a recent that just happened. That is really detrimental to landlords, I will have a video coming out about it this upcoming Wednesday, I’ll hope you will check it out! I am currently living in Burnaby. In our rental agreement, it was stated that in the event of early termination, us, the tenants have to pay an additional one month rent, and deposit will not be returned to us. No notice period was mentioned. Is this acceptable and legal?

Are you in a fixed term tenancy? Either way though, the answer is no. I would get familiar with your rights and involve the residential tenancy board if need be. A landlord (and a tenant for that matter) cannot override tenancy laws

@@GermynGroup yes we are in a 1-year fixed term tenancy. And below is the exact clause from our tenant agreement. "In the event that the tenant would like to terminate their tenancy before the end of their contract due to any unforeseen circumstances, this will be considered a violation of the contract. Consequently, the tenant will be required to pay an additional 1 month's rent and the deposit will not be refunded." The landlords did not mentioned anything about notice period, but purely monetary penalty. We also understand from BC law that landlord can only claim our deposit on damages but not for early termination purpose. So this term from the contract sound like an illegal term by law.

Hi Jeff, regrettably they are allowed to ask you to move out if your lease is up, or you are on a month-to-month tenancy. They can only ask you to move out if they plan to occupy the unit, it has been sold and the buyer is moving in, or they are substantially renovating the unit which requires further permissions from the tenancy branch. Make sure they are evicting you for appropriate reasons; otherwise you may be entitled to 12 months of rent.

@@jeffyu8854 Hi Jeff, the landlord can use the dwelling for their own purposes as long as they don't re-rent it. This doesn't necessarily mean they need to 'move in', they can choose to leave it empty if they'd like, but it must not be re-rented for at least 6 months.
