The pious obligation of children has been abolished- reference may be made to the amended sub-section 4 of section of the Hindu Succession Act, 1956; 2. Coparcenary consists of 4 and not 3 generations of lineal descendants; 3. In a family settlement even property can be given to a family member who had no interest whatsoever in the property; 4. There can be adverse possession even by a co-owner; 5. Ancestral property does not get anymore converted into coparcenary property after the coming into force of the Hindu Succession Act, 1956; and 6. There is no concept of survivorship vis-a-vis coparcenary property after the amendment to the Hindu Succession Act in 2005.
in an land acquisition case where the district court after hearing all the sides i.e., farmers,collector,state industrial corporation ( ID ) have given judgement in favour of farmers, then it was challenged in High court by ID and after FA partial amount was allowed to released. soon after that Daughters in the family files a case in court of being cheated by brothers (though they were aware of proceedings ) in that case what step can be taken by brothers and how much of Percentage of Share can be expected to given to the Daughters? the case was under hearings in various courts from nearly 50 years. The Daughters took the law of HSA 2005 as opportunity and now harassing brothers for share stake one of the grandson met with an accident and got physically handicapped and is need of money for treatment, his treatment has to be discontinued now can there be any relief under Disability affairs act? please can you assist with your kind advice
A corparcenery consists of propositus and his three lineal descendants the sos/s grand son/s and great grand sons Simply stated corparcenery has succession of 4 degrees lineal decent Not 3 as stated by you

Please what should we do if father misused of this senior citizen act . Matter is that , father always doing cruelty and misbehaving with my mother and we both brother save his mother from his father cruelty , now father make plan for eviction to us from house thats why father file a false case under senior citizen before DM . We and our mother said and trying to uderstand to DM that , this case is false and not maintainable , but DM did not listsen to us and gave order for eviction , now we file appeal before divisional commissioner but divisional commissioner also did not listsen to us , we had also submitted certified copy of domestic violance case before divisional commissioner which was filed by mother before district court. Now divisional commissioner also did not give stay and said , in his intrim order that we will have to vacant the house after that we can fight case . Sir now we goes to delhi high court for stay . And high court gave us stay. Please tell us how can fight against this false case. Sir this property is our ancestor property but my father had made febricated document and agreement to sell .but DM/ divisional commissioner are not listsening to us that this property tittle is not decided. My father was lived with his bhabhi illegly and now his bhabhi son wants to sell this property thats why my father file false case for evication Please give your suggestion on this case
