People need life lessons. That's why some end up not making it. One day she will do this to the wrong person who wouldn't be the type to seek a judgment, simply senseless violence.
When you're planning for a party or event, especially a large one, it's perfectly normal to start ordering and buying stuff months in advanced so you're not trying to get things last minute and run the risk of not being able to get whatever you'll need.

Love that the defendant keeps reiterating how much she wasn't trying to keep her money and yet kept ALL the money. She just can't admit she's wrong. Even in the end she says she offered partial refund and that's what she got. No ma'am she got 400 and not the 135 you were trying to offer. 🙄
I wish both plaintiff and defendant well. I think both were very, very decent in the exit interview. I can't fault either for trying to keep the deposit or for wanting it back. A good outcome today.
Definitely they both stated they argument in a good way. The pandemic was very hard for businesses such as hers. I love that the plaintiff still gave the defendant praise for her great work.
I can understand what the defendant was saying about having to order the linens, and do prep work, otherwise the case would have been, "She didn't get my items in on time!" Having said that, the plaintiff couldn't have the shower due to something beyond her control. Covid has practically (And perhaps it actually has) created a new branch of law, just trying to sort all the litigation it left in its wake.
WHAT? When the pandemic happened, concerning deposits, cancelling was called 'force majeur' and so all deposits had to be refunded, the pandemic hurt us all, especially businesses. This defendant did not do $200 worth of work, that's outrageous, she should have returned all the money...
The plaintiff is such a lovely person! I'm glad she won! She should have received the full refund because the defendant got to keep the product. She should have had to give the her the table cloths so she herself could have returned them!

I'm always biased in these cases because I manage a meeting/event space where we were of course devastated by the pandemic. We, fortunately, already had acts of god covered in our contract so we were able to survive and just hold all deposits towards future meetings. But if we hadn't had that the business would have closed.
Same here. Told my boyfriend that I don't need a baby shower, I'm a pretty private person, why spend so much money for ppl to buy you diapers?! What?! Same goes for birthdays. I'd rather go on a private trip with my partner
You sound broke. People have money to do it. It’s a celebration and alot of times it can be considered the event that all the family comes together until next year. My family does one big event every year just so we see eachother. This could have been that event wrapped in a baby shower which is awesome. I think people should stop sizing other people money. A certain amount may sound big to you but to someone else it’s play money.

I know the wedding industry from bakers, flower shops, dress shops anything and everything in-between are all hurting right now. They will take forever to recoup their losses but they had to have known their inability to perform the contract automatically means the funds have to legally be refunded. It's common sense although I will say both of these women were very well spoken and seemed polite. Sometimes court is ugly with all the sland and bickering but in this instance it seems they both believed they had legitimate claim to the money and they both decided mutually that a judge needed to decide who was right. Also I've seen JM decide many of these cases in favor 100% back to the customer and it was extremely clever of the defendant to bill out her clients in s way that breaks down the planning and meeting because she was able to retain a third of the deposit.
I don't understand adults who can't trust themselves with saving money or being patient, she overpaid because she couldn't trust herself but could trust the stranger. Many people sue/ get sued here because they couldn't wait to have the entire amount and then buy the items but agree instead to higher interest rates or overpay like her
We always release from contracts. Even after multiple meetings with subs and the homeowner. We never hold even the deposits. There’s something in business where the more human and understanding you are, the more you end up selling.
I think it's ridiculous that the defendant was awarded $200 for a consultation and her time when the whole reason for the consultation and the time she spent was for the baby shower and she could not deliver that! If I was going to award her any money for her time and efforts I would have awarded her $25, I think that's even being generous! I don't think she should have gotten anyting when she couldn't deliver on the contract, I also think it's ridiculous that she goes on and on trying to make herself look good and Justified by saying she wasn't trying to keep the plaintiffs money and that she offered her another date or a partial refund when she did exactly that, she kept her money and didn't return any of it! Why would somebody decide to have a baby shower after the baby has been born!? The defendant is a thief bottom line.

How does the defendant get any money? I don't get it.the things she bought she has and can re use for whatever future event she has. The plaintiff can't so why does the plaintiff have to eat that? Makes no sense.

Milian clearly came into this case looking for a fight with this defendant. But as soon as she realized that she had been impacted by covid-19 as the rest of us have including herself, she backed off. Not to mention having done some of the work despite the cancellation. Good ruling
When she says she never wanted to keep her money she is full of it lol. The minute she was asked why she was keeping it she went on and on about all these services she rendered and made it seem like that money was for those services. She then repeated it multiple times after that. She definitely wanted to keep that money, and once she realized she look bad, then she changes it up.
