Thank you and well done. This is a very topical subject right now, with so many people wanting to live simpler lives. Many coming from abroad to settle in Portugal, because it has such a natural and less stressful way of living. Also some Portuguese, 'returning to the land', from working abroad or escaping overcrowding in cities. I appreciated your approach and sensible advice and information, which will prove very helpful. The land categories are so important and many coming from abroad might be a bit naive and not realize this. Unfortunately, some get tricked into buying land that is not the right category, eg for farming, or building a home on. Then have their dreams destroyed..

I live here since a year and I can tell you that many properties are offered way above market value and go up in price if the find out that you are not native. They will do anything to sell it to you, so get professional help, take lawyer at the least, maybe even two. Also many properties are only partly official, the rest has been added over the years without paperwork. All unpaid utilities remain with the property, so your lawyer should investigate unpaid bills as well. Remember that once you are ready to invest here, also invest in legal protection which is only a small amount of the total bill. Thanks for making this video.

This is excellent advice, thank you, and by the way, your english is brilliant! 😊 I guess what you are saying - in excellent and most informative, helpful detail - can be summarised in three basic principles: 1) BE RESPECTFUL! (seja respeitoso!) As a guest or new arrival into a location, whatever its size and profile, the rule of thumb should be RESPECT . In Britain people EXPECT RESPECT of British laws and regulations by foreigners, so it shouldn't come as a suprise that Portuguese authorities, officials and residents should expect the same. In my 65 years of experience I have found that nothing opens doors like polite, friendly and respectful request for instruction, and observance thereof. 2) BE HONEST AND FRANK! (seja honesto, franco e aberto!) The nore we tell the local planning authority about what we are trying to achieve the better they can help, and in that I can imagine that hiring a local expert, though perhaps a llittle costly to beg in with, could save a great del of money and deelays, later on. What's more it can ensure that ALL paperwork is correctly completed, with translated copies, and requirements are carefully listed and explained, for example in terms of responsibilities, boundaries, one-off and recurring payments, limitations, permits required and sanctions for infractions. 3) DON'T TRY TO BE A SMARTASS! (não tente ser um espertinho!) Trying to impress people with how much we know, or, worst still, trying to cut corners, do things 'off the books', playing 'Anarchist', or get around laws and regulations by not decalring everything upfront is NOT clever, it is stupid, and DISRESPECTFUL! When people find us foreigners (i am Italian by birthm but in the UK for almost 47 years) they righfully resent it, and it reflects badly on their impression of ALL people of that nationality, or even ALL foreigners. There is no reason that should be any different in Portugal or anywhere else. So thank you for this excellent, concise guide, Raphaël, my partner and I hope to get in touch, at some point, impressed by your open and helpful website and guidance. In the meanwhile, I hope the Covid 19 epidemic is not affecting you and yours closely, and that you and your families keep safe and healthy. Be well, be loved, be safe, be happy!

E tenham muito coidado com certa gente que existe por ai, sem moral. Que tentam embrulhar e enganar o estrangeiro, com pouco conhicemento da lingua e costumes regionais. O investimento em areas rurais em Portugal, nunca foi tao necessario como agora.

Gea Vox .....these are good principles to follow, no matter where one lives. Sadly, in my country, Canada, rules 1) and 2) are largely ignored and, indeed, they often expect our laws and rules to be bent to their will and complain vociferously otherwise!

OK Your video in short: nothing is allowed by law. You have to apply for building permission for EVERYTHING. It's false marketing when Pure Portugal markets some plots as "suitable for yurts and mobile homes"

This is what i was thinking too watching this. Basically cannot build nothing without a permit. So what is the point of owning 'off grid land' if you cannot actually do anything on it? And if you put up a 'temporary' home you can only have it on YOUR land for a year. So what's all this hype about going off grid if you cant actually escape the system?

Hi Raphael! Excellent video! You mentioned some districts will be more "welcoming" when it comes to building without a license, to attract more people. Would you be able to name some of these districts, or even "conselhos" if any come to mind? Thank you very much in advance!

Hello Martins! The list is always changing since it will depend on developping programms and national politics, but, a safe bet would be: Sertã, Idanha-a-Nova, Oleiros, Fundão, Guarda, Pedrogão, etc. Central Portugal, the Beiras, and some places in Alentejo are in need of new people to curb the desertification tendency. People recuperating ruins and bringing a new life is a big concern for certain places (actually, you could say that for the generality of Portugal, but, you got my point...).

Impresionante como Portugal é um dos países mais restritivos da Europa em relação à construção de cabanas enquanto partes do país estão repletas de barracões. Seriamente a considerar comprar terreno em França ou Espanha em vez de Portugal onde a lei é mais clara e mais permissiva tanto para construção como uso para alojamento local.

Thanks for your video. When you talk about specific programmes for people to go and live back in their land, do you know if something like that is happening around Seia area? Also, I've seen you build tiny homes. What is the price range of those and also, do you include legalisation services for agricultural land permissions to build? thanks again

Sou Advogada e concordo perfeitamente. Nada de construir ilegal. Contudo, já vi edificios legalizados pelas Câmaras e é insuficiente. Temos os exemplos jurídicos do Prédio Coutinho em Viana do Castelo, e muitos outros pelo país. Já tive um caso destes. E aqui não há lugar a invocação de direitos adquiridos. Mas é possível a obrigação da Câmara de indemnizar por danos causados. Penso que, muito em breve, haverá legislação para estas edificações. O governo não quer barracas semeadas desordenadamente por todo o pais, nem vai perder a oportunidade de cobrar mais impostos.

Exactamente. Uma casa é uma casa e precisa de projectos de especialidades (que dão garantia de qualidade e segurança ao futuro habitante) e da devida legalização que confere todos os direitos legais (seguro, revenda, etc.). O problema aqui é quando deixamos de lado os imóveis de dimensão normal para nos concentrarmos na construção de unidades (qualquer que seja o material, painéis, madeira, aço leve, etc.) que pela sua dimensão não justificam o custo de um licenciamento tradicional. É o único ponto onde compreendo a tentação de mudar as coisas: não é justo ter de pagar o mesmo para uma tiny house de 30m2 do que para uma residência de 130m2. Claro que as câmaras têm tarifas diferentes para diferentes dimensões. Mas a nível de projecto, requerem quase as mesmas especialidades. Logo, os mesmos custos associados a nível de projectos. Se a Lei integrasse essa nova realidade (casas muito pequenas, mais leves, quiçá apenas de residência secundária, etc.), não somente ajudaria ao repovoamento de locais mais desertificados, como que estimularia a economia e a construção de qualidade, de acordo com padrões definidos por Lei. Pois que construir de forma selvagem não é a solução. É um mau investimento, é perigoso, ilegal, e frequentemente de qualidade final muito duvidosa (em termos de arquitectura, estabilidade, isolamento, etc.).

As long as they are legal, every region. Probably not inside towns, because usually an Ecological house will not correspond, in architecture, to the urban planning. But lands around towns cannot forbid to install a legalized house. You have to submit architecture and specialties (like insulation and stability) to get approvement from townhall (Camara).

@@SaintJeronimo not complety true Raphael. In Lagos, Algarve, due to municipal norms you are not alowed to do anything. Not even a legal wood house. Not a caravan stoped in your land. Nothing. Its absolutly absurd the level of stupidity. This is general for the algarve... absurd. This guys should be promoting sustainable living and they do exactly the oposite. @@pedrgloria Of course it is true IF the land is buildable. Algarve is no exception. Everywhere in Portugal there are lands where you cannot build. We are always talking here of land where you can build. Hence the sentence "as long as they are legal". In all my videos I mention the importance to check the possibilities of a land before buying. @@SaintJeronimo estou a falar de terrenos urbanos. Em Lagos não permitem casas de madeira. Podes tentar tu próprio meter um PIP na câmara para construir uma casa de madeira num terreno urbano. Simplesmente não deixam. Remetem para o seu regulamento interno. É absurbo.

Partindo do princípio que a ruína está registada na caderneta predial do terreno e que preenche certos requisitos de antiguidade, é sempre legal recuperar o edifício desde que não se proceda a um aumento. Qualquer modificação requere sempre consulta camarária.

Who says they have? And I quote the Decreto-Lei n.º 555/99, de 16 de dezembro: «De acordo com a Lei, qualquer edificação para utilização humana prevalece sobre o eventual caráter desmontável ou amovível da mesma, uma vez que, mesmo não tendo uma efetiva incorporação ao solo, têm elementos de conexão, como as ligações a infraestruturas locais e gerais (água, saneamento, eletricidade, gás), assumindo assim um caráter de durabilidade e de permanência». Meaning: what is said in the video still applies. A house, even removable, is a house and occupies land. Even a mobil-home needs a land inspection before being installed.

Just curious, is it allowed to build a small spanish-style house (8mx15m or smaller) in a farm land in Central Portugal?

You mean, whithout the need to license it? No. That is way too big. A 120m2, no matter the style, is a permanent structure that needs proper legalization. The maximum that I know of is 40m2. And that is only in certain cherry-picked parts of the country.

@@as-1982 Not at all. I understand your concern but, as long as it is with an architecture project, you will be able to submit all kind of architectures. We have extremely modern houses in the middle of the mountain. Minimalist houses by the sea. Brutalist houses (concrete! concrete everywhere!) in the countryside. As long as you have a project, a concept, and you try to build something with quality and respectful of your surroundings, you have a good chance of having no problem with an original style. The exception of course is towns or locals that have a very protected style (schiste villages, medieval villages, old downtown cities, etc.). And even there it is not impossible. In Monsanto you have, at the entrance of that thousand year old town, a very modern restaurant. It is all about submitting a project to townhall with the help of an architect.

If the reality has not been considered yet by the Law (e.g., Yurts), then no, it isn't. Local townhall's have had the tough case of going case by case. Architects work on these kind of unique cases.

I have lived in Portugal for over 18 years and I love the people and the country BUT as they say here every case is different and you will never get any concrete information and will get so many different opinions. Don’t trust anything you hear and above all don’t employ any legal services until you have spoken to all the relevant authorities and above all the people local to you. You can spend a lot of money and wasted time with a legal representation and will get so bogged down with paperwork and excuses. Spend your hard earned money wisely. Good luck you will love it here.
