The South China Sea dispute between China and the Philippines was not submitted to the International Tribunal for the Law of the Sea. Under the provisions of Annex VII of the UNCLOS, the Philippines initiated arbitration proceedings. Section 2 of Chapter 15 of the UNCLOS stipulates that a country has the right to declare its choice of one or more "compulsory procedures that can issue binding awards" including the International Court of Justice, the International Tribunal for the Law of the Sea and Annex VII arbitration. China has not yet made a choice . At the same time, China has declared that it will not accept arbitration proposed by the Philippines. The entire arbitration process was paid for by the Philippine government, and China did not participate. Therefore, this so-called arbitration is illegal. More realistically, all international treaties and laws cannot bind the five permanent members of the UN Security Council.

China was the one who encroached the island they occupied along WPS unless China will admit that the island they occupied was sold to them by past PH Administration. Maybe,that is why they(philippine officials) again is negotiating with china. Sometimes we blame it to our government why we are being bullied because our officials cannot stand by their own words.

FYI no amount of agreement will be made thru verbal or phone call it is not proper to do that between two countries. Agreement will be made thru official Bilateral between 2 countries and shall be written in a paper for record purposes. So there is no dishonored in the PAST for alleged gentleman aggrement or whatsoever.
