Tim, the ATF has no rule making authority. Congress can't delegate law making out to other federal corporate agencies, it must go through Congress to have any effect, as upheld by multiple Supreme Court rulings, most recently the EPA vs. West Virginia case. And this applies to all agencies, including but not limited to the ATF and the IRS. These corporate entities don't have power over we the people. We need to start acting like it.
Well, that's a commendable le position, and things should work that way. Congress has abrogated its responsibility in allowing these so called "enforcement " agencies to decide policy. Congress needs to be held to account for the blatant ambiguity and abuse of power that they allow to these agencies. As it stands now, these agencies can and have ruined lives.
I'm pretty sure Congress passed an act allowing itself to delegate rules and interpretation of laws they have passed to agencies tasked with enforcement. Surely we should know this rather than just complain that it is wrong. At least then we'd know the specific legal hold ups. Edit: I looked it up. I wanted to add that it is illegal to convert your AR rifle into a pistol. If you buy an AR rifle and change out the stock to a brace and change the upper to less than 16in, it is illegal. You can convert a pistol to a rifle but not a rifle to a pistol.
@@ethanking4954 start with a new stripped receiver, build a pistol.. Pin and weld a barrel extension of some kind. I like the fake suppressors. But remember that a pistol over "26 inches in length is an "any other weapon" requiring a tax stamp. Best to swap brace with a stock as you would your barrel. I've got a 20" and a 10.3" as well as a .300 blackout 16".

If you can't understand the difference, then it shows that you are ignorant. And I mean that in the true sense of the word, not as an insult. Laws don't care about your opinions. They don't necessarily make sense, but you don't get to arbitrarily interject or change them. That is Congress' job.

Why is the concept of regulating firearms at all not challenged in court? “The right of the people to bear arms shall not be infringed” does not discuss any qualification of any “arms”. Possession of any Rifles, pistols, shotguns, cannon, knives, clubs, vehicles, battering, rams, grenades (aka petard), and any other weapon, is liable to get the bearer arrested in virtually every major city inside the USA, which is all together in violation of the second amendment.
Good job explaining it in layman terms. The new ATF gun laws about braces, stock, length, rifles, SBR, pistol is extremely frustrating, confusing, and scary since law enforcement are not updated or knowledgeable with them and they are just as confused like us with the new ATF tax stamp/registration laws. If cops see you in a blue state such as California with an sbr or a pistol with a brace, they would automatically harass you and give you hell and demand if you have a federal TAX STAMP and if its registered, that is if they haven't shot you dead yet. As a pistol-with-brace owner nowadays you have to be assertive and knowledgeable with law enforcement. It gets more complicated with different state laws. This is one reason people are moving out of California aside the housing price crisis.
Let's be honest, it's all a vocabulary game. SBR's and Pistols with a brace are the same thing and the ATF is out of line trying to regulate something as irrelevant as 4-8 inches of barrel length.

Mistake In Video - Excellent video. It definitely explained the distinctions clearly and I Thank You. The only mistake was at 2:30, you verbally state minimum length of 26 inches, and the video states "LESS" than 26 inches.for overall length. That threw me off at first, but beyond that, it is an excellent video.

I'm all for getting rid of the ATF and their nonsense.... but, and I say this as UK resident not an American, the idea that any of those braces are NOT designed to be fired from the shoulder is plainly a joke. Almost everyone using a brace uses it as a stock. Again, you should have the right to an SBR without ATF approval IMHO. But pretending that braced "pistols" aren't designed to be fired from the shoulder is just disingenuous.
SBR is a novelty in the US, pistol is the way to go if you actually plan to use it. I own both, SBR stays in the safe save for range days, pistol goes in the truck with me at all times.

You don’t understand the 2nd amendment to being with. I agree with Tim, there are certain criteria that SHOULD keep you from buying a weapon. Domestic violence offenders are already on the list for one.

There's some bad information in here. It's not simply a matter of putting a brace on it or putting a stock on it, that determines whether you have a pistol or an SBR. You can't just take a rifle and swap out the upper for a shorter barrel, and then throw a brace on it. Once a rifle, always a rifle. What matters is how the gun was originally "designed" when it was serialized and how it was designated when transferred. Ironically, if you buy a "pistol", you can put a 16" or longer upper on it all you want, and switch it back to a shorter barrel whenever you want. Once a pistol, always a pistol. In other words, just make sure that all your AR lowers are "pistols", and then do whatever you want with your uppers. Side note, if you own an AR "rifle" and you buy just an upper with a barrel less than 16". The ATF can and will charge you with "contructive possession" of an SBR. So again...just stick with "pistol" lowers, which are generally covered by your CCW while "rifles" are typically not, but check your state laws to be sure on that one.
@@JamieFaux-qi6ip That's incorrect. The 26" overall length rule comes from the NFA and only applies to rifles and shotguns. Essentially they have to be more than 26" OAL and have a 16" barrel, 18" for shotguns. Obviously this is all a confusing mess that makes no sense, which only proves that it's all unconstitutional anyway. Out of this mess they created a whole other class of firearm called "other", which is basically a weapon that's over 26" in total length, but has a shorter barrel, but no stock. This is why the Mossberg Shockwave is legal. It's not a pistol, but it's technically not a shotgun either. As far as ARs go, the lower receiver is the firearm, only because the design of the platform presented a huge problem for the poorly written unconstitutional laws. So they arbitrarily selected the lower as the part that must be serialized. It's completely subjective, and arguably neither the upper or the lower is actually a firearm, but you can see what a problem that presents for tyrants. So, whatever the lower is originally configured as, is what it is. If it's a pistol from the factory, then it's always a pistol. You can put a 24" upper on it and it's still a pistol. There's no restriction on how long a pistol can be, only on how short a rifle can be, and it's a combination of specific factors that make it a "rifle", such as being "designed" to be fired from the shoulder.

Timothy Cunning's 1771 legal dictionary, the definition of "arms" is "any thing that a man wears for his defence, or takes into his hands, or useth in wrath to cast at or strike another." This definition implies any arm is bearable, even if the arm isn't portable (i.e. able to be carried). As a matter of fact, see the complaint in Clark v. Garland (which is on appeal from dismissal in the 10th Circuit), particularly pages 74-78. In this section, history shows that people have privately owned cannons and warships, particularly during the Revolutionary War against the British, and it mentions that just because that an arm isn't portable doesn't mean that it's not bearable.
