Planning Permission: What They're Not Telling You

We've been asked to talk about planning a lot, but have avoided it until now. Why? Because there are some hard truths that many off-gridders don't like to talk about, and with good reason.
Getting planning to build a house on agricultural land, in woodland or, well, quite frankly anywhere is complicated at best and impossible at worst, and yet so many people still dream of building their own home.
If you are hoping to build a low-impact house in order to live a simpler life, here are the things that we have found to be true but that no one wants to talk about:
Time - whatever way you go about getting planning permission, it seems inevitable that it will take a very long time... probably years.
Risk - unless you are extremely rich or have friends in high places, the odds are that it will involve some form of risk-taking, which may make some people feel uncomfortable.
However, that doesn't mean that it isn't possible, and this video we give some tips as to how you can go about it.

I know a Freemason in Somerset who buys tiny plots of agricultural land and always gets planning permission to build a house or two. I am not going to say he gets permission because the head of building control is also a Freemason.

An absolute circus of a system and no mistake! As you said, the worst annoyance is the huge dual standard of developers being able to build housing that detrimentally affects the area but an individual cannot build a small and unobtrusive home on their own land.

@@meljen8592 not really, developers can establish need for housing due to the chronic housing shortage in the UK and individuals cannot,to get change of use for agricultural to residential you have to prove lawfull need and developers already have that,its really that simple.

Also the totally ridiculous situation that it's much easier to put a load of airbnbs on your land than it it for a house to live in - even if the airbnb is occupied 365 days per year. Loads of wealthy people with land have done this around us.

It's illegal to have 'no fixed address' in the UK. Think about it: The government isn't getting as much tax as a house generates. Private firms aren't getting your utility payments, who's policy is decided via the government - who also likely profits from your money. The government can't threaten you into submission; they can't take your shelter. The mortgage business; banks, solicitors, estate agents. All missing out on your 20+ year debt from being priviledged to own a home. A lot of sectors and people miss out on a lot of money, from you not 'buying' a house. Plus - this is the kicker - if you're not needing to work as much, or earn as much, to pay your mortgage off, then the country misses out on your taxable income. This is why governments don't want you 'un-shackled'.

I quit the UK for eastern Europe, here you can live on your own land. You can buy 1 ha of land for as little as £5000, property taxes are 5% of that charged in the UK. You can easily live an off grid lifestyle far cheaper and safer than being in the UK.

well done to you, I would love to do that but what puts me off is being a foreigner who doesnt speak the language. It would have to be when I 'retire' also because I don't do an internet based job. Do you think there are enough Brits or other English speakers there to make a 'community'?

We bought a corner house, on a largish estate, with the sole intention of extending, I designed the extension to blend in, look like it had always been there. The council wanted us to make changes which would ruin the looks and the internal layout. I got the planning officer around for a site visit. I took her for a walk around the estate, pointed out all the properties which set a precedent, I also pointed out all the properties which looked hideous because the extensions didn't blend in. Within two days I had my planning permission as I had designed it. As with everything in this country you need to know how to work the system.

Get a TV licence then cancel it after a month. TV licencing will be plaguing you with letters for years.

My neighbour has just got permission to build three houses in his garden . The local farmer has built vast buildings for indoor boot sales and has artics delivering good there and basically running out of it and it’s a 7.5ton country road . John bloor has been granted permission to build over a thousand houses in a field quarter of a mile away or less . But I got turned down for a 2mx4m porch 🤦‍♂️

Here in the states, we are given a warranty deed when we buy land. This binds us to the municipalities jurisdiction. However, we can request from the Bureau of Land Management a certified copy of the letters patent for our lands Metes and Bounds. After collating the relevant sales history combined with the Land Patent we can post it on a public bulletin board such as a town hall or library for 60 days plus one. At the end of the 61 days we take it to the county recorders office so it can be recorded as our land thereby, nullifying the warranty deed. At this point we are forever free to do what we will with our land without planning permission, permits, inspections, codes and ordinances. And this without reprisal.

Another very informative vid Fraser. From what I’ve read, the removal of the 4 yr and 1 day rule is part of the Levelling Up and Regeneration Bill. Words copied from there read: ‘’Whilst certain items within the LURA took immediate effect, this is not the case for the 4 year rule provisions. This means that although the LURA is now adopted, the 4 year rule is sticking around for the time being. All we know is what the LURA tells us. Specifically, that the 4 year rule will be swapped for the 10 year rule “on such day as the Secretary of State may by regulations appoint”. In plain English? This just means the 4 year rule will be cancelled on a future date to be decided by the Secretary of State. The Secretary of State will publish a secondary item of legislation which will officially declare the date of its cancellation.’’ I’ll email you some information 👍 Cheers Paul

I sympathise, having dealt with Planning officers for over 4 decades. They do make it personal which is wrong. I also, sadly, agree that it is easier to ask for forgiveness rather than permission. Many owners/builders are not gaining permission now, and that is The Councils` fault. PO`s premise should be `how can we approve this` not `how can we refuse this`. The Planning system needs shaking up, and maybe Labour will do this - we will have to see?. I would suggest only apply for a LDC following any Enforcement, so not to risk refusal, sad but true.

Totally agree with what you say. Have you studied the John Nix handbook? You can even rent the livestock from a local farmer in order to get planning permission. Most councils cannot object to these guidelines.

I've just come across your channel. Really interesting. We're Brits living off grid in SW France but a lot of your challenges resonate with us. Planning permission is a nightmare and the government seem a little suspicious of anyone who is trying to live what they see as an 'alternative lifestyle'. I guess they view us as a bunch of hippies not wanting to contribute to society (even though the off grid movement in France is huge, and growing). Keep up the good work, keep the videos coming and most importantly, keep the faith!

Excellent advice and just the way i would do it if i find woodland to buy. Slowly and quietly bit by bit get the locals used to the land being worked and improved.

Agricultural land in the UK is protected ,to live on it you have to get change of use to residential,for that you have to prove a lawfull reason why your need to live on that land overrides the UK economic need to have that land as agricultural thats why its so hard,an agricultural business will maintain the economic status of the land but there are not many agricultural businesses which demand you live on site,large building companies building at scale will come under established need due to the chronic housing shortage in the UK but an individual cannot,it all seems so arbitary when looked at from the outside but it is 100% down to the Town and Country Planning Act,any body trying to live on agricultural land needs to know this act inside out which is near impossible so the only way really is getting a planning agent.

Yet a developer can come in and demolish hedgerows and concrete over the fields, land that can never be converted back to agriculture, vs. a small dwelling in a field

@@LaughingMan44 developers have already established need due to the massive housing shortage we have,its not about it being able to be changed back to agricultural land its about establishing a lawfull reason for it to have change of use from agricultural land to residential land,all land in the Uk, if you want to live on it has to have residential planning,you are not allowed to live on agricultural land unless you can establish lawfull need and nearly all individual need is classed as "want" in UK law so doesn't stand a chance of getting change of use planning

@@LaughingMan44 Im not obsessing over the law Im explaining how the system works,you have to understand planning law and the ideology behind it to even think about trying to do anything remotely "none conformist." BTW I live off grid in a cabin in the woods with no planning permission and almost no chance of getting it,the only chance people have to do what I have done is have an in depth knowledge of planning law ,my own personal feelings about planning law and random ramblings about what I think should be done ultimately help no one,land is used as a means of control to stop the majority gaining any power, but knowledge is power

Councils are corporations and rely on you accepting that they have the right to grant or refuse permission thereby making a contract between you. I built a cabin on my land 8 years ago and responded to all their communications by asking for a contract showing their authority over me. This method also works to stop council tax demands and many other scams. Make sure you have read all their rules and watched every video you can and digest all the information before you go down this route. Richard Vobes has a load of information on his channel.

Until the house prices are valued at what it cost to build +materials + cost of land the planning department will try and stop people from making a fast buck in their eyes and the people who paid for rural exclusivity will be resentful where I am in East Sussex new money wants to live rural and get on the train to London they do not want anyone without their value system living next door

Uk , very strict planning laws here ! Unless you’re a developer and want to put up 500 houses . We can’t even put a caravan / motor home with out planning unless there’s a president ( previous dwelling )

Travellers seem to be left alone by the councils and eventually get planning on land! This is very common in the London home counties. If the council want to build a housing estate on agricultural land, they would just do it without any consultation from the locals. They would rubber stamp it regardless. And if you do by land, make sure its not next to a Karen 😁 The whole system is corrupt.

you have to understand the planning act,to live on agricultural land you have to establish need,this need has to be lawfull,so running an agricultural business which demands you have to live on site,not many reasons,for example trees dont need 24 hr looking after,I think now only a stud farm will give residential rights,but due to the Uk wide housing shortage building companies building at scale can identify need ,that cannot be used on a individual level as there is always 1 spare house to rent or buy,because there is also a massive shortage of places for travellers which the government is breaking its own laws on then travellers also can automatically establish need.Its very much to do with the wording of the planning act.

ASHP's do work in the cold, after all, they are ubiquitous in the Scandinavian countries and it gets pretty cold over there. I personally have an ASHP, retrofitted in 2021, and it's lovely and comfortable.

They only work if the house is as air tight and well insulated as Scandinavian homes. Most British buildings are not built to these levels as they are old and leaky. Hence heat pumps don’t work here. 🤦🏼‍♂️

@MrMonero mine is a 1970's 4 bed detached house with a floating wooden floor. I have improved insulation and double glazing. A heat loss calculation was performed as the system designed around my house. It's really a simple calculation, can enough heat be added to raise the internal temperature to the required level and cope with the heat loss. The amount of insulation etc determines how much the heating system will cost to run be it ASHP, gas or oil etc.

I remember watching a guy who did it by building his house on stilts on a land that he used to make charcoal for his business. Because it was built on stilts it wasnt classed as permanent dwelling. They couldnt touch him. It took him a few years and he had to show that he needed to be there all hours of the day. So the council said as long as the living arrangements weren't permanent (concreted in) he could live there but when he decided to leave he woukdnt be able to sell it as land with a home.

wouldn't work now .Most land is agricultural to stay on it for more than 28 days a year,no matter what your in,tent,house on stilts or cabin ect you need change of use to residential,this is almost impossible to get as there is always a presumtion of refusal unless a lawfull need is established,charcoal burning used to be a lawfull need but now also carries a presumption of refusal for change of use. The "permanent dwelling" rule is many decades out of date.

Problem Ive got and I’m sure many have the same issue: I have. House with a mortgage, I would need to sell the house to buy the land but would have to live on it straight away as the house would have gone.

Interesting view. Thing is you need planning laws. And once you have laws you will get people trying to get round those laws. So as usual they have to be ambiguous and open to interpretation.

Oh my word... the level of cyst-emic absurdity in the modern world is... ummm... lost for words. You both often seem rather relaxed and in search of a way around all those instances of bureaucratic retardartion, but aren't you really indignant at what's goinig on? Also, as an Eastern European off-gridder, I have to admit that the cost of land is on the rise. Surely, one can purchase land for pennies here and there, but that'll be rather unlivable. It is, however, failry easy to "change the statut" of farmable land into that one can build on. For houses up to 70m2, no need for any official permits. This is the situatiuon in Poland, at least. Such a blessing it would be to have conscious neighbours around...
