Lowell Evans, regional director for the Epilepsy Foundation of Virginia, details an experience that unfortunately happens too often to those who have seizures. Instead of being treated for his seizure, he was arrested because the officer thought he was drunk. Lowell is speaking up to bring awareness to another justice system injustice that is not talked about enough.

I have went into status epilepticus in front of EMS because of this. I have a grand mal and then sometimes a partial after that. They don’t acknowledge anything other than a convulsion as a seizure. Partial seizures are the second most common type of seizure and epilepsy has been found in a huge population since history of humans. It’s amazing that emergency personnel doesn’t know more about it. You handled it so kindly. I’m very frustrated and I can’t say that I would have been so kind. I’m terrified of having a seizure in public and someone calling EMS.

The police should be aware of the difference between someone who is going through a seizure and someone who is drunk. A drunk person will have the odor of alcohol on them. Someone having a seizure will not have the odor of alcohol. It appears that the police officer who approached Lowell Evans had a total misunderstanding that he was having a seizure and that is why he had pulled his car off the road. He developed a sensation and knew that a seizure was possible. He simply had a seizure and he was at no risk of causing harm to others. All the officer needed to do was to asked him his name, where he was and the day's date. Just expect some confusion if the person is in the post ictal stage that follows the seizure. Also the person might not want to drive after they have had a seizure so it would be best to offer some assistance. It would be helpful perhaps for many police departments to have an special officer assigned to deal with those who have epilepsy and it might be a good thing that the officer has epilepsy themselves (make sure that it is under good control) so that they'll understand what the person is going through when they're having a seizure. It is also strongly suggested that the person affected by epilepsy or other seizure disorder carry a card with them that states that they have a seizure disorder and what to do if they're found having a seizure. Except in a few rare cases, they will not need medical attention. They will simply need assistance. Once the effects of the seizure wear off, the person will generally be O.K. However it might be a good idea sometimes for the officer to take to person home or perhaps to the police station to take a nap after the seizure until they feel better. Some people with epilepsy will be wearing a bracelet stating that they have epilepsy.

You are correct on that but he couldn’t respond because he was having a seizure. He was not Postictal. Partial seizures manifest differently depending on the part of the brain that it originates from. He was actually Postictal in the cop car and was pretty with it. That’s not always the case. God was with him that day
