Portsmouth MOD Police pulled me over saying that my registration was coming back to a different vehicle, they soon changed their accusations. No ID, No Details!!!! Audit of Portsmouth MOD Police.
@johnferguson40 You want to see USA of not knowing the law tooting there guns crazy from 2013 to 2024 over 10 000 people have died at police hands using firearms. 😢
It's a good idea to address them politely, even overly polite, because then they'll struggle with a BS public order charge, and imagine if it went to court and them trying to justify to a judge or magistrate that you were rude or aggressive when not raising your voice and calling them Sir.
It astounds me that those involved in enforcing laws, don't know basic legislation. How many professions would allow you to be this ignorant while conducting your day to day activities?
This is what the MOD police are like. They don't have the workload like the normal constabulary's have so go around trying to find people to bully on the most trivial matters. I got pulled for accidentally taking a wrong turn at Mildenhall airforce base. They pulled me like this man and then tried to do a background check and thought it was relevant to bring up an assault accusation from five years ago then stand there grinning like morons as if they had somehow shown what powerful men they were! I applaud you sir for showing what sad little time wasters these people are! Remember if these folk start hounding you, do exactly what this guy's done and take badge numbers and names and follow up with a complaint! Didn't indicate? What clowns!
You say that, but given their MOD role, they would have very little regular experience of traffic stops. This means that there are many sections of legislation that they would seldom need to refer to - an example being s43 Terrorism Act - it only being on the very rare occasion when a search may be required under that section. Things happen quickly and suddenly they have to start quoting specific sections and acts?
@@Audit-The-Auditors unfortunately I don't agree mate. They are a professional outfit and should be knowledged up on basic law enforcement wether MOD police or regular. Agree with other specific law only attributle to a particular service but basic legislation which they could come into contact should be learnt. Maybe I am to much of a perfectionist but I certainly wouldn't go out into my field of expertise and quote something that is clearly wrong or didn't know. I would be in the crap from my senior management. But hey, it seems professionalism is rare these days
@@MG-nm9gt Being 'professional' simply means you are paid to do something, so every single person in every job that culminates in a wage is a 'professional', it does not reflect competency. There are hundreds of acts and sections, so if you don't use one for any protracted period, not every human being will be able to instantly recall it when required. However, you sum it up beautifully with 'field of expertise' = MOD police are not experts in traffic legislation, so don’t patrol the streets, they protect sites of national importance , which does not usually encompass the above type of work.
I couldn’t watch this video till the end, it infuriates me that these idiots expect people to perform like circus animals when they bark the commands, and yet they have no clue about the laws they are supposed to enforce.
If you want to see a video in which a police officer did not conduct a stop and search properly, see "Southwark Police Station (revisit)" and the channel is "kolleberks."
This happens so many times police are clueless to their own simple procedures Sec 163 to stop then Sec164 or 165 to obtain details It's not fuc king hard It's like a builder that doesn't know the ratio of how to make cement You did great job 👌
detained without arrest for over 16 mins, they earned about £20 between them doing that. the police have far too much time on their hands. people have been saying for years that, the police believe its their job to harass the general public if they haven't been told too do something else. but, they won't go anywhere near a real criminal unless someone makes a complaint. it just doesn't make sense.
And I'm happy that you 2 cops need to go back to school, under section 163 of the road traffic act the driver does not have to give you any details. All the driver must do is pull over if requested to do so by an officer.
@@neilcampbell2222 come on Neil you can search this stuff yourself: Section163 Power of police to stop vehicles (1)A person driving a motor vehicle on a road must stop the vehicle on being required to do so by a constable in uniform. (2)A person riding a cycle on a road must stop the cycle on being required to do so by a constable in uniform. (3)If a person fails to comply with this section he is guilty of an offence. You will need Section 164 to discuss providing a drivers licence or ask for the drivers date of birth You will need Section 165 to discuss providing a drivers name and address, the vehicle owners name and address and details of insurance and test if appropriate.
Not knowing the regulations. Trying to use their perception to accuse you. And the insult to the flag of our country (black and white with a blue stripe) they are a disgrace.
In this country, the requirement to indicate is as follows, Signals should be given clearly, in good time, WHEN THEREIS SOME THERE TO BENEFIT. this means that if there is no one for whom the signal would be of benefit, there is no legal requirement to do so. And I know this because...... I am a Grade 5 Driving Instructor with over 37 years experience. Im afraid these Policemen are fishing in the dark
MDP officers may now exercise police powers where a ""local police force requests the assistance of MDP officers""". This is most likely to be in support of defence related tasks; major civil emergencies; or the provision of specialist policing capabilities, such as marine policing. Where such assistance is provided, Ministry of Defence Police officers will be under the operational control of the local Chief Constable from the requesting force, and will have the same police powers as officers of that force.
Section 163 of the road traffic act only give a police constable in uniform the power to STOP any vehicle on the road. They then need to use section 164 to ask for driving licence and 165 to obtain names and addresses.
@@waronthestreets7456 I've seen so many videos where the police think sec 163 covers everything. You did a good job stopping them in their tracks especially when you quoted the legislation he was trying to "Abuse" back at him.
How many times do we have to tell these officers that Section 163 says you have to stop, only sections 164 or 165 req's your details etc,,, Numpties, they could be called something else. Great interaction. Loved the video...... Nice One...
Seriously, if you want to increase viewers/ subscribers you only have to use your camera horizontally. That way everything you film fills the whole screen. This style here looks like a 90s home video. Not good; not professional. And you'll never get monetized if you stick to filming vertically......it's off putting.
There should be a recording of the occiffer asking to check your registration and it coming back as not the right reg for make of car. If he's able to check the reg himself then it's on his computer. Ask to hear the conversation or see the computer history for this interaction.
that was a little fishing trip by officers who by their own force protocol should confine their activities to the Admiralty dockyard. The Home Office regularised their status to that of a civil force a couple of years ago and they abuse that by going fishing when they get bored. They do have a reciprocal arrangement to assist the civil police when requested but this was clearly not the case. Unless their vehicle has a current speedo calibration certificate they can't pace you and I doubt the MOD provide speed guns. Sec 163 RTA is the power for a UNIFORMED police officer to stop any vehicle on a public road. Sec 164 RTA is the power to request your driving licence and proof of valid insurance. If they suspect you are giving false details they can detain you otherwise they must issue you with a producer. Sec 165 RTA is the power to demand your name and address but NOT your date of birth. Knowledge is power.
@John Bratley - Ministry of Defence Police Act 1985 gave them full police powers. They have been included in policing legislation since. Notably, they are subject to Section 26, Criminal Justice & Courts Act 2015 (Improper Exercise of Police Powers).
@@jimhalliday1871 the point is for one trying to be so clever and then actually admitting to an moving traffic offence which is on film and could still be served a summons for. Also admitting to changing lanes without indication which the mod police car saw, so they was a car in vicinity and being in overtake lanes with no other cars around are covered by careless driving and lane hogging. So yet again these ‘road warriors’ who think they know everything are sadly lacking in knowledge. I’m not your ‘mate’.
I hope you sent a invoice for the on the job training by a member of the public. Also if they don't pay the invoice could you off set it against you council tax????
163 Power of police to stop vehicles (1)A person driving a motor vehicle on a road must stop the vehicle on being required to do so by a constable in uniform. (2)A person riding a cycle on a road must stop the cycle on being required to do so by a constable in uniform. (3)If a person fails to comply with this section he is guilty of an offence. 165 Power of constables to obtain names and addresses of drivers and others, and to require production of evidence of insurance F1... and test certificates. You should have accused him (on his body camera) of lying about the `mixed up reg number`, because he obviously was. They also lied about having to ID under section 23. How can the public respect these lying tyrants?
1. What is the jurisdiction of the Ministry of Defence Police? The Ministry of Defence Police (MDP) derives its powers to operate as a policing organisation from the Ministry of Defence Police Act 1987, as amended by the Anti-Terrorist Crime and Security Act 2001. Within the jurisdiction defined by the MOD Police Act 1987, MDP officers have the full powers and privileges of constables, identical to other civil police officers in the UK. The jurisdiction of MDP officers covers: land and Property anywhere in the UK owned by, under the control of, used by, or providing services to(a) the Secretary of State for Defence (b) the ordnance companies (c) the dockyards (d) Visiting Forces (e) Crown property (f) within UK territorial waters and (g) any land where their provision has been agreed by the Secretary of State individuals (a) employed by the Defence Council or Ministry of Defence, (b) subject to control by the Defence Council, and (c) Visiting Forces when providing mutual aid to any police force when witnessing any suspected criminal act or to save life and minimise personal injury MDP jurisdiction was extended by the Anti-Terrorism, Crime and Security Act 2001 in some significant respects. MDP officers may now exercise police powers where a local police force requests the assistance of MDP officers. Second, an MDP officer may exercise police powers to deal with emergency situations where he/she is in uniform, or in possession of documentary evidence of membership of the MDP, and has “reasonable grounds for suspecting that an offence is about to be committed, is being committed or has been committed, or “…reasonably believes that action is necessary to save life or prevent or minimise injury.” Third, a senior MDP officer may authorise MDP officers to carry out stop and search operations under section 44 of the Terrorism Act 2000 (which allows these powers to be exercised at random, without the need for reasonable suspicion). These exceptional powers are however subject to prior authorisation for a specific area and period of time by the Home Secretary. These powers are not exercised at the present time. The primary objective of the extended jurisdiction is to assist in the prevention of terrorism and to provide an effective police response to terrorist incidents or suspected acts of terrorism. 2. Policing protocols with other forces Local agreements with Home Office police forces (or with Police Scotland) are made between the MDP Chief Constable and other chief constables. These set out the agreed working relationship between MDP and other police forces, outlining where necessary areas of responsibility and accountability. The protocols make provision for consultation and co-operation between the forces, with the aim of delivering the best policing on the ground. 3. Why are there MDP officers serving overseas? The MOD requirement for the MDP directs the Chief Constable to provide specialist civil policing aid to defence and other international policing commitments in support of UK government policy. Over the past 15 years, MDP officers have served in various international missions overseas, representing about one third of the UK international policing contribution. Officers have been deployed to the Balkans, Iraq, Georgia, Afghanistan and several other post-conflict zones under arrangements managed by the Foreign and Commonwealth Office. The role of the officers is to train and mentor the local indigenous police. The provision of civilian police officers to peacekeeping missions is a valuable way of fostering international relations and honouring treaty requirements, as well as promoting best practice in fledgling democracies, encouraging trade, dealing with international crime, and helping reduce poverty by promoting internal security.
I got stopped one night in Germany taking an army friend back to his barracks, by the redcaps. Stood by my car with a smile on my face answering his questions. He wanted to know why I was smiling, and I replied that I was just thinking of something. He asked what I was thinking, and I replied that unless he was ordering me to tell him what I was thinking then I didn't have to. The poor deluded fool then ordered me to tell him, so I did. And he didn't like it as he couldn't charge me as he had ordered me to tell him. Bet he never made that mistake again.
JFC. The entire bullyboy toolkit is given to them with a mere half a dozen laws (Section 163 and 164 of The Road Traffic Act, Section 1 and 2 of PACE, Section 43 of The Terrorism Act, and Section 5 Public Order Offence), and they still can't be bothered to remember them.
The MoD Police only have jurisdiction on Mod land/property, in the same way that Military police only have jurisdiction on military land or over military personnel.
"Road traffic act" "Road traffic act" "Road traffic act" don't use some umbrella terminology as it is bound to be abused (officer thinks it is 135rta, explain real world would not know adam from eve) tell it AS IT IS, "Reckless driving" / "failure to yield"
Give me all your personal information so I can try and find some dirt to make a crime. Absolute joke they think we will bow down to this crap. Good job 👍
Ha ha ha this cop had to ask his colleague what traffic act I've pulled you over. Then he quoted 163, then saying this allows him to ask for your details. What sort of a cop is he ???? 163 JUST and only JUST requires you to stop and NO MORE. 164 and 165 that's the next step.
I wonder if these clowns got back into their car and said to each other...."Well we really handled that well" or did they not discuss with each other this escapade as they were 100% embarrassed? Hmmm Me thinks it would be the latter!!
