This video is based on Presumptions Related to Documents which are covered under Chapter V "Of Documentary Evidences"
Section 79 - 90A are specifically related to Presumptions as to Documents
Case Laws mentioned in Video:
R.S. Nayak v. A.R. Antulay AIR 1986
Government publications, state of affairs as to Government Business stated therein, are presumed to be unless rebutted.
Case Law on Section 79
Krishan Rani v. Chini Lal AIR 1981
The court held that in a divorce case, when a certified copy of the FIR was tendered in evidence, it was admissible.
Case Law on Section 80
Emperor v. Radha Halwai 1902
Where confession made before Magistrate did not bear his certificate, stating belief that it was freely and voluntary made, as required by section 164 (3) of Cr.P.C. It was held that it could not be admitted under section 80 without proof of its having been so made.
Case Law on Section 81
State of Rajasthan v. Union of India 1977
A statement of a fact is merely hearsay and consequently inadmissible in evidence, unless the maker of the statement appears in court and deposes to having perceived the fact reported. While newspaper reports testify to their contents, they are not admissible evidence of their truth.
Case Law on Section 83
Ranganath Ramchandra Suryavanshi v. Mohan 2008
It was held that if any map or plan is made for the purpose of any cause, the said map or plan will have to be proved to be accurate. The onus of proving such map as accurate lies on the party who wants to rely on the said map or plan.
Case Law on Section 85
Citi Bank N.A. New Delhi v.J.K. Mills 1982
It was held that court can presume that the notary public must have satisfied himself about competence of the executants.
