I found this in my recommendations after watching a video on the Jan 6 appeals ruling that the guy being held in pretrial detention for 7 months despite having no history of violence other than participating in the riot
I was hoping you would talk about this issue: After I pleaded not guilty at my arraignment the judge amended my bail agreement and said I had to register with a specific agent at the Department Of Corrections Parole and Probation within 24 hours and do whatever this person said. My attorney agreed with it and knew it was going to happen but didn't warn me. He told me the judge wanted to have my pre-sentence investigation to save time. My attorney gave me some tips on how I was supposed to deal with this agent, don't lie, don't talk about the current issue and don't offer any more information of past problems then you have to. The last sentence was, "call me if you have any questions." I have a feeling you would think this is perfectly acceptable and give me many reasons to justify it.
A cop says you are not under arrest you are only detained as they put handcuffs on and confine someone up in the back of a patrol car. A judge says in a detention hearing post arrest you are detained at the local jail awaiting trial. Sounds to me the outcome of both arrest and detained are the same. So why the legal semantics?
what about things like letting them see a clock or use their phones or the conditions of the jail (say the bedding)? also getting more chances to make phone calls. are there any appeals about these recently?
